AN ORDINANCE OF THE COUNCIL OF THE CITY OF
GLENDALE, MARICOPA COUNTY, ARIZONA, PURSUANT TO
ARTICLE VII, SEC. 5 (d) OF THE GLENDALE CITY
CHARTER, AUTHORIZING AND DIRECTING THE MAYOR
AND/OR CITY MANAGER AND CITY CLERK TO EXECUTE A
LEASE AGREEMENT WITH ACES AVIATION ASSOCIATES
FOR A FIXED BASE OPERATION AT THE GLENDALE
MUNICIPAL AIRPORT; AND DECLARING AN EMERGENCY.
WHEREAS, the City is the owner of a municipal airport located at
the intersection of Glendale Avenue and 107th Avenue; and
WHEREAS, a certain portion of the Airport is designed to be used
as a fixed base operation ("FBO") , such property containing
approximately 176, 351 square feet of land improved with facilities for
use as a FBO building and approximately 13 , 124 square feet of land
improved with certain facilities for use as an aviation fuel farm (the
"FBO Property") ; and
WHEREAS, the City desires to lease the FBO Property to Aces
Aviation Associates, a limited liability company, and Aces Aviation
Associates desires to lease the FBO Property from the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
GLENDALE as follows:
SECTION 1 . That the City has determined that the fixed base
operation at the Glendale Municipal Airport owned by the City of
Glendale shall be leased to Aces Aviation Associates and that the
Charter of the City of Glendale requires the lease of public property
to be accomplished by ordinance.
SECTION 2 . That the Mayor and/or City Manager and City Clerk are
hereby authorized and directed to execute the Lease Agreement, a copy
of which is on file with the Clerk of the City of Glendale.
SECTION 3 . Whereas the immediate operation of the provisions of
this Ordinance is necessary for the preservation of the public peace,
health, and safety of the City of Glendale, an emergency is hereby
declared to exist, and this Ordinance shall be in full force and effect
from and after its passage, adoption, and approval by the Mayor and
Council of the City of Glendale, and it is hereby exempt from the
referendum provisions of the Constitution and the laws of the State of
Arizona.
