Ms. Bower read the resolution and ordinance by title.
Mr. Richert said the request was for a Minor General Plan Amendment from BP (Business
Park) to EMU (Entertainment Mixed Use) and a zone change from A-1 (Agricultural) to PAD
(Planned Area Development). The project size was 33 acres. He said notices were mailed on
March 15, 2021 to property owners within 300 feet and the site was posted on March 12th.
No comments had been received.
Mr. Richert said the Planning Commission recommended approval of the request at its
meeting on April 1, 2021, finding the PAD proposal would result in a quality development
product which was consistent with the goals and objectives of the General Plan by ensuring
mixed use projects with housing, retail, restaurants, and integrated transit facilities and was
consistent with the development objective of the General Plan.
Mr. Richert said staff found the request conformed to standards and recommended approval
subject to the following stipulations:
1. Conformance to the 99th Avenue and Glendale Avenue PAD dated March 3, 2021,
2. The developer shall grant and record an avigation easement to the City, Glendale
Municipal Airport for the site, per the content and form prescribed by the City Attorney.
The developer shall create and incorporate a section within the community CC&R's or
residential leases or regulations that clearly defined the airport nuisances, aircraft noise
and overflight issues. It shall be completed and approved by the City prior to the final
approval of construction documents and/or issuance of permits.
3. The developer shall provide documentation to the City prior to the final approval of
construction documents and/or issuance of permits that Form 7460- 1 had been filed for
the development with the Federal Aviation Administration (FAA) and the development

received a "No Hazard Determination". If temporary equipment used during construction
exceeded the height of the permanent structure, a separate Form 7460-1 shall be
submitted to the FAA and a "No Hazard Determination" obtained prior to the construction
start date.
4. An in -lieu payment for the north half of the future median on Glendale Avenue adjacent
to the site shall be received prior to permits being issued for the first phase of
development. The payment would be based on an Engineer's Cost Estimate to be
reviewed and approved by the City.

NORTHERN AVENUE AND REEMS ROAD FROM THE RR -45 ZONING DISTRICT TO PAD
(PLANNED AREA DEVELOPMENT) FOR AN INDUSTRIAL DEVELOPMENT PLAN
ENTITLED "THE CUBES AT GLENDALE"; AMENDING THE ZONING MAP; PROVIDING
FOR AN EFFECTIVE DATE; AND DIRECTING THE CITY CLERK TO RECORD A

Mr. Richert said the request was to rezone approximately 75.6 acres from RU -43 (Rural) to
PAD (Planned Area Development). He said 260 acres of the project had already been
annexed into the City (Reems Ranch: AN -220). The applicant was Mike Withey of Withey
Morris PLC.
Mr. Richert said the land uses mirrored the land uses in the Reems Ranch PAD and included
typical M-1 and C-2 uses (general commercial, retail, offices, industrial and warehouse). The
coverage was 60% and billboards would not be allowed.
Mr. Richert said at its meeting on April 1, 2021, the Planning Commission recommended
approval with an amendment to Stipulation #6 stating billboards and digital billboards were not
allowed and a new stipulation #9 stating the maximum building height could not exceed 54
feet measured from finished floor elevation. Both Luke Air Force Base and the applicant
supported the amendments. The proposed rezoning was consistent in substance and
location with the development objectives of the General Plan and the proposal would be
compatible with the Reems Ranch PAD.
Mr. Richert said staff recommended approval subject to the following:
1. Development shall be in conformance with the Cubes at Glendale PAD development
narrative dated March 26, 2021.
2. Onsite retention would be required for the 100 -year, 2 -hour storm even for the gross site
area, including the adjacent portions of Reems Road & Northern Avenue.
3. All power lines on and adjacent to the site under 69KV shall be placed underground.
4. Right-of-way dedications of 55 feet was required for both Reems Road & Northern
Avenue.
5. FAA Obstruction Evaluation / Airport Airspace Analysis (OE/AAA) might be required at
Design Review.
6. Billboards and digital billboards were not permitted.
7. Design review approval was required for all site development.
8. Any proposed loading docks and tractor trailer parking must be screened from view with
an 8 -foot tall decorative block wall along Northern Avenue & Reems Road.
9. The maximum building height could not exceed 54 feet from finished grade.

Mr. Richert said the ordinance would approve annexation of a 78 -acre site located north of
Camelback Road, west of 152nd Avenue and south of Luke Air Force Base with 595,080
square feet of industrial and manufacturing uses proposed. The fiscal impacts included net
annual revenues of $440,000 and one-time revenues of $4.8 million. The existing Maricopa
County zoning was RU -43 (Rural) with Military Compatibility Permit and the City's
"like -zoning" was PAD (Planned Area Development).

25. ORDINANCE NO. 021-34

Ms. Chapin said the proposed ordinance granted a new utility easement in favor of Arizona
Public Service Company (APS) at the Glendale Regional Public Safety Training Center
(GRPSTC).
Ms. Chapin said in 2019, Council approved the City's participation in APS' Take Charge
Arizona Electric Charging Station Pilot Program. As part of the program, APS was installing

Ms. Camacho said the proposed ordinance approved certain Fiscal Year 2020-2021

COUNCIL COMMENTS AND SUGGESTIONS
Councilmember Aldama thanked the officers of the Glendale Police Department for their service to the
community.
Councilmember Clark had asked the developer for agenda item 22 how the name "The Cubes" was
chosen. She was told it was chosen because industrial buildings were measured in cubic feet. Steel
had been ordered for The Cubes last week and would not be delivered until October. The wait for
steel would slow down development.
Councilmember Clark was pleased to announce the groundbreaking for the lake at Heroes Park on
Monday, May 24th at 9:00 a.m.
Mayor Weiers said there were other developments in the country called "The Cubes" so this project

was "The Cubes at Glendale." He said there were wonderful things going on in the City.
