R24-26 A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, DIRECTING AND ENTERING INTO A COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG-CV3) AGREEMENT WITH PHOENIX GOSPEL MISSION, INC. FOR HEAT RELIEF RESPITE CENTERS. 16. RESOLUTION NO. R24-27 A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, APPROVING THE PLACEMENT OF THREE, (3) RECOGNITION PLAQUES IN THE HEART OF GLENDALE NEIGHBORHOOD COMMEMORATING GLENDALE'S HISPANIC HERITAGE AND COMMUNITY IMPORTANCE. 17. A motion was made by Councilmember Joyce Clark, seconded by Councilmember Lauren Tolmachoff to adopt Consent Resolutions items 15 through 18. Councilmember Clark said, as was her habit and practice, she would be voting no on all 5-year contracts. RESOLUTION NO. R24-30 A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, AMENDING THE GENERAL PLAN MAP OF THE CITY OF GLENDALE, ARIZONA, BY APPROVING GENERAL PLAN AMENDMENT GPA23-03 FOR PROPERTY LOCATED AT 7448 NORTH 83RD AVENUE. AND ORDINANCE NO. 024-09 AN ORDINANCE OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, REZONING PROPERTY LOCATED AT 7448 NORTH 83RD AVENUE FROM A-1 (AGRICULTURAL) TO R1-8 (SINGLE RESIDENCE — 8), AMENDING THE ZONING MAP; PROVIDING FOR AN EFFECTIVE DATE; AND ORDERING THAT A CERTIFIED COPY OF THIS ORDINANCE IS RECORDED. (PUBLIC HEARING) Presented by: Tabitha Perry, Deputy Director, Development Services Ms. Bower read the resolution and ordinance by title. Mayor Weiers opened the public hearing. Ms. Perry said the request was for a Minor General Plan Amendment from Low -Density Residential (LDR 2.5, 1 — 2.5 dwelling units per acre) to Medium Density Residential (MDR 3.5, 2.5 — 3.5 dwelling units per acre) and rezoning of the subject property from A-1 (Agricultural) to R1-8 Single Family Residential. The property was .93 acres and was located at the northwest corner of Orangewood and 83rd Avenues. The request matched land use designations immediately south of the subject parcel. Ms. Perry said the applicant intended to divide the parcel into 3 lots for residential use. It was a straight zoning request and did allow for two-story buildings. The applicant's intent was to develop single -story homes. The Planning Commission recommended approval of GPA23-03 and ZON23-05 with two stipulations. Councilmember Clark asked if any easement would be dedicated along the westside of 83rd Avenue for reconstruction of the street. Ms. Perry said it was one of the stipulations. Councilmember Tolmachoff said the building maximum height was 30 feet. There was an entitlement to build 2-story homes. Ms. Perry said it was a straight zoning and staff did not want to take away the ability to develop the site in accordance with the development standards for that zoning district. The applicant had stated on the record that the intent was single-family residential. Councilmember Tolmachoff asked if Council should add the stipulation for single-family residential. Ownership of the property could change. Ms. Perry said the stipulation could be added and the applicant had indicated there would be no problem with the stipulation for single -story buildings. City Council Meeting Minutes - April 23, 2024 Page 7 of 10 Jordan Greenman, applicant's representative, said the property was surrounded by two-story properties and preventing the applicant from doing so seemed unreasonable and the applicant preferred not to have the stipulation added. Councilmember Clark said it should be compatible with the adjacent property. She said the stipulation should require one-story units adjacent to existing one-story units and two-story units adjacent to existing two-story units. Councilmember Turner said it appeared there were three properties that bordered the site on the south and two were two -stories. At least some portion of the property bordered two-story properties. He supported approving it without the stipulation. Jerome Gill, Yucca District resident, did not want two-story homes behind him. He did have a two-story home. The zoning when his home was developed required the subject property to be single -story. The new owner should still fall under that requirement. Councilmember Malnar said he would second Councilmember Clark's stipulation. Mr. Bailey asked for clarification of the stipulation. Councilmember Clark said the stipulation would be that the applicant would be required to build two-story single-family residential adjacent to existing two-story single-family residential and one-story single-family residential adjacent to existing one-story single-family residential. Mayor Weiers did not know what adjacent meant. Ms. Perry asked that Council postpone further discussion on the matter until after the next item to allow staff time to develop an acceptable stipulation. Mayor Weiers postponed the item until after item 24. After the conclusion of agenda item 24, discussion returned to the item. Mr. Bailey said the stipulation motion was that the property owner would be able to construct two-story if there was adjacency. What did it mean if the property was on a corner lot and was adjacent to both one-story and two-story properties. Councilmember Clark withdrew her previous motion and offered a stipulation that would require one-story residential on all three lots. Councilmember Malnar seconded the motion. Ms. Perry said the applicant would agree to the stipulation requiring single-family residential on the three lots. Mr. Bailey said Council should first make a motion regarding the resolution and then the ordinance with the added stipulation. Mayor Weiers closed the public hearing. A motion was made by Councilmember Joyce Clark, seconded by Councilmember Lauren Tolmachoff to adopt Resolution No. R24-30. Councilmember Turner said even though the applicant was willing to concede to the one-story requirement, he did not think it was a particularly fair requirement but he would vote aye. ORDINANCE NO. 024-10 AN ORDINANCE OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, EXTENDING AND INCREASING THE CORPORATE LIMITS OF THE CITY OF GLENDALE, MARICOPA COUNTY, STATE OF ARIZONA, PURSUANT TO THE PROVISIONS OF TITLE 9, CHAPTER 4, SECTION 9471, ARIZONA REVISED STATUTES AND ITS AMENDMENTS, BY ANNEXING CERTAIN TERRITORY LOCATED AT THE SOUTHEAST CORNER OF PEORIA AVENUE AND SARIVAL AVENUE IN THE CITY OF GLENDALE CONSISTING OF APPROXIMATELY 12.44 ACRES TO BE KNOWN AS ANNEXATION AREA NO. 244: AMENDING THE ZONING MAP; PROVIDING FOR AN EFFECTIVE DATE; AND ORDERING THAT A CERTIFIED COPY OF THIS ORDINANCE IS RECORDED. Ms. Perry said the requested annexation involved approximately 12.4 acres for commercial development. It was currently zoned Neighborhood Commercial in the County and if annexed, the City would apply the most compatible zone district which was C-1 (Neighborhood Commercial). The applicant intended to retain the C-1 zoning designation for a convenience store with a gas station which would require a conditional use permit. No one wished to speak. Councilmember Tolmachoff invited everyone to the Cholla District annual barbeque next Thursday. May 2nd, at the Foothills Recreation and Aquatics Center at 5:30 p.m. CITIZEN COMMENTS Angel Grado, Ocotillo District resident, commented on the Glendale Works Program. Rory Goree, Ocotillo District resident, welcomed the new Ocotillio District Councilmember, Leandro Baldenegro.
