GLENDALE, ARIZONA 85301 SEPTEMBER 28, 2023 6:00 P.M. 1. CALL TO ORDER 2. ROLL CALL Present: Vern Crow, Chair Edwin Nyberg, Vice Chair Tom Cole, Commissioner Martin Nowakowski, Commissioner John Geurs, Commissioner Brian Hooper, Commissioner Absent: John Crow, Commissioner Also Present: Tabitha Perry, Deputy Director Development Services James Gruber, Deputy City Attorney Christina Lavelle, Senior Planner Tawanda Walker -Hall, Recording Secretary 3. CITIZEN COMMENTS Chairperson Crow received 1 speaker card for case CUP23-04 heard on August 24th and September 14th. Speaker in support of the project. 4. APPROVAL OF MINUTES Vice Chair Nyberg motioned for a continuance of the August 24th and September 14th Planning Commission minutes to the next scheduled public hearing. Commissioner Cole seconded. Chairperson Crow called a roll call vote. All Commissioners vote Aye. Motion passes. 5. WITHDRAWALS AND CONTINUANCES There were none. 6. PUBLIC HEARING ITEMS CUP23-18 Conditional Use Permit (CUP) to allow for a convenience land use in the Yucca District. Christina Lavelle, Senior Planner presented case CUP23-18. Applicant Steve Shaw gave a presentation. Chairperson Crow closed the public hearing for CUP23-18. Commissioner Geurs motioned to approve CUP23-18 subject to the stipulations contained in the staff report. Commissioner Hooper seconded. Chairperson Crow called for a roll call vote. All Commissioners vote Aye. Chairperson Crow CUP23-18 has been recommended for approval subject to the stipulations as outlined by staff. Mr. Gruber, what are the next steps in the process? Deputy City Attorney Gruber: Your action with respect to CUP23-18 is final and subject to a written appeal received within 15 days. 2. CUP23-19 Conditional Use Permit (CUP) to allow for a convenience land use in the Barrel District. Christina Lavelle, Senior Planner presented case CUP23-19. Applicant representative Madison Link gave a presentation. Chairperson Crow closed the public hearing for CUP23-19. Commissioner Cole motioned to approve CUP23-19 subject to the stipulations outlined in the report. Vice Chair Nyberg seconded. Chairperson Crow conducted a roll call vote. All Commissioners vote Aye. Chairperson Crow CUP23-19 has been recommended for approval subject to the stipulations as outlined by staff. Mr. Gruber, what are the next steps in the process? Deputy City Attorney Gruber: Your action with respect to CUP23-19 is final subject to a written appeal received within 15 days. 3. GPA23-04 & ZON23-06 Entitlement request for approval of a General Plan Amendment and Planned Area Development (PAD) Rezoning Application. Christina Lavelle, Senior Planner presented cases GPA23-04 and ZON23-06. Chairperson Crow closed the public hearing for GPA23-04 and ZON23-06 noting each case will be voted on separately. Commissioner Cole motioned to approve GPA23-04 as written. Commissioner Hooper seconded. Chairperson Crow conducted a roll call vote. All Commissioners voted Aye. Chairperson Crow GPA23-04 is recommended for approval as written. Mr. Gruber, what are the next steps in the process? Deputy City Attorney Gruber your action with respect to GPA23-04 are not final; your recommendation will be forwarded to the City Council. Chairperson Crow called for a motion for ZON23-06. Commissioner Cole motioned to approve ZON23-06 per the stipulations outlined in the staff report. Commissioner Geurs seconded. Chairperson Crow conducted a roll call vote. All Commissioners vote Aye. Chairperson Crow ZON23-06 is recommended for approval subject to the stipulations outlined by staff. Mr. Gruber, what are the next steps in the process? Deputy City Attorney Gruber your action with respect to ZON23-06 is not final; your recommendation will be forwarded to the City Council. 4. ZTA23-01 ZONING TEXT AMENDMENT GLENDALE CENTERLINE OVERLAY (GCO) DISTRICT - A request initiated by the Planning Commission for an amendment to the Glendale Zoning Ordinance, Section 6.806 - Parking, for the Glendale Centerline Overlay District. The intent is to amend the parking requirements to provide flexibility for required parking spaces regarding multifamily residential developments. Christina Lavelle, Senior Planner presented case ZTA23-01. Chairperson Crow closed the public hearing for ZTA23-01. Commissioner Hooper motioned to approve ZTA23-01 as written. Commissioner Cole seconded. Chairperson Crow conducted a roll call vote. All Commissioners voted Aye. Chairperson Crow ZTA23-01 has been recommended for approval as written. Mr. Gruber, what are the next steps in the process? Deputy City Attorney Gruber your action with respect to ZTA23-01 is not final; your recommendation will be forwarded to the City Council. 7. OTHER BUSINESS There were none. 8. PLANNING STAFF REPORTS Deputy Director Perry advised Commission staff will ask for consideration for a Chair & Vice Chair for 2024 and the schedule for the 2024 calendar year. 9. COMMISSION COMMENTS AND SUGGESTIONS There were none. 10. NEXT MEETING The next regular meeting of the Planning Commission is scheduled for Thursday, October 26th at 6:00 p.m., in the Glendale Civic Center 5750 W. Glenn Drive, Glendale, Arizona, 85301. 11. ADJOURNMENT Chairperson Crow called for a motion to adjourn. Vice Chair Nyberg motioned. Commissioner Cole seconded. All Commissioners voted Aye.
