GLENDALE AVE. GLENDALE, ARIZONA 85301 JANUARY 26, 2022 9:30 A.M. 1. CALL TO ORDER A JOINT MEETING OF THE LOCAL FIRE AND POLICE BOARDS Chair Charles Erickson called the joint meeting of the Local Fire and Police Boards to order at 9:30 a.m. 2. ROLL CALL FOR THE JOINT MEETING OF THE LOCAL FIRE AND POLICE BOARDS Present: Mayor & Board Member Jerry Weiers Board Member & Chair Charles Erickson Fire Board Member Paul Morales, Fire Captain (virtually) Police Board Member Cody Carmichael, Police Sergeant Police Board Member Justin Harris, Police Officer Absent: City Manager & Board Member Kevin Phelps Fire Board Member Anthony Love, Fire Engineer Staff Present: Jim Brown, Board Secretary & Director of Human Resources & Risk Mgmt.(virtually) Michael Hamblin, Assistant City Attorney Ken Barnes, Assistant Fire Chief John Davidge, Police Sergeant Nancy Rodriguez, HR Analyst Lisa Chill, Admin Support Supervisor, HR Other Attendees Court Reporter Donna Terrell Police Officer Dustin Davis Mrs. Shawna Lee Davis 3. CITIZEN COMMENTS There were no citizens present. 4. DISCUSSION ON PROCURING INDEPENDENT LEGAL COUNSEL FOR THE BOARDS Prior to the discussion, Chair Erickson recused himself from the discussion as he stated that he has a personal relationship with one of the attorneys on the list of possible attorneys for the Board to utilize. Board Secretary Jim Brown led the discussion related to procuring independent legal counsel for the Boards as required by HB2381 with an overview of the process that HR had gone through to find options for the Board. All Board Members except for Chair Erickson discussed their concerns and thoughts regarding this decision. 5. CONSIDERATION AND POSSIBLE ACTION ON PROCURING LEGAL COUNSEL FOR THE BOARDS The Board voted to enter into an initial one-year service agreement with Ryan Rapp Underwood & Pacheco to provide legal services to the Board. ADJOURN THE JOINT MEETING OF THE LOCAL FIRE AND POLICE BOARDS Chair Erickson adjourned the joint meeting at 9:41 a.m. 7. CALL TO ORDER THE LOCAL POLICE BOARD Chair Charles Erickson called the Local Police Board meeting to order at 9:50 a.m. 8. APPROVAL OF THE MINUTES The Board approved the Public Safety Personnel Retirement System - Local Police Board Minutes of December 15, 2021 Motioned by Board Member Cody Carmichael, seconded by Board Member Justin Harris AYE: Mayor Jerry Weiers Board Member Charles Erickson Board Member Cody Carmichael Board Member Justin Harris Passed 11. NEW BUSINESS There was no new business for open session. 12. EXECUTIVE SESSION Upon a public majority vote of a quorum of the Local Police Board, the Board may hold an executive session, which will not be open to the public, regarding any item listed on the agenda but only for the following purposes: (i) discussion or consideration of records exempt by law from public inspection (A. R. S.§38 -431.03(A)(2)); (ii) discussion or consultation for legal advice with the Board's attorney (A.R.S. § 38-431.03(A)(3)) The Board voted to go into Executive Session. The Board reviewed the Medical Evaluation for New Police Personnel - Jacob Ayala B. The Board reviewed the Medical Evaluation for New Police Personnel - Maurice McGhie C. The Board reviewed the Application for Ordinary Disability Retirement, along with medical records, submitted by Dustin Davis 13. ADJOURN EXECUTIVE SESSION AND RECONVENE IN OPEN SESSION 14. CONSIDERATION AND POSSIBLE VOTE ON EXECUTIVE SESSION ITEMS A. The Board voted to approve admission of two (2) New Police Personnel into the Public Safety Personnel Retirement System (PSPRS) with any pre-existing conditions noted on the Pre -Existing Conditions Report: Jacob Ayala Maurice McGhie Motioned by Board Member Justin Harris, seconded by Board Member Cody Carmichael AYE: Mayor Jerry Weiers Board Member Charles Erickson Board Member Cody Carmichael Board Member Justin Harris Passed B. Before the motion, Chair Erickson asked Police Officer Dustin Davis if he would like to address the Board. Mr. Davis said that he would and he read a statement that he had prepared detailing the injuries, and the impact of those injuries on his life, caused by his automobile accident. The Board acknowledged receipt of the Application for Ordinary Disability Retirement submitted by Dustin Davis and voted to order an Independent Medical Evaluation (IME). Motioned by Board Member Cody Carmichael, seconded by Board Member Justin Harris AYE: Mayor Jerry Weiers Board Member Charles Erickson Board Member Cody Carmichael Board Member Justin Harris Passed 15. BOARD COMMENTS AND SUGGESTIONS There were no Board comments or suggestions. 16. NEXT MEETING The next regular meeting of the Public Safety Personnel Retirement System Local Police Board will be held on February 23, 2022 at 9:30 a.m., in the 4th Floor Conference Room, located at 5850 W. Glendale Ave., Glendale, Arizona, 85301. 17.
