CALL TO ORDER
Mayor Weiers called the meeting to order at 12:30 p.m.

WORKSHOP SESSION
1. COUNCIL COMMITTEES
Presented by: Julie K. Bower, City Clerk
Ms. Bower read the item by title. She said it was necessary to make appointments to the
Government Services Committee. The current members were Councilmember Malnar,
Councilmember Tolmachoff and Councilmember Clark. All three were eligible for reappointment
and all three had requested reappointment.
Mayor Weiers confirmed Council consensus to reappoint all three to the Government Services
Committee.
2. COUNCIL ITEM OF SPECIAL INTEREST - SHORT-TERM RENTAL CODE AMENDMENTS
Presented by: Rick St. John, Deputy City Manager
Ms. Bower read the item by title.
Mr. St. John presented information on the following:
. Short term rental code amendments:
. Neighbor notification requirements
. Occupancy rates
. New definitions and more clearly defined prohibition
Councilmember Turner asked if the neighbor notification requirements applied to neighbors
behind the short-term rental and/or if there was an alley.
Mr. St. John said if there was an alleyway or strip park, the property still must be notified if
adjacent or diagonal.
Councilmember Tolmachoff said in Arrowhead Lakes, there was a lake and golf course. She
asked if there was wording to address that type of situation, such as a distance requirement.

Mr. St. John said that it was a yet to be determined distance but felt a 200-foot distance was
reasonable.
Councilmember Tolmachoff asked about the event center and if a wedding would be
considered an event. She asked if the 200 square foot requirement would determine the
number of guests allowed.
Mr. St. John said a wedding would be considered an event. The 200 square foot requirement
applied to the number of people residing in the home. The occupants could not rent the short
term for the sole purpose of having the wedding while the occupants stayed at a hotel. If the
occupants stayed in the home and had the wedding, that would be allowed.
Councilmember Turner asked if a maximum occupancy should be established. He would like
Council to consider that as part of the regulation. There might be only 5 occupants, but if 200
people were invited, that would be a different burden on the neighborhood.
Councilmember Tolmachoff said the occupancy maximum would depend on the lot size. The
nuisance party was already included in an ordinance. If they were not creating a nuisance, they
would not be violating anything. If they were not violating an ordinance, there should not be a
problem.
Mr. St. John said operating under the nuisance party ordinance would be the easier path. It
would be difficult to determine a maximum, and he was unsure how it would be enforced.
Councilmember Turner would still like it to be considered so that the owners leasing out the
property would know up front. It would be helpful for code enforcement to know what number it
should be dealing with.
Councilmember Tolmachoff said that part of the amendment established occupancy limits.
Guests and occupants were two different things.
Councilmember Turner was referring to the combined number of guests and occupants. A
maximum occupancy was needed for each location.
Councilmember Tolmachoff said guests were a different issue from occupants. She asked if a
child counted as an occupant.
Mr. St. John said children did count as occupants. Occupancy was the number of people
staying in the home, which was different than the number of people attending an event. A new
bill was being signed by the governor that dealt with short term rentals and there were some
changes to the state's short term rental law. He would be looking at that new bill to see what
amendments needed to be made. Even after the current changes, he would be back in August,
and he could include Councilmember Turner's suggestion in that study. Council could still
proceed with the three amendments presented today.
Councilmember Clark supported moving forward as it was written. If there were any suggested
changes, those could be considered at a later time.
Mayor Weiers said it was two different things, and he did not think Council should be looking at
visitor occupancy. He supported the item as written. Down the road, Council might need to
revisit the visitor occupancy.
Councilmember Malnar supported the item as written. If it were to come back in August, he

would like to know more about occupancy for residential. He had only seen it for commercial
purposes.

A motion was made by Councilmember Bart Turner, seconded by Councilmember Ray
Malnar to hold an executive session.

EXECUTIVE SESSION
Council met in executive session at 12:51 p.m. for discussion/consultation with the City Attorney and
City Manager to receive an update, to consider its position, and to provide instruction/direction to the
City Attorney and City Manager regarding Glendale's position in connection with City -owned property
near 71st Avenue and Butler Drive pursuant to A.R.S. §§ 38-431.03 (A)(3)(4)(7).
A motion was made by Councilmember Ray Malnar, seconded by Vice Mayor Ian Hugh to
adjourn the executive session.
