AUTHORIZATION TO ENTER INTO AMENDMENT NO. 1 TO THE CONSTRUCTION AGREEMENT WITH MIDSTATE ENERGY, LLC Presented by: Michelle Woytenko, Director, Field Operations Councilmember Tolmachoff requested a presentation on the item. Ms. Woytenko said the amendment to the service agreement with Midstate Energy, LLC, updated the vendor name to Veregy West, LLC, expanded the scope of work and compensation, and extended the agreement for one year with options to renew. The amended "not to exceed amount" would be $8,380,000 for the entire term of the agreement. All other terms of the agreement remained the same. Ms. Woytenko said the scope of work included light pole replacement, electrical service entrance replacements and new pole bases at Grand Linear Park, O'Neil Park, Northern Horizon Park and Lions Park; air-cooled chillers, air handling units, variable flow valves and electrical service at the Main Library. Many of the items were discussed during workshop sessions. However, pricing was not available until additional work was completed. Councilmember Tolmachoff said the cost had increased from approximately $1.8 million to $8.4 million. She asked what was added to the project. Ms. Woytenko said the big ticket items were at the Main Library, which included the air-cooled chillers, air handling units, variable flow valves and electrical service. Councilmember Tolmachoff asked if it also included the work at Grand Linear Park, O'Neil Park, Northern Horizon Park and Lions Park in addition to the Main Library. Ms. Woytenko said that was correct. Councilmember Tolmachoff asked about the vendor name change. Ms. Woytenko said the company had changed its tradename, but it was the same company. Councilmember Turner asked if the library project was being added to the performance -based contract or was it that staff had not had prices when the contracts were discussed with Council. Ms. Woytenko said a good portion of the project was already planned, but staff did not have pricing and had not decided what type of chillers would be used at that time. Councilmember Turner asked if Council could look forward to an analysis of how effective the performance -based contracts had been. Ms. Pederson said the proposed ordinance would authorize the City Manager to enter into a Purchase and Sale Agreement with Courthouse, LLC to sell City -owned property located at 4701 West Glendale Avenue, in AS -IS condition for the remediation and redevelopment of the parcel for commercial use. The TWG affordable housing development left a City -owned remnant parcel of approximately 2.75 acres in size. On March 14, 2024, the City received an unsolicited offer from CivicGroup, doing business as Courthouse, LLC to purchase the parcel for the proposed development of multiple retail tenants. A motion was made by Councilmember Joyce Clark, seconded by Councilmember Lauren Tolmachoff to adopt Ordinance No. 24-34. James Deibler, Phoenix resident, discussed passport acceptance by the City.
