Vern Crow, Chair Edwin Nyberg, Vice Chair Tom Cole, Commissioner John Crow, Commissioner John Geurs, Commissioner Martin Nowakowski, Commissioner Brian Hooper, Commissioner Also Present: Tabitha Perry, Deputy Director, Development Services James Gruber, Chief Deputy City Attorney Alex Lerna, Sr. Planner Joseline Castaneda, Planner Tawanda Walker -Hall, Recording Secretary APPROVAL OF THE MINUTES Planning Commission Meeting Minutes of November 9, 2023. Chairperson Crow called for a motion to approve the Planning Commission Meeting minutes of November 9, 2023, Commissioner Cole motioned to approve the minutes for the Planning Commission Meeting minutes of November 9, 2023. Commissioner Geurs seconded. Chairperson Crow called for a vote. All Commissioners voted AYE, motion passed. WITHDRAWALS AND CONTINUANCES There were none. CUP23-01 -A request by Jamie Angulo on behalf of RKAA Architects, representing HH - 51 st & Glendale, LLC, for a conditional use permit to allow for a convenience use/drive- thru use in the C-2 (General Commercial) zoning district. The applicant is proposing a 1,302 square foot coffee shop with drive-thru services. The site is located on the west of the southwest corner of 51 st Avenue and Glendale Avenue and is in the Ocotillo District. Alex, Lerma, Sr. Planner, presented CUP23-01. Chairperson Crow closed the public hearing for CUP23-01. Commissioner Geurs motioned to approve CUP23-01 subject to the stipulations outlined in the staff report. Commissioner Hooper seconded the motion. Chairperson Crow called for a roll call vote. All Commissioners voted, AYE, motion passed. 2. CUP23-22 -A request by Jason Morris on behalf of Withey Morris Baugh, PLC, representing BYPG Holdings, LLC, for a conditional use permit to allow for the distribution of finished goods in the Planned Area Development (PAD) zoning district. The site is located west of the southwest corner of 99th Avenue and Ballpark Boulevard and is in the Yucca District. Alex, Lerma, Sr. Planner, presented case CUP23-22. Applicant gave a presentation. Chairperson Crow closed the public hearing for CUP23-22. Commissioner Nowakowski motioned to approve CUP23-22 subject to the stipulations outlined in the staff report. Commissioner Geurs seconded the motion. Chairperson Crow called for a roll call vote. All Commissioners voted, AYE, motion passed. 3. CUP23-25 -A request by Julie Johnson, Arizona Mutt Hutt LLC., for a Conditional Use Permit to allow for a commercial kennel in the M-1 (Light Industrial) zoning district. The site is located west of the northwest corner of Maryland Avenue and 57th Avenue, 5712 West Maryland Avenue and is in the Ocotillo District. Joseline Castaneda, Planner presented CUP23-25. Applicants gave a presentation. Chairperson Crow closed the public hearing for CUP23-25. Commissioner Geurs motioned to approve CUP23-25 subject to the stipulations outlined in the staff report. Commissioner Hooper seconded the motion. Chairperson Crow called for a roll call vote. All Commissioners voted, AYE, motion passed. 6. OTHER BUSINESS There was none. 7. PLANNING STAFF REPORT a. Tabitha Perry, Deputy Director of Development Services informed the Commissioners that the Unified Development Code (UDC) was adopted by the City Council at the December 12th public hearing and thanked the Commissioners for their service. 8. CITIZEN COMMENTS There were none. 10. NEXT MEETING The next regular meeting of the Planning Commission is scheduled for January 25, 2024 at 6:00 p.m., in the Civic Center located at 5750 W. Glenn Dr., Glendale, Arizona, 85301, 11. ADJOURNMENT Chairperson Crow called for a motion to adjourn. Vice Chair Nyberg motioned to adjourn. Commissioner Cole seconded the motion. All Commissioners voted, AYE, motion passed. Chairperson Crow adjourned the meeting at 7:10 p.m. The Planning Commission meeting minutes of December 14, 2023, were submitted and approved this 22nd day of February 2024.
