GLENDALE AVE. GLENDALE, ARIZONA 85301 APRIL 27, 2022 9:30 A.M. 1. CALL TO ORDER THE LOCAL POLICE BOARD Chair Charles Erickson called the meeting to order at 9:30 a.m. 2. ROLL CALL Present: Mayor & Board Member Jerry Weiers City Manager & Board Member Kevin Phelps Board Member & Chair Charles Erickson Board Member Justin Harris, Police Officer Absent: Board Member Cody Carmichael, Police Sergeant Staff Present: Jim Brown, Board Secretary & Director of Human Resources & Risk Mgmt.(virtually) Michael Hamblin, Assistant City Attorney John Davidge, Police Sergeant Nancy Rodriguez, HR Analyst Lisa Chill, Admin Support Supervisor, HR Other Attendees Court Reporter Donna Terrell Board Attorney Cynthia Kelley 3. CITIZEN COMMENTS There were no citizens present. 4. APPROVAL OF THE MINUTES The Board approved the Public Safety Personnel Retirement System - Local Police Board Minutes of March 23, 2022 Motioned by Board Member Justin Harris, seconded by Board Member Kevin Phelps AYE: Mayor Jerry Weiers Board Member Kevin Phelps Board Member Charles Erickson Board Member Justin Harris Other: Board Member Cody Carmichael (ABSENT) Passed S. NEW BUSINESS Board Secretary Jim Brown read the pertinent information and the following questions related to the reemployment of Mark Malinski, a retired Glendale Police Sergeant. Mr, Malinski retired on April 30, 2021. He is being rehired by the City of Glendale as a Park Ranger on May 8, 2022. 1. Did Mr. Malinski become reemployed in any capacity by the City of Glendale before one year after his date of retirement? The Board agreed by consensus that the answer is No. 2. Is Mr. Malinski being hired into a non-PSPRS position? The Board agreed by consensus that the answer is Yes. 3. Does this Board Acknowledge that the City of Glendale in not responsible to pay the ACR to PSPRS, but will be responsible for matching contributions into ASRS? The Board agreed by consensus that the answer is Yes. 6. EXECUTIVE SESSION Upon a public majority vote of a quorum of the Local Police Board, the Board may hold an executive session, which will not be open to the public, regarding any item listed on the agenda but only for the following purposes: (i) discussion or consideration of records exempt by law from public inspection (A.R.S. § 38-431.03(A)(2)); (ii) discussion or consultation for legal advice with the Board's attorneys (A.R.S. § 38-431.03(A)(3)); The Board voted to go into Executive Session at 9:33 a.m. Motioned by Board Member Justin Harris, seconded by Board Member Kevin Phelps AYE: Mayor Jerry Weiers Board Member Kevin Phelps Board Member Charles Erickson Board Member Justin Harris Other: Board Member Cody Carmichael (ABSENT) Passed A. The Board reviewed the Medical Evaluations for six (6) New Police Personnel: Anthony Agresta Nicholas Azzano Christian Davids Janusz Pisarczyk Jeffrey Fisher (Lateral) Anthony Hogan (Lateral) B. The Board reviewed and discussed the Application for Accidental Disability Retirement, along with medical records, submitted by Police Sergeant Thomas Psalidas. 7. ADJOURN EXECUTIVE SESSION AND RECONVENE IN OPEN SESSION The Board reconvened in open session at 9:42 a.m. 8. CONSIDERATION AND POSSIBLE VOTE ON EXECUTIVE SESSION ITEMS A. Police Sergeant John Davidge confirmed that the following four (4) new Police Personnel have met the standards of the Glendale Police Department and the Arizona Peace Officer Standards and Training Board. Anthony Agresta Nicholas Azzano Christian Davids Janusz Pisarczyk The Board voted to approve the admission of four (4) New Police Personnel into the Public Safety Personnel Retirement System (PSPRS) with any pre-existing conditions noted on the Pre -Existing Conditions Report: Anthony Agresta Nicholas Azzano Christian Davids Janusz Pisarczyk Motioned by Board Member Justin Harris, seconded by Board Member Kevin Phelps AYE: Mayor Jerry Weiers Board Member Kevin Phelps Board Member Charles Erickson Board Member Justin Harris Other: Board Member Cody Carmichael (ABSENT) Passed B. Sergeant Davidge confirmed that the following two (2) new Police Personnel have met the standards of the Glendale Police Department and the Arizona Peace Officer Standards and Training Board. Jeffrey Fisher (Lateral) Anthony Hogan (Lateral) The Board voted to approve the transfer of service credits in the Public Safety Personnel Retirement System (PSPRS) for the following two (2) new City of Glendale Police Personnel from previous employers, with any pre-existing conditions noted on the Pre -Existing Conditions Report: Jeffrey Fisher (City of Phoenix) Anthony Hogan (Salt River PD) Motioned by Board Member Justin Harris, seconded by Board Member Kevin Phelps AYE: Mayor Jerry Weiers Board Member Kevin Phelps Board Member Charles Erickson Board Member Justin Harris Other: Board Member Cody Carmichael (ABSENT) Passed C. At the request of Sergeant Thomas Psalidas, who was not present, Mr. Brown read a letter before the motion that was written by Sergeant Psalidas to the Board. The Board acknowledged receipt of the Application for Accidental Disability Retirement submitted by Thomas Psalidas and voted to order an Independent Medical Evaluation (IME). BOARD COMMENTS AND SUGGESTIONS There were no Board comments or suggestions. 10. NEXT MEETING The next regular meeting of the Public Safety Personnel Retirement System Local Police Board will be held on May 25, 2022 at 9:30 a.m., in the 4th Floor Conference Room, located at 5850 W. Glendale Ave., Glendale, Arizona, 85301. 11.
