Dear Mr. Dudley,
My name is Lucinda A. DeLeon and I live at 9813 N. 48th Ave. My intention for writing this
letter is to thank Pam and Mark for meeting with me yesterday as well as to explain to you why
the permit/construction at my home was never completed. My husband(now ex-husband)was a
self employed contractor in 2008. He wanted to build a home office, enclose our one car carport
into a garage and build a back patio. (As a side note; due to my ex-husband being a contractor,
he handled all the permit issues, as well as anything relating to the remodel. It wasn't until
recently; I learned the permit was expired.)
Our permit was issued on 2/28/2008 and according to the City's records, on 3/3/2008, we failed
the stem wall inspection. According to my ex-husband, the footers on the back patio needed to
extend four(4)feet down due to the patio being right next to our pool. On May 9, 2008, a new
plan was approved by the City and on 5/19/2008, we passed the footer inspection. I've had the
original permit as well as the original"green tag"hanging in my front window ever since.
Shortly after the footer inspection,the framing and electrical were done for all three areas.
Right around May/June 2008,the construction"crash"happened. Due to my ex-husband's
business slowing down and for financial reasons, all construction was stopped. In addition,in
May 2009, we filed Ch. 13 bankruptcy, our marriage was over in May 2010, our divorce was
final in June 2012 and our bankruptcy was discharged in June 2014. As I'm sure you can
imagine the past eight years have been really rough.
I've spent the past two years trying to recover from the bankruptcy. In May of this year, I will
finally be eligible/able to refinance my home. In addition to removing my ex's name from the
mortgage,my goal is to cash out some equity in order to finish my house/construction project.
I understand the plans for my house were written using 2006 building code and as of now,the
codes were modified in 2012. I am respectfully asking to pick up from where the construction
left off and move forward. I have spoken to several contractors who are willing to give me a bid
as soon as the City gives me a green light. My goal is to start the construction in June 2016 and
have the project completed no later than August 2016.
For your review, I've included a copy of the original building/site plans, a copy of the City's
record of the inspections as well as current pictures of the back patio, office as well as the car
port. As you can see from the pictures,nothing has changed since the construction stopped in
2008.
I am aware several of my neighbors called the City to complain about my house not being
completed. I apologize for these calls and am hoping to move forward and put the past in the
