OF THE CITY OF GLENDALE, MARICOPA COUNTY,
ARIZONA HELD TUESDAY, OCTOBER 11, 1994
The meeting was called to order by Mayor Scruggs with
the_ following Councilmembers present:" dark, Eggleston,
Huffman, McAllister, Lieberman, and Ewing. Members'" absent:
None.
Also present were Martin Vanacour, City Manager; Peter
Van Haren, City Attorney; and Pamela Oliveira, City" Clerk.
WELCOME
Mayor Scruggs welcomed Boy Scout Troops 660, 61, and 368
from Glendale.
Compliance with Article VII. Section 6 of the Glendale City
Charter
A Statement was filed by the City Clerk stating that the
three Resolutions to be considered at this meeting were
delivered to the Mayor and all members of the City Council,
were available for public examination, and the titles were
posted at City Hall more than 72 hours in advance of this
meeting.
MINUTES
It was moved by Ewing, seconded by Lieberman, to
dispense with the reading of the minutes of the regular
meeting of September 27, 1994, as each member of Council had
been provided copies in advance, and approve them. The motion
carried unanimously.
BUSINESS FROM THE FLOOR
Mr_. Bryce Alexander, 8042 W. Oregon, Glendale, AZ,
voiced his support for developing a park-at 79th Avenue and
Montebello. He said the children have" no place to play there
isn't a park within a square mile of that neighborhood".
BIDS AND CONTRACTS
1. PARKING AGREEMENT WITH U.S. WEST
Councilmember Eggleston said because of a possible
conflict of interest, he wished to be excused from
consideration of voting on this matter. Mayor Scruggs

responded let the record show that Councilmember Eggleston
has excused himself from discussion and voting on Item No. 1.
Dr. Martin Vanacour, City Manager, presented this item.
To help provide more public parking spaces in downtown, U.S.
West has agreed to allow public use - of its parking lot at
57th Drive and Glenn Drive for a three-year period. An
agreement between the City of Glendale and U.S. West has been
prepared_that outlines the conditions for public use of the
parking lot. After the three-year period, we may approve a
new agreement with U.S. West.
As part of the agreement, the City indemnifies U.S. West
against any liability in the public area, and U.S. West may
reclaim all parking spaces with 60 days notice. Since the
City is_ indemnifying U.S. West against any liability, the
City will maintain and re-stripe the parking lot. "It is
estimated that this cost will be $12,000 and these funds are
available in the Downtown Projects Fund.
By approving the agreement, the City will be adding
approximately 70 public parking spaces in downtown. This will
help provide more convenient and central parking for downtown
shoppers.
The recommendation is to authorize the City Manager to
enter Into a parking agreement with U.S. West for the use of
its parking lot at 57th Drive and Glenn Drive for public
parking.
Mayor Scruggs asked if any of the Councilmembers had
questions of the City Manager or staff on this item. There
was no response.
It was moved by Ewing, seconded by dark to authorize
the City Manager to enter into a parking agreement with U.S.
West for the use of its parking lot at 57th Drive and Glenn
Drive for public parking. The motion carried with Eggleston
"Abstaining" .
2. CHANGE ORDER NO. 1 - GLENDALE LANDFILL FLOOD CONTROL
LEVEE
Dr. Martin Vanacour, City Manager, presented this item.
This is a request for approval of- Change Order No. 1 and
final to the contract, with Granite Construction Company, for
Glendale Landfill Flood Control Levee.
Additional work, as shown on Exhibit A, was required to
remove and stockpile fencing on the north-south dike.
Monitoring wells were re-adjusted due to grade modifications
on the Northern Avenue section. The soil'cement roadway was
deleted and replaced with an aggregate base roadway surface
on the Northern Avenue section. Fill construction 'increased

significantly due to modification of grades along Northern
Avenue. The amount of this change order is $"36,069.00,
resulting in a revised contract amount of $417,115.00.
Funds for this work are available in Account No.
55-6235-8300 (Landfill Account). Public Works/Engineering
staff has reviewed the costs and found them to be "fair and
reasonable.
The recommendation is to approve Change Order No. 1 in
the amount of $36,069.00.
Mayor Scruggs asked if City Council had any questions of
the City Manager or staff on this item. There was no
response.
It was moved by Lieberman, seconded by dark to approve
Change Order No. 1 in the amount of $36,069.00. The motion
carried unanimously.
PUBLIC HEARING - Off-Track Wagering Facility License
3. OFF-TRACK WAGERING FACILITY: ARNOLD'S. 2X4 LOUNGE
(REMOVE FROM TABLE)
On May 28, 1991, the City Council enacted an Ordinance
which regulates Off-Track Wagering facilities in the City of
Glendale. Shortly thereafter, the City received its first
application to have an Off-Track Wagering Facility located in
Glendale. Although this Off-Track Wagering Facility has
changed hands three times since the original application,
Glendale has not received another site application until now.
This is a request for a new Off-Track Wagering Facility
License at Arnold's 2x4 Lounge which is located at 5106
North_ 51 Avenue, for pari-mutual wagering. This
establishment is located over 300 feet from any school or
church. The Planning and Zoning Department, Tax & License
Division and Police Department have reviewed the application
and have determined that it meets all necessary- technical
requirements.
Although a Police Department background check of the
site shows approximately 56 calls for service to this address
between 1990-1994, none of these are serious enough to
warrant a recommendation of denial by the Department
regarding this application.
A site visitation was also conducted by the Police
Department. During this inspection, it was pointed out to
the applicant that parking lot safety and "the number of
available parking spaces were concerns. The applicant
responded that the on-site security personnel would patrol

the parking lot area The applicant also noted that if
parking becomes a problem in the future, he would consider
leasing additional space if needed.
This item was tabled at the request of the applicant at
the_ September 13, 1994 Regular Council meeting. The
applicant requested that this item be placed on the October
11, 1994 Regular Council agenda. Attached is a second
request from the applicant to table this item until November
8, 1994.
Mayor Scruggs said we have one public hearing item which
needs to be removed from the table before it can be
discussed.
Councilmember Lieberman questioned Mr. Van Haren as to
whether the application had to be removed from the table
first before tabling it tonight. Mr. Van Haren said to take
any action on the item it must be removed from the table. He
recommended that it be tabled but not to any particular date.
The application can then be brought back to City Council when
it is ready.
It was moved by Lieberman, seconded by Clark, to bring
the Off-Track Wagering Facility Application from the table
and bring it to the present Council level. The motion carried
unanimously.
It was moved by Lieberman, seconded by dark, to table
the Off-Track Wagering Facility Application of Arnold7 s 2x4
Lounge for an indefinite period. The motion carried with
Councilmember Huffman voting "Nay".
RESOLUTIONS
4. MODIFICATION OF ASSESSMENT NO. 10 - IMPROVEMENT DISTRICT
NO. 59
Dr. Martin Vanacour, City Manager, presented this item.
Chicago Trust Company, as trustee under Trust No. 20621,
owner of the property on the southwest corner of 79th Avenue
and Union Hills Drive, has petitioned for a modification of
Assessment No. 10 of Improvement District No. 59. State
Statute allows this modification with City Council's
approval. The new modifications reflect assessments in
proportion to the benefits to new parcels created by Chicago
Trust Company (an existing parcel is being split "into two
separate parcels).
The City's Finance and Engineering Departments have
reviewed the appraisal for the properties and determined that
the property can bear the assessment this modification would

create This modification will not change the City's
financial position for Improvement District No. 59.
The recommendation is to waive reading beyond the title
and adopt the attached resolution approving the modification
of Assessment No. 10 of Improvement District No. 59, as set
forth in the modification resolution.

5.COMMUNITY ANTI-VIOLENCE AND GANG ENFORCEMENT TASK FORCE
Dr. Martin Vanacour, City Manager, presented this item.
In 1993, the Arizona Department of Public Safety began a Gang
Intelligence and Team Enforcement Program throughout the
State of Arizona for the purpose of anti-gang enforcement and
investigation. While the program has been successful, the
need for resources from all law enforcement agencies has
become an important factor in addressing the gang and
violence problems plaguing the state.
As a result of recent legislative funding, the
Department of Public Safety is proposing to create a. core
gang unit of 50 officers from various law enforcement
agencies in Arizona to supplement its original gang unit. It
has asked the City of Glendale Police Department to dedicate
one police officer to this endeavor. The task force members
will be used to form the Community Anti-Violence and Gang
Enforcement Task Force (C.A.G.E.), and will be divided into
four gang units to concentrate on the Phoenix Metro area, and
areas that have a high concentration of gang activity.
If approved, Glendale's participation would increase our
intelligence gathering potential, improve our ability to
coordinate joint activities with other agencies, provide a
significant increase to resources available to the Glendale
Police Department to combat gang violence and provide a
professional development opportunity to one of our officers.
By combining resources and using them to their most effective
and efficient levels, this unification of law enforcement
agencies will cause a more concentrated effort in eliminating
the presence of gangs in the valley.
The Department of Public Safety will be funding this
task force through a grant received from the Arizona Criminal

Justice Commission, and will be reimbursing participating
agencies the cost for personnel assigned full-time to the
unit. The reimbursement costs also includes equipment,
overtime, training and travel costs.
The recommendation is to waive reading beyond the title
and adopt a resolution authorizing the City Manager to enter
into an agreement with the Arizona Department of Public
Safety to assign one police officer to the Community
Anti-Violence and Gang Enforcement Task Force.

WITH THE ARIZONA DEPARTMENT OF PUBLIC SAFETY FOR THE
ASSIGNMENT OF ONE POLICE OFFICER TO THE COMMUNITY
ANTI-VIOLENCE AND GANG ENFORCEMENT TASK FORCE (C.A.G.E.)
It was moved by dark and seconded by Lieberman to pass,
adopt/ and approve Resolution No. 2920 New Series. The motion
carried unanimously.
6. INTERGOVERNMENTAL AGREEMENT WITH CITY OF PHOENIX
FOR FIXED ROUTE SERVICE
Dr. Martin Vanacour, City Manager, presented this item
This is the annual renewal of an intergovernmental agreement
between the City of Phoenix and the City of Glendale for
continued operation of fixed bus routes within Glendale. The
funding for the contract amount of $439,000 is provided in
the current approved Transit budget. The contract is for the
current fiscal year, FY94/95, and includes the following
fixed routes:
Yellow Route
Route 138
Route 59
Grand Avenue
Thunderbird Road
59th Avenue
Extension
Route 170
Route 80 Northern Avenue
Route 90 Olive Avenue
Route 24 Glendale Avenue
(Sat.Service)
Bell Road
Additional routes provided to the City of Glendale are
paid for by the Regional Public Transportation Authority and
are therefore not included in this contract. These routes
are as follows:
Route 24 - Glendale Avenue (Weekdays)
Route 59 - 59th Avenue
Route 67 - 67th Avenue
Route 570 - Northern Expressway

Route 106 - Peoria Avenue
Route 581 - Thunderbird Expressway
The recommendation is to waive reading beyond the title and
adopt a resolution to authorize execution of an inter
governmental agreement with the City of Phoenix for the
operation of fixed route services in Glendale.
Resolution No. 2921 New Series was read by number and
title only, it being A RESOLUTION OF THE COUNCIL OF THE CITY
OF GLENDALE, MARICOPA COUNTY, ARIZONA, AUTHORIZING AND
DIRECTING THE ENTERING INTO OF AN INTERGOVERNMENTAL AGREEMENT
WITH THE CITY OF PHOENIX PERTAINING TO THE FIXED ROUTE
SERVICES OPERATED IN GLENDALE BY PHOENIX TRANSIT FOR THE
1994-95 FISCAL YEAR.
It was moved by Lieberman, seconded by Huffman, to pass,
adopt, and approve Resolution No. 2921 New Series. The
motion carried unanimously.
REQUEST FOR FUTURE WORKSHOP AND EXECUTIVE SESSION
It was moved by Vice Mayor McAllister, seconded by
Lieberman, to schedule a City Council Workshop at 8:30 a.m.
and an Executive Session at 5:30 p.m., on October 25, 1994,
in Room B-3. The Executive Session is pursuant to ARS
38-431.03 to discuss personnel matters and obtain legal
advice. The motion carried unanimously
COUNCIL COMMENTS AND SUGGESTIONS
Councilmember Eggleston reminded everyone that the
popular Saturday Market commences this Saturday in Murphy
Park.
Vice Mayor McAllister said he appreciated the Boy Scouts
coming to the City Council meeting
Mayor Scruggs thanked the Boy Scouts for coming to the
meeting and invited them to come back
