GLENDALE AVE. GLENDALE, ARIZONA 85301 JULY 26, 2023 9:30 A.M. 1. CALL TO ORDER THE LOCAL POLICE BOARD Chair Charles Erickson called the meeting to order at 9:40 a.m. 2. ROLL CALL Present: Mayor & Board Member Jerry Weiers City Manager & Board Member Kevin Phelps Board Member & Chair Charles Erickson Board Member Mitchell Ervin, Police Officer Absent: Board Member Justin Harris, Police Officer Staff Present: Jim Brown, Board Secretary & Director of Human Resources & Risk Mgmt. Vicki Moss, Assistant Director of Human Resources Mike Hamblin, Assistant City Attorney John Davidge, Police Sergeant Charlotte Beadles, Benefits Analyst Lisa Chill, Admin Support Supervisor, HR Other Attendees: Board Attorney Cynthia Kelley Former Police Officer Lucero Ruiz (via telephone) Former Police Officer Matthew Salyers Former Police Officer James Saylor (via telephone) 3. CITIZEN COMMENTS There were no citizens present. Before the meeting continued, Assistant HR Director Vicki Moss asked Chair Erickson for a moment to get former Police Officers Lucero Ruiz and James Saylor on conference call. Ms. Ruiz and Mr. Saylor successfully joined the meeting via conference call and introduced themselves. 4. APPROVAL OF THE MINUTES The Board voted to approve the Public Safety Personnel Retirement System - Local Police Board Minutes of May 24, 2023 Motioned by Board Member Mitchell Ervin, seconded by Board Member Kevin Phelps AYE: Mayor Jerry Weiers Board Member Kevin Phelps Board Member Charles Erickson Board Member Mitchell Ervin Other: Board Member Justin Harris (ABSENT) Passed 5. NEW BUSINESS A. Board Secretary Jim Brown read the pertinent information related to the reemployment of Jeffrey Horsley, a retired City of Glendale Police Officer. Mr. Horsley retired on January 21, 2023. He was rehired by the City of Glendale as a Transit Operator on July 3, 2023. There was some discussion on the parameters for PSPRS members to return to work after retirement among the members, the Board Attorney and staff liaisons. It was noted that due to a change in statute, members may return to work sooner than six months after retirement as the result of an open competitive hiring process. Mr. Brown asked the following questions and the Board answered by consensus. 1. Has Mr. Horsley become reemployed in any capacity by the City of Glendale before six months after his date of retirement? The Board agreed by consensus that the answer is Yes. 2. Was Mr. Horsley rehired into a non-PSPRS position? The Board agreed by consensus that the answer is Yes. 3. Was Mr. Horsley's reemployment a result of participating in an open competitive process? The Board agreed by consensus that the answer is Yes. 4. Does this Board acknowledge that the City of Glendale is responsible to pay the ACR to PSPRS, and will be responsible for matching contributions into ASRS? The Board agreed by consensus that the answer is Yes. The Board voted to approve the reemployment of Jeffrey Horsley. Board Secretary Brown read the pertinent information related to the reemployment of Robert Troy Evans, a retired City of Glendale Police Officer. Mr. Evans retired on April 1, 2023. He was rehired by the City of Glendale as a Management Analyst on June 5, 2023. Mr. Brown asked the following questions and the Board answered by consensus. 1. Has Mr. Evans become reemployed in any capacity by the City of Glendale before six months after his date of retirement? The Board agreed by consensus that the answer is Yes. 2. Was Mr. Evans rehired into a non-PSPRS position? The Board agreed by consensus that the answer is Yes. 3. Was Mr. Evans' reemployment a result of participating in an open competitive process? The Board agreed by consensus that the answer is Yes. 4. Does this Board acknowledge that the City of Glendale is responsible to pay the ACR to PSPRS, and will be responsible for matching contributions into ASRS? The Board agreed by consensus that the answer is Yes. The Board voted to approve the reemployment of Robert Troy Evans. EXECUTIVE SESSION Upon a public majority vote of a quorum of the Local Police Board, the Board may hold an executive session, which will not be open to the public, regarding any item listed on the agenda but only for the following purposes: (i) discussion or consideration of records exempt by law from public inspection (A.R.S. § 38-431.03(A)(2)); (ii) discussion or consultation for legal advice with the Board's attorneys (A.R.S. § 38-431.03(A)(3)); The Board voted to go into Executive Session. All attendees that are not members of the Police Board or supporting staff exited the conference room prior to the Executive Session, and the telephone was muted for the telephone attendees. The Board reviewed the medical Evaluations for five (5) New City of Glendale Police Personnel: Christopher M. Benkoski Nathaniel J. Hansen Kateri R. Marotta Derek C. McDowell Ramon Villegas Acuna B. The Board reviewed and discussed the Application for Accidental Disability Retirement, along with medical records, submitted by Lucero Ruiz C. The Board reviewed and discussed the Application for Accidental Disability Retirement, along with medical records, submitted by Matthew Salyers D. The Board reviewed and discussed the Application for Accidental Disability Retirement, along with medical records, submitted by James Saylor 7. ADJOURN EXECUTIVE SESSION AND RECONVENE IN OPEN SESSION 8. CONSIDERATION AND POSSIBLE VOTE ON EXECUTIVE SESSION ITEMS A. Sergeant John Davidge confirmed that the following four (4) New Police Personnel have met the standards of the Glendale Police Department and the Arizona Peace Office Standards and Training Board (AZPOST). The Board voted to approve the admission of four (4) New Police Personnel into the Public Safety Personnel Retirement System (PSPRS) with any pre-existing conditions noted on the Pre -Existing Conditions Report: Christopher M. Benkoski Kateri R. Marotta Derek C. McDowell Ramon Villegas Acuna Motioned by Board Member Mitchell Ervin, seconded by Board Member Kevin Phelps AYE: Mayor Jerry Weiers Board Member Kevin Phelps Board Member Charles Erickson Board Member Mitchell Ervin Other: Board Member Justin Harris (ABSENT) Passed B. Sergeant Davidge confirmed that the following New Police Personnel have met the standards of the Glendale Police Department and the Arizona Peace Office Standards and Training Board (AZPOST). The Board voted to approved the transfer of service credits in the Public Safety Personnel Retirement System (PSPRS) for the following new City of Glendale Police Personnel from previous employer, with any pre-existing conditions noted on the Pre -Existing Conditions Report: Nathaniel J. Hansen (City of Phoenix) Motioned by Board Member Mitchell Ervin, seconded by Board Member Kevin Phelps AYE: Mayor Jerry Weiers Board Member Kevin Phelps Board Member Charles Erickson Board Member Mitchell Ervin Other: Board Member Justin Harris (ABSENT) Passed C. Board Secretary Brown read the statement regarding the action requested of the Board regarding the Application for Accidental Disability Retirement submitted by former Police Officer Lucero Ruiz. The Board voted to order an appropriate Independent Medical Evaluation (IME) based on the medical information provided on the application and medical records submitted by Lucero Ruiz. Motioned by Board Member Mitchell Ervin, seconded by Board Member Kevin Phelps AYE: Mayor Jerry Weiers Board Member Kevin Phelps Board Member Charles Erickson Board Member Mitchell Ervin Other: Board Member Justin Harris (ABSENT) Passed D. Board Secretary Brown read the statement regarding the action requested of the Board regarding the Application for Accidental Disability Retirement submitted by former Police Officer Matthew Salyers. The Board acknowledged receipt of the Application for Accidental Disability Retirement submitted by Police Officer Matthew Salyers and voted to order an appropriate Independent Medical Evaluation (IME) based on the medical information provided. BOARD COMMENTS AND SUGGESTIONS There were no Board comments or suggestions. 10. NEXT MEETING The next regular meeting of the Public Safety Personnel Retirement System Local Police Board will be held on August 23, 2023 at 9:30 a.m. at the Glendale Media Center, 3rd Floor Conference Room, located at 9494 W. Maryland Ave., Glendale, Arizona, 85305. 11.
