This Amendment to Right of Way and Easement is made and entered this !!tay

2026 by and between City of Glendale, an Arizona Municipal Corporation (Grantor) and
El Paso Natural Gas Company L.L.C.,a Delaware Corporation(Grantee).
WHEREAS, by instrument dated October 17s' 1956, recorded in Docket 2086 at
Pages 506-507 in the County Clerk's Office of Maricopa County, Adolpe S. Damko, a
single person, ORIGINAL GRANTOR, did grant unto El Paso Natural Gas Company, a
corporation, as ORIGINAL GRANTEE, a right of way and easement ("Original
Easement") in,under,over and across a tract of land in Maricopa County,Arizona,for the
purpose of a right of way and easement to construct,maintain and operate a pipe line with
appurtenances thereto over and through the hereinafter described land.
Lot 1 (North % half) Section 5 Township 2 North Range 1 East; except that part
lying West of the West bank of New River, described as follows; Beginning at the
Northwest Corner of said Lot 1. Thence East 442.72 feet along the North Line of said Lot
1; Thence South V 14' West 464.46 feet parallel to the West line of said Lot 1; Thence
South 28'49' 40"West 955.54 feet to the Southwest corner of said Lot 1; thence North 1°
14' East 1301.77 feet along the West line of said Lot 1 to the place of the beginning.
WHEREAS,El Paso Natural Gas Company L.L.C.,a Delaware corporation,having
its principal office at 1001 Louisiana Street, Houston, Texas 77002, El Paso Natural Gas
Company L.L.C.,shall hereinafter be referred to as the GRANTEE; and,
WHEREAS, the undersigned are successor's-in-interest to the Original Easement
and GRANTOR the present owner(s)of the tract of land,or a portion thereof, described in
the Original Easement by virtue of Warranty Deed dated June 13a'', 2006, recorded as
document 200608069668 in the County Clerk's Office of Maricopa County,Arizona; such
persons or entities collectively shall hereinafter be referred to as GRANTOR.
WHEREAS, the GRANTOR and GRANTEE now desire to amend the Original
Easement through this Amendment in order to define legal description of Original Right of
Way;
NOW,THEREFORE,in consideration of Ten Dollars($10.00),the mutual benefits
to be obtained here from and other good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, Grantor and Grantee do hereby amend the
easement for as follows:
The legal description from Original Right of Way dated October 17, 1956, being:
Lot 1 (North %2 half) Section 5 Township 2 North Range 1 East;except that part lying West
of the West bank of New River, described as follows; Beginning at the Northwest Corner
of said Lot 1. Thence East 442.72 feet along the North Line of said Lot 1; Thence South 10
14' West 464.46 feet parallel to the West line of said Lot 1;Thence South 28'49' 40"West
955.54 feet to the Southwest corner of said Lot 1; thence North 1° 14' East 1301.77 feet
along the West line of said Lot 1 to the place of the beginning. will be replaced by the
Exhibit A attached hereto and by reference made a part hereof.
Except as herby amended, all terms and conditions of the Original Right of Way
and Easement shall continue in full force and effect and be binding upon Grantor and
Grantee,their heirs, successors and assigns.

TEMPORARY WORKSPACE AND ACCESS AGREEMENT
RE: Project: Line 2215 Pipeline Relocation AFE: 303792

City of Glendale of Maricopa County, (hereinafter collectively called "Grantor") of the real
property commonly known as Maricopa County. Parcel No. 142-60-005T and 142-60-005U located in
Section 5,Township 2 North,Range 1 East(the"Property"); it is hereby acknowledged, do hereby grant
unto El Paso Natural Gas Company, L.L.C. ("EPNG"), its contractors, subcontractors, agents, and
employees, the right to use temporary workspace (TWS) on the Property, northeast of and adjacent to
EPNG's existing 30' easement as well as access to the relocation site. The general area is depicted on
Exhibit "A" Temporary Workspace and Additional Temporary Workspace and together shall constitute
the "Temporary Workspace," and shall be utilized for the sole purposes of accessing with equipment
during scheduled pipeline relocation. Incidental use of areas outside of, but adjacent to, the Temporary
Workspace will be permitted so long as it is used in the same manner as the Temporary Workspace.
This Temporary Workspace and Access Agreement is effective when fully executed through April
30,2026, and may be extended an additional period of one (1) month.
EPNG shall indemnify and hold the Grantor harmless from any claim,damage,or expense to person
or property validly claimed under state or federal law which is directly caused by the negligence of EPNG,
its representatives, employees, contractors, or subcontractors in its use of the Temporary Workspace.
Upon completion of construction, EPNG shall (a) restore the Temporary Workspace, to the extent
practical,to its pre-construction condition;(b)have no further rights in and to the Temporary Work Space;
and(c) settle or correct damages to fences, improvements, and growing crops, if any.
