Ms. Bower read the Ordinance by title.
Ms. Perry said the request was to rezone 10 acres from C-2 (General Commercial) to R-4
(Multiple Residence) to allow for a 120 -unit multi -family development. The General Plan
Designation was MDHR 12 (Medium to High Density Residential, 8.0-12.0 dwelling units/acre)
and was consistent with the General Plan Land Use designation.
Ms. Perry said the request met the General Plan, provided sufficient infrastructure, increased
housing supply and utilized underdeveloped property and supported infill development. The
Planning Commission recommended approval of ZON21-17, subject to 2 stipulations outlined
in the staff report.
Councilmember Clark asked what amenities would be offered as part of the project.
Ms. Perry said the applicant had not yet submitted a design review application but amenities
would typically include a tot lot, pool and spa, fitness center, and clubhouse.

Mr. St. John said the proposed amendments were discussed at a Council workshop and there
was consensus to move forward. The first amendment dealt with the feeding of pigeons on
private property, making it illegal to do so in such a way as to create health and safety
concerns. The second amendment dealt with holiday decorations and allowed residents to
install holiday decorations up to 60 days prior to the celebrated holiday rather than the original
30 -day provision.

Mr. St. John said with the proposed language, a violation would occur when a resident with a
grass lawn allowed the grass to exceed 6 inches in height.
Councilmember Malnar asked if a resident had desert landscaping, would the weeds have to
be 6 inches in height to be considered blight.
Mr. St. John said it would be a violation regardless of the height of the weeds.
Mayor Weiers asked if the resident was responsible for grass growing in the sidewalk that
could cause a tripping hazard.
Mr. St. John said that was a violation.
Warren Wilfong, Ocotillo District resident, spoke in opposition to the ordinance.
Councilmember Malnar asked if by adding the 6 -inch rule would it apply to weeds in desert
landscaping.
Mr. Bailey said Mr. St. John's explanation was correct and it would be enforceable. It
addressed hazards or nuisances that were less than 6 inches.
Mr. St. John said it could be broken into three areas:
. Any property in the City could not have weeds or grass over 6 inches in height
. Any desert -landscaped property could not have weeds that caused blight regardless of
height
. Any vegetation on sidewalks that constituted a tripping hazard was a violation regardless
of height,
A motion was made by Councilmember Ray Malnar, seconded by Councilmember Lauren
Tolmachoff to adopt Ordinance No. 022-29.
Mayor Weiers did not think it was the citizens' responsibility to make sure there was not a
tripping hazard on sidewalks. He would be voting no.

ARIZONA, AUTHORIZING CASH AND APPROPRIATION BALANCE TRANSFERS
BETWEEN BUDGET ITEMS IN THE ADOPTED FISCAL YEAR 2021-2022 BUDGET.

Ms. Bower read the ordinance by title.
Ms. Camacho said the proposed ordinance would approve certain Fiscal Year 2021-2022
(FY21-22) budget amendments. Exhibit A contained the requested cash and appropriation
transfers between departments and funds. The transfers were consistent with the Cash and
Budget Appropriation Transfer Policy. The total budget appropriation across all funds
remained unchanged.
Councilmember Tolmachoff asked what the process was to decide where the appropriations
went when it was re -appropriated and what funds needed appropriation.
Ms. Camacho said Budget finds where there was available appropriation that would not be
utilized during the current fiscal year and only the appropriation was transferred to the fund
where it was needed. No cash was being moved. She said departments would request an
appropriations transfer.
Ms. Rios said some of the transfers were cases where a project was brought forward to
Council and Council provided consensus to proceed with the project. There was no funding

for the project. Budget transfers could only take place in the fourth quarter.

Mr. Bailey said the item had been presented at a Council workshop and there had been
consensus to proceed. There had been discussion regarding membership requirements for
the Planning Commission and an amendment was being proposed to section 3.102(c) which
stated "Members shall be residents of the City of Glendale or own real property, operate a
licensed business of continuous operations in the City of Glendale and demonstrate civic
participation in community activities."
A motion was made by Councilmember Bart Turner, seconded by Councilmember Lauren
Tolmachoff to adopt ordinance No. 022-32.
A motion was made by Councilmember Bart Turner, seconded by Councilmember Joyce
Clark to amend the motion with following amendment to 3.102(c) pertaining to the
compositions of the Planning Commission:
Members shall be residents of the City of Glendale or own real property, operate a
licensed business of continuous operations in the City of Glendale and demonstrate
civic participation in community activities.
Councilmember Turner said the amendment would allow non-residents to serve on the
Planning Commission. He did not think that was a good idea. There would be no limit on
the number of non-residents who could serve on the Planning Commission. Council
should be able to find good, qualified residents who had a vested stake in the outcome of
the City as members of boards and commissions, including the Planning Commission. He
did not support the amendment to the motion.
Councilmember Clark said there were people who had businesses in Glendale who were

extremely vested in the City and participated regularly in the life of the community that
would fit the proposed criteria. She asked Council to approve the amendment as stated.
Mayor Weiers said when a business owner was willing to give back to the community, he
did not know why Council would not want to take advantage of that.

Councilmember Turner said he was opposed to the amendment, but the uniform bylaws
were important and would be helpful to all of the boards and commissions.

COUNCIL COMMENTS AND SUGGESTIONS
Councilmember Hugh congratulated Vice Mayor Aldama on the successful Hook -a -Kid on Fishing
event held at Bonsall Park.
Councilmember Tolmachoff reminded Cholla residents and City staff of the first annual Cholla District
barbeque at 5:30 p.m. on May 12th at the Foothills Recreation and Aquatics Center.
Councilmember Turner recognized Councilmember Malnar for the work he had done to improve the
neighborhood of Granada Estates.
Vice Mayor Aldama thanked Councilmember Hugh and Councilmember Clark for attending the 6th
annual Hook -a -Kid on Fishing event. He also thanked City staff and his family for making it a
successful event.
Mayor Weiers said an induction ceremony would be held on May 6th to recognize nearly 200 high
school students who had made the decision to enter military service. Retired 4 -star General Robin

Rand would be administering the oath.

Lynn Bulmer, Sahuaro District resident, addressed issues in the Granada Estates neighborhood.
Joyce Capson, Sahuaro District resident, addressed issues in the Granada Estates neighborhood.
James Greeley, Sahuaro District resident, addressed issues in the Granada Estates neighborhood.
Warren Wilfong, Ocotillo District resident, addressed parking violations.
