Workshop Meeting Civic Center City Council Mayor Jerry Weiers Vice Mayor Ian Hugh Councilmember Leandro Baldenegro Councilmember Joyce Clark Councilmember Ray Malnar Councilmember Lauren Tolmachoff Councilmember Bart Turner CALL TO ORDER Mayor Weiers called the meeting to order at 12:30 p.m. ROLL CALL Present: Mayor Jerry Weiers Vice Mayor Ian Hugh Councilmember Leandro Baldenegro Councilmember Joyce Clark Councilmember Ray Malnar Councilmember Lauren Tolmachoff Absent: Councilmember Bart Turner Also Present: Kevin Phelps, City Manager Michael Bailey, City Attorney Julie K. Bower, City Clerk Councilmember Baldenegro attended the meeting telephonically. Councilmember Turner arrived after the roll was called at 12:37 p.m. WORKSHOP SESSION COUNCIL ITEM OF SPECIAL INTEREST - ADOPTING A REPEAT OFFENDER ORDINANCE Presented by: Rick St. John, Deputy City Manager Ms. Bower read the item by title. Mr. St. Jon presented proposed changes to the draft ordinance regarding the definition of "repeat offender" and "violation" and the minimum and maximum fines for an offense. Councilmember Malnar asked if a repeat offense was of the same type of violation. Mr. St. John said that was correct. Councilmember Tolmachoff was in support of the proposed ordinance and thought it would address the problem. Councilmember Clark was in support of the ordinance as written. Mayor Weiers said there was Council consensus to move forward with the proposed ordinance. CITY MANAGER'S REPORT Mr. Phelps said the Desert Diamond Arena had initiated an employee community initiative. Arena employees picked up trash around the Westgate Entertainment District last weekend. Mr. Phelps said the Arizona Rattlers were coming out of a 3-game winning streak, and he encouraged everyone to support the team. City Council Meeting Minutes - May 14, 2024 Page 2 of 4 Mr. Phelps said the groundbreaking for the Heroes Park sports complex would take place on Friday. CITY ATTORNEY'S REPORT No report COUNCIL ITEMS OF SPECIAL INTEREST Councilmember Tolmachoff requested the review of the short-term rental ordinance to determine if additional requirements should be added. Councilmember Turner requested a review of the 8,000 square foot limit for accessory dwelling units to determine if it could be reduced to 7,000 square feet. He requested that it be brought forward for discussion. MOTION AND CALL TO ENTER INTO EXECUTIVE SESSION A motion was made by Councilmember Joyce Clark, seconded by Vice Mayor Ian Hugh to hold an executive session. Discussion and or consultation, to consider its position, and to provide instruction/direction regarding the appointment of the Presiding Judge and discussion/consultation for legal advice with the City Attorney pursuant to A.R.S. §38-431.03(A)(1)(3) . Discussion/consultation with the City Attorney and City Manager to receive an update, to consider its position, and to provide instruction/direction to the City Attorney and City Manager regarding Glendale's position in connection with pending or contemplated litigation, or in settlement discussions conducted in order to avoid or resolve litigation re: Rare Earth, LLC. pursuant to A.R.S. §38-431.03 (A)(3)(4) . Discussion/consultation with the City Attorney to receive an update and legal advice regarding Initiative INT-2023-01 pursuant to A.R.S. §§ 38-431.03 (A)(3) . Discussion/consultation with the City Attorney to receive an update, to consider its position, and to provide instruction/direction to the City Attorney regarding property located at 7215 N. 62nd Avenue pursuant to A.R.S. §§ 38-431.03 (A)(3) . Discussion/consultation with the City Attorney and City Manager to receive an update, to consider Glendale's position, and to provide instruction/direction to the City Attorney and City Manager regarding the City's position in connection with pending or contemplated litigation, or in settlement discussions conducted to avoid or resolve litigation involving Glendale Avenue City Council Meeting Minutes - May 14, 2024 Page 3 of 4 Reconstruction project between 91st Ave and State Highway 101 pursuant to A.R.S. §38-431.03 (A)(3)(4) . Discussion/consultation with the City Attorney and City Manager to receive an update, to consider its position, and to provide instruction/direction to the City Attorney and City Manager regarding Glendale's position regarding a contract with the Plaza Companies that is the subject of negotiations pursuant to A.R.S. §38-431.03 (A)(3)(4) A motion was made by Councilmember Joyce Clark, seconded by Vice Mayor Ian Hugh to adjourn the executive session.
