Ms. Bower read the item by title.
Ms. Perry said the annexation request involved approximately 63 acres of vacant land for a
multi -building industrial development. The property, currently within the Maricopa County
jurisdiction, was zoned IND -1 (Planned Industrial) and IND -2 (Light Industrial). Upon
annexation, tentatively scheduled for December 14th, the City would apply the most
compatible City zoning district which was M-1 (Light Industrial). The General Plan land use
designation was RMU (Regional Mixed Use). The process would occur simultaneously with
the annexation. Following annexation, the applicant sought to rezone the property from M-1 to
PAD (Planned Area Development). The proposed PAD did not include residential land uses.

Mayor Weiers opened the public hearing.
Ms. Perry said the proposed ordinance would approve a rezoning application (ZON21-21) for
a 75 -acre project titled "Organics Loop 303," located at the southwest corner of Bethany
Home Road and Sarival Avenue.
Ms. Perry said the applicant hosted a virtual neighborhood meeting. No one attended the
meeting. The applicant and City staff had been made aware of a property owner with
concerns about access points, performance standards and lack of notification. Staff also
received an email from an adjacent property owner with concerns about increased traffic
volume. Staff believed the land uses with the associated performance standards were
appropriate to mitigate the concerns.
Ms. Perry said staff did verify that the address of the property owner who expressed concerns
about notification was listed on the applicant's affidavit regarding notice.
Ms. Perry said the request was to rezone the property from RR -45 to PAD (Planned Area
Development) to allow for a mixed-use development. The property was designated as
an LCLU (Luke Compatible Land Use) Area. The application was in compliance with the
designation. The maximum building height proposed was 60 feet. Two buildings were
proposed for a total of 851,300 square feet. Half street improvements would be made to
Bethany Home Road and Sarival Avenue. There were stipulations to address access with a
shared common access easement.
Ms. Perry said the Planning Commission recommended approval of the application subject to

stipulations.
The following people spoke in opposition to the application:
Cynthia Graber, Phoenix resident
Tom Howard, Phoenix resident
Ken Roth, applicant, said he had reached out to Ms. Graber and explained that the access
point would be entirely on the subject property not her property. He did offer to make it a
common entrance that could be shared by both properties.
Councilmember Turner said stipulations 5 and 6 indicated a 45 -foot common (shared) private
access easement along the west property line from Bethany Home Road to Missouri Avenue
and from Missouri Avenue to Sarival Avenue. The easement was entirely on the applicant's
property.
Mr. Roth said that was correct. It would be shared for access onto the adjacent property to
the south.
Councilmember Turner said the applicant was willing to use 45 feet of the applicant's property
to access the neighboring property and it would be a private access.
Mr. Roth said that was correct. It would also allow emergency access if necessary.
Councilmember Turner asked if the irrigation ditch that ran along the north -south alignment
would be preserved.
Mr. Roth said the ditch was contained entirely on the neighboring property. The
development's boundary wall would be to the east side of the irrigation ditch.
Councilmember Clark asked who sent out the public notification.
Ms. Perry said the applicant sent out the notification letters inviting property owners in the
designated neighborhood to attend the virtual neighborhood meeting. When the application
moved on to the public hearing process, City staff sent out postcard notification of the public
hearings. Staff used the mailing list provided by the applicant. She said the adjacent property
owner's address was included on the mailing list.
Councilmember Clark said it was not required for the adjacent property owner to grant an
access easement because the access was entirely on the applicant's property.
Ms. Perry said that was correct. If the adjacent property owner wanted access in the future, it
would be granted.
Councilmember Clark asked if the irrigation ditch was entirely on the adjacent property and if
the applicant had any reason to do anything with regard to the ditch.
Ms. Perry said the ditch was entirely on the adjacent property. The City would not approve
anything that would eliminate access to the ditch. There would be no impingement on the
adjacent property owner's water rights.
Councilmember Clark said the City in good faith mailed the notification postcards. The
adjacent property owner's access, irrigation ditch and water rights would not be impacted by
the development.

newspaper.

zoning. Like zoning within the City would be RR -45. The applicant had submitted a
companion rezoning application to rezone the property to PAD (Planned Area Development)
for a commercial and industrial development.

Ms. Perry said the request was for a Minor General Plan Amendment (GPA21-10) and
rezoning for a 7.5 -acre project titled "The Capistrano" located at 7410 North Zanjero
Boulevard to allow for the development of 314 dwelling units which included repurposing a
3 -story vacant building.
Ms. Perry said the Minor General Plan Amendment proposed a change from CCC (Corporate
Commerce Center) to EMU (Entertainment Mixed Use) and a rezoning from PAD (Planned
Area Development) to PAD for a development plan entitled "The Capistrano." The applicant
also proposed limited commercial uses on the first floor of the existing 3 -story building. The
maximum building height was 85 feet for the existing building and 65 feet for a proposed
building. There was a 15 -foot landscape buffer.
The Planning Commission recommended approval of the Minor General Plan Amendment
and the rezoning application with stipulations.

Councilmember Clark thanked the developer for incorporating so many elements of the
original building. The whole concept would blend together. She loved the project.

Ms. Bower read the ordinance by title. She said the proposed ordinance would adopt the new
Council district boundaries that Council reached consensus on at its workshop on November
9th. If approved, the new boundaries would go into effect immediately.
A motion was made by Councilmember Ray Malnar, seconded by Vice Mayor Ian Hugh to
adopt Ordinance No. 021-82.
Councilmember Clark was disappointed that the map did not incorporate the request of
Independence Heights residents. The City would continue to grow, and the Yucca District
would have an incredible increase in population. Council was putting off the inevitable in
order to keep the boundary lines as close as possible to what they had always been.
There would be dramatic shifts in the boundaries in ten years to accommodate the growth
in the Yucca District. Council had preserved the largest geographical district, encouraged
the largest population growth that would occur in the next few years and preserved the
City Council Meeting Minutes - November 23, 2021 Page 11 of 17
district that remained the economic -driver in the City. It made a very strong case for
completing all of Heroes Park. She would be voting no on the motion.

A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY,
ARIZONA, APPROVING THE AMENDED SUBMISSION OF THE CITY OF GLENDALE'S
2021 COMMUNITY HOUSING ANNUAL PUBLIC HOUSING AGENCY PLAN (FORM
HUD -50075 -ST), TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT.

Ms. Moreno requested that Council conduct a public hearing and adopt a resolution approving
and authorizing the submission of a significant amendment to the City of Glendale's 2021
Annual Public Housing Authority Plan to the U.S. Department of Housing and Urban
Development (HUD). The action would add two new policies to the Glendale Housing
Authority's Housing Choice Voucher Administrative Plan for Emergency Housing Vouchers
and Project Based Vouchers.
Ms. Moreno said both chapters were regulatory in nature. The first chapter was to document
the City's policies relating to the administration of the Emergency Housing Voucher Program.
The second chapter would allow the City to,take advantage of an economic development tool
to attract the creation of new housing units in Glendale through the use of project -based
vouchers. There was no new funding associated with the use of the tool, but it would serve
as a mechanism to address the supply shortage of affordable units in the community. The
units would be required to rent at published fair market rental rates.
Councilmember Clark asked what was meant by project -based voucher.
Ms. Moreno said it was taking one of the City's existing housing choice vouchers and
dedicating it to a specific development. For example, there was a 100 -unit project that the
City might provide 30 project -based vouchers for the development. The 30 units would be
deemed "affordable" to address the needs of the population utilizing the vouchers.
Councilmember Clark asked what fair market rates were.
Ms. Moreno said fair market rents were published annually by HUD to ensure that the City's
housing assistance payments were in accordance with fair market rent in the region.
Councilmember Aldama said it was a tool to increase the affordable homes inventory.
Ms. Moreno said that was correct. Currently, there was a lack of affordable units, and the tool
would sustain the inventory of units that were required to remain affordable for a long period
of time.
Councilmember Tolmachoff asked if the funding could be used for a specific demographic,
such as hearing-impaired or seniors.
Ms. Moreno said the demographics mentioned were suitable for the City's programs.
Mayor Weiers said one of the biggest problems was seniors being priced out of their homes
because of the rent increases. The homeless problem would get worse. He was in full

Mayor Weiers opened the public hearing.
Dan Klocke, Phoenix resident, spoke in favor of the item.
Mayor Weiers closed the public hearing.
A motion was made by Councilmember Jamie Aldama, seconded by Vice Mayor Ian
Hugh to adopt Resolution No. R21-121.
Mayor Weiers said it was one more tool for the City to use and he was very excited about
it. He said Ms. Moreno was doing an awesome job.

COUNCIL COMMENTS AND SUGGESTIONS
Councilmember Aldama said the Human Rights Campaign (HRC) released its scorecard for the 2021
Municipal Equality Index (MEI), a nationwide evaluation that rated 506 cities based on
non-discrimination laws, the municipality as an employer, municipal services, law enforcement, and
leadership on LGBTQ+ equality. Glendale received a score of 94, its highest score since Glendale
had been included in the Index. The high score demonstrated Glendale was an inclusive and
welcoming community. The score was also important as the City continued to pursue future
opportunities to host mega -events and attract world-class businesses that prioritized inclusiveness.
Councilmember Clark wished everyone a happy Thanksgiving.
Councilmember Malnar expressed his gratitude for the opportunity to serve with his fellow
Councilmembers and City staff. He was also grateful for his wife and family, his health and all the
citizens who dedicated their time and effort to help others.
Councilmember Tolmachoff wished everyone a happy Thanksgiving. She was proud that the City had
done a lot of really good things as shown by the high score in the HRC's MEI.
Councilmember Tolmachoff reminded Cholla residents of the Cholla District meeting on December 2nd
at 5:30 p.m. at the Foothills Recreation and Aquatics Center.
Councilmember Turner extended holiday wishes to the employees and residents of Glendale. He said
we were blessed to live in a time and a place where there was abundance.
Vice Mayor Hugh said it was a pleasure to serve with his fellow Councilmembers and City staff. He
wished everyone a happy Thanksgiving.
Mayor Weiers reminded everyone of the Christmas Parade on December 11th at 11:00 a.m. It kept
getting bigger and better.
CITIZEN COMMENTS
Dennis Nielsen, Sahuaro District resident, spoke regarding issues with feeding pigeons in residential
areas.
