Councilmember Clark said automatic aid was very important to all of the cities throughout the
Valley. She said the Life Safety Council, which administered automatic aid, refused to deal
with reimbursement for excess calls for fire and medical service outside of a member's
jurisdiction. Year -over -year, the City of Glendale responded into Phoenix approximately
2,000 times more than Phoenix responded into Glendale. It was a large imbalance.
Councilmember Clark said the automatic aid agreement stated, "Reciprocity; No Guaranty of
Perfect Equity. Participants agree that automatic aid is reciprocal. While this does not ensure
that a participant's jurisdiction will receive the exact amount of assistance it gives, it does
mean that all participants will provide assistance outside their jurisdictional boundaries and
that the level of service delivered, and decisions made within the Automatic Aid System will be
mutually beneficial to all participants in the system and will maintain general equity among all
participants to the greatest degree possible."
Councilmember Clark said the situation had gone on too long. She would be casting a no
vote on the agreement.

Mayor Weiers opened the public hearing.
Ms. Perry said the property was currently zoned M-1(Light Industrial). The applicant was
requesting to rezone the property to.PAD (Planned Area Development) to allow for a
mixed -use of industrial and commercial. There were four access points, and the primary truck
route would be north and south with a secondary access from the Missouri Avenue Alignment
as an east -west route.
Ms. Perry said the Planning Commission considered the application at its meeting on
November 10th and recommended approval with stipulations.
The following people spoke on the matter:
Cynthia Graber, Phoenix resident, said her property rights on the adjacent property were
being obstructed by the proposed project.

Jack McKinney, Lake Forest, IL, was the applicant's representative. He said the land Ms.
Graber had been using encroached on the subject property and the project would lose 40,000
square feet because of the encroachment. He was trying to work something out with Ms.
Graber.
Councilmember Malnar asked if the easement rights referred to by Ms. Graber were recorded.
Tom Howard, Phoenix resident, said it was a proscriptive right that had been enjoyed since
Ms. Graber's family had owned the property. No legal action had been filed to enforce it.
There was no recorded easement.
Councilmember Malnar asked if Council approved the action, would the City have any liability
if the easement went to court.
Mr. Bailey said the zoning matter before Council did not involve access. It would be the
property owner's obligation and burden to establish a right of access or extinguish a right of
access.
Councilmember Clark said the matter before Council was only the zoning application. The
access issue would have to be decided by a court.

Ms. Perry said the property was approximately 276 acres and was located at the northwest
and northeast corner of Sarival Avenue and Olive Avenue. It was currently within Maricopa
County and zoned RU-43 (Rural Residential). There was a companion item next on the
agenda for a proposed Major General Plan Amendment to Light Industrial and a rezoning
request for PAD (Planned Area Development) to allow for approximately 4.38 million square
feet of industrial building area.

Ms. Perry said the applicant was requesting a Major General Plan Amendment from RMU
(Regional Mixed Use), MDR3.5 (Medium Density Residential with 2.5-3.5 dwelling units per
acre), and MDR5 (Medium Density with 3.5-5 dwelling units per acre) to LI (Light Industrial)
and to rezone the site from RR-45 (Rural Residential) to PAD (Planned Area Development).

Ms. Perry said the applicant received feedback at a public hearing from nearby residents that
were displeased with the proposal. The applicant worked with the residents to address the
concerns. The maximum building height was 60 feet and setbacks included 400 feet from
residences to the north, along with a minimum landscaping setback of 200 feet. The
landscaping buffer would actually be 237 feet and would include a walking trail.
Ms. Perry said the Planning Commission heard the request at its meeting on December 8th
and recommended approval of both requests with 18 stipulations.
Brandon Klippel, Waddell resident, spoke in opposition.

Councilmember Clark commended the developer, the developer's representative, and the
neighbors. The two groups had worked together to come up with stipulations to mitigate
the impact on the neighborhood.

ARIZONA, AUTHORIZING THE EXECUTION OF A UTILITY EASEMENT IN FAVOR OF
ARIZONA PUBLIC SERVICE ON CITY PROPERTY LOCATED ON THE EAST SIDE OF

35. ORDINANCE NO. 022-89
AN ORDINANCE OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY,
ARIZONA, AMENDING THE GLENDALE CITY CODE, CHAPTER 24 (MOTOR VEHICELS
AND TRAFFIC), ARTICLE IV (SPECIFIC PARKING PROHIBITIONS) SECTION 24-68
(PARKING ON RESIDENTIAL LOTS) (C) AND (D) AND SETTING FORTH AN EFFECTIVE
DATE.

Ms. Bower read the ordinance by title.
Mr. St. John said Council had previously approved a change related to offstreet parking.
The distinction between a large lot and a small lot was changed to 8,000 square feet. Staff
recommended that it be changed back to 12,000 square feet so that it was consistent with
the Unified Development Code (UDC) and to provide ease of understanding for residents.
The ordinance would also change where the continuous width of a driveway was measured,
from the front setback to the front of the property line.
Councilmember Malnar said the Code Committee recommended the change to 8,000 square

feet. The Committee determined that there were many lots that were technically out of
compliance because they were not allowed a full 40 feet of driveway. The proposed
ordinance would take those lots back out of compliance. He supported leaving it at 8,000
square feet.
Councilmember Malnar proposed that the ordinance be amended to strike the 12,000 square
feet requirement and leave it at 8,000 square feet in 24-68(C) and 24-68(D). He said Council
might need to bring the item back once Council discussed circular drives.
A motion was made by Councilmember Ray Malnar, seconded by Councilmember
Lauren Tolmachoff to adopt Ordinance No. 022-89.
A motion was made by Councilmember Ray Malnar, seconded by Councilmember Joyce
Clark to amend the motion to strike "12,000" in Section 24-68 paragraphs C and D.
Councilmember Turner supported the amendment. The issue could be addressed when
the UDC came forward and there was a discussion regarding circular driveways. He
supported the measurement from the property line.
Warren Wilfong, Ocotillo District resident, supported the ordinance as amended. There
were thousands of properties with 40-foot driveways and that was why the Code
Committee settled on the 8,000 square feet.

Vice Mayor Aldama said it was also the recommendation of the consultant the City hired
to work with the Code Committee.
Mayor Weiers said it was an attempt to make the Code as good as possible.

COUNCIL COMMENTS AND SUGGESTIONS
Councilmember Clark wished everyone a Merry Christmas. She thanked staff for the work done on
behalf of the residents.
Councilmember Clark said the Yucca District meeting was very successful and thanked Dale Adams
at the Desert Diamond Arena for making everyone so comfortable.
Councilmember Clark congratulated Councilmembers Tolmachoff, Turner and Aldama on their
re-election to Council.
Councilmember Hugh thanked Mayor Weiers for the successful Hometown Christmas Parade. He
wished everyone Merry Christmas.
Councimember Malnar wished everyone Merry Christmas, Happy Hannukkah and happy holidays.
Councilmember Tolmachoff thanked everyone who attended the Cholla District Holiday Mixer. She
wished everyone a safe and happy holidays.
Councilmember Turner wished residents happy holidays and a happy New Year. He expressed his
appreciation for the work done by City staff. He also wished his fellow Councilmembers a happy
holiday.
Vice Mayor Aldama said it would be his last meeting in 2022 serving as the Vice Mayor. He thanked
Council for appointing him to that role. He wished everyone a Merry Christmas and a happy New
Year.
Mayor Weiers said the Hometown Christmas Parade was the largest to date with 109 entries. It
brought people into downtown Glendale and also collected donations for the Hope for Hunger Food
Bank.
Mayor Weiers wished everyone a joyous New Year.
CITIZEN COMMENTS
Warren Wilfong, Ocotillo District resident, commented on the Unified Development Code and the
opportunity for citizen participation.
James Baird, Ocotillo District resident, read scripture and commented on abortion.
