Ms. Rabin read the ordinance by title.
Mr. Richert said the request was for a zoning change from R-4 (Multiple Residence) to R-5
(Multiple Residence) in order to enable the expansion of a previously approved 192 -unit
apartment complex known as Golden Lane Apartments. The proposal would add 1.9 acres to
the initial project site, for a total of 9.33 acres. It would add 72 units, for a total of 264 units
(28.4 units/acre). The site was located at the southwest corner of Alice Avenue and 67th
Avenue.
Mr. Richert said the Planning Commission, at a public hearing on March 4th, approved the
proposal. The request was consistent with the policies/objectives of the General Plan. It
would encourage development within a portion of the community where infrastructure already
existed and was compatible with adjacent facilities and residences. Staff recommended
approval with the following stipulations:
1. Development in substantial conformance to the Design Review submittal (DR21- 03),
dated January 18, 2021; and any revisions required as part of that review.
2. Staff approval of site plan revisions in conformance to building height and setback
standards for the R-5 Zone; and which addressed all transportation concerns for
stacking and turnaround at the entry along 67th Avenue.
3. Lot tie which combines both parcels.

ARIZONA, REZONING PROPERTY LOCATED AT THE NORTHEAST CORNER OF 69TH
AVENUE AND PARADISE LANE FROM R14 (SINGLE RESIDENCE) TO R-3 (MULTIPLE
RESIDENCE) FOR A DEVELOPMENT PLAN ENTITLED "PARADISE ENCLAVE";
AMENDING THE ZONING MAP; PROVIDING FOR AN EFFECTIVE DATE; AND
DIRECTING THE CITY CLERK TO RECORD A CERTIFIED COPY OF THE ORDINANCE.

Ms. Rabin read the resolution and ordinance by title.
Mr. Richert said the request was for approval of GPA20-06 and rezoning the property from
R1-4 to R-3 (Multiple Residence) for a project titled "Paradise Enclave" located at the
northeast corner of 69th Avenue and Paradise Lane. The proposed project was on 4.83 acres
and would include a high-quality gated apartment complex that would consist of seventy (70)
dwelling units at a density of fifteen dwelling units per acre (du/ac). The townhome
development would provide an ample number of amenities for different age groups within the
community. In addition, the townhomes would include two -car garages and one guest parking
space for every three dwelling units. The project had the support of the neighborhood to the
north.
Mr. Richert said staff found that the Planned Area Development (PAD) would result in a
quality development product which was consistent with the goals and objectives of the
General Plan by development of in -fill parcels where infrastructure was available. It
contributed to the diversity and supply of housing within Glendale. Staff recommended
approval subject to the following stipulations:
1. Conformance to the Paradise Enclave Minor General Plan Amendment and R-3
Narrative revised submittal dated December 23, 2020.
2. Dedication of additional right-of-way on 69th Avenue to provide a total half -width of 35
feet shall be made before building permits were issued for any development on the
property.
3. Dedication of additional right-of-way on Paradise Lane to provide a total half -width of 35
feet shall be made before building permits were issued for any development on the
property.
4. All half -street improvements on 69th Avenue and Paradise Lane adjacent to the site
must be completed with development of the property.
5. A right-of-way abandonment shall be processed for all interior streets.
6. All gated driveways shall require a turnaround area.
7. All overhead utility lines, including communication lines and electric lines less than 69 kv
on or adjacent to the site shall be undergrounded as part of the project.
8. Shall vacate the Paradise Enclave Plat and obtain final plat approval of a one -lot
subdivision prior to design review.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY,
ARIZONA, REZONING 7.2 ACRES LOCATED AT 5330 WEST UNION HILLS DRIVE FROM
A-1 (AGRICULTURAL) AND SR -30 (SUBURBAN RESIDENTIAL) TO PAD (PLANNED AREA
DEVELOPMENT) FOR A DEVELOPMENT PLAN ENTITLED "TERRA POINTE"; AMENDING
THE ZONING MAP; PROVIDING FOR AN EFFECTIVE DATE; AND DIRECTING THE CITY
CLERK TO RECORD A CERTIFIED COPY OF THE ORDINANCE.

Mr. Richert said the request by Benjamin Graff, on behalf of Quarles & Brady LLP,
representing Terra Pointe LLC, was for approval of a rezoning from SR -30 (Suburban
Residential) and A-1 (Agricultural) to PAD (Planned Area Development) to enable expansion
of an existing senior living and assisted care facility known as Terra Pointe. The 7.2 -acre site
was located at the northwest corner of Union Hills Drive and 53rd Avenue and was in the
Cholla District. The site currently included an existing senior living facility, constructed in
1981. The facility was renovated in 2015 as a 74 -bed memory care center.
Mr. Richert said the request was consistent with the General Plan. It provided a highly
needed community service; promoted infill development where infrastructure was already
available; and was compatible with adjacent facilities and residences. Staff recommended
approval subject to the following stipulations:
1. Development in substantial conformance to the PAD narrative, dated December 7,

2020. Narrative to be amended to clarify that any future multi -family use of the property
would be subject to further hearing action; and to allow "accessory offices and select
personal services (barber, etc.)." No other uses would be allowed without further hearing
action.
2. Dedication of a 10 -foot right-of-way adjacent to APN #200-25-004F to bring the total
right-of-way on Union Hills Drive to 65 feet.
3. Dedication of additional right-of-way on 54th Avenue so that the public sidewalk and
public streetlights were encompassed within right-of-way. 25' half street right-of-way
dedication was required.
4. As the ROW for North 53rd Avenue was private, an ingress/egress easement shall be
recorded along the eastern edge of APN #200-25-004F to encompass the existing
pavement utilized by properties adjacent to the property and by properties to the north
so that they (and emergency/service vehicles) would have legal access. The dedication
shall include the easement required for the placement of a sidewalk along the property
frontage.

Mr. Graff clarified stipulation number 1. The applicant had agreed that if a multi -family use
was to come into play, it would require a future hearing. The personal services, such as
barber services, were currently permitted as a right.

A motion was made by Councilmember Lauren Tolmachoff, seconded by Councilmember
Jamie Aldama to adopt Ordinance No. 021-26.
Councilmember Tolmachoff said the project was a win-win for the community. The
formerly blighted property had been turned into a beautiful facility that met a need for the
aging population.

- GROUP HOMES) OF THE ZONING ORDINANCE; PROVIDING FOR SEVERABILITY,
SETTING FORTH AN EFFECTIVE DATE; AND DIRECTING THE CITY CLERK TO
RECORD A CERTIFIED COPY OF THE ORDINANCE.

Ms. Perry said the proposed ordinance would amend Section 7.502, Group Homes of the
Zoning Ordinance. The ordinance was in response to a complaint received from the Housing
and Urban Development Department (HUD). Currently, group homes were defined as a
dwelling shared as a primary residence by at least six (6) but not more than ten (10)
handicapped or disabled persons.
Ms. Perry said the proposed ordinance would remove the maximum number of unrelated
individuals from the definition, include a more inclusive list of services provided and provide
clarity in the disability accommodations process.
Ms. Perry said the Planning Commission had recommended approval of the amendment at its
meeting on March 18, 2021.

39. ANNEXATION AN -222 FALCON PARK (PUBLIC HEARING) LOCATED TO THE NORTH OF
152ND AVENUE AND CAMELBACK ROAD INTERSECTION

Mr. Richert said the 78 -acre property was located north of Camelback Road, west of 152nd
Avenue and south of Luke Air Force Base and 595,080 square feet of industrial and
manufacturing use was proposed. At its meeting on March 23rd, Council gave direction to
move forward with the annexation process and approved a pre -annexation development
agreement (PADA) to allow the property owner to address infrastructure needs.

Mr. Richert said the fiscal impacts and assumptions included an annual net benefit to the City
of $440,000 and one-time revenues of $4.8 million. The public hearing on the adoption of the

Mr. Richert said the approximately 75.6 -acre property was located south of Northern Avenue,
east of Reems Road and north of Luke Air Force Base with 1.2 million square feet of industrial
and manufacturing use proposed. Council approved a pre -annexation development
agreement (PADA) to allow the property owner to address infrastructure needs and provided
consensus to move forward with the annexation.
Mr. Richert said the fiscal impacts and assumptions included an annual net benefit to the City
of $250,000 and one-time revenues of $4.9 million. A public hearing for the adoption of the
annexation was tentatively scheduled for April 27, 2021.

Ms. Rabin read the ordinance by title.
Ms. Rios said the proposed ordinance would allow staff to execute all necessary documents
and take the necessary actions to issue $260 million of City of Glendale Certificates of
Participation and enter into a ground lease and a lease purchase agreement to provide the
necessary financing to make additional contributions to the Public Safety Pension Retirement
System (PSPRS).
Ms. Rios said the actual interest would be determined by the market when the certificates
were sold. The estimated savings generated by the transaction over the next 17 years would
be $100 million.
Councilmember Turner asked if any additional action by Council would be necessary in the
future.
Ms. Rios said tonight's action was the last formal action that Council would take.
Councilmember Turner said Council had received a list of suggested properties. He asked if
the list was fixed with the adoption of the ordinance.
Mr. Freund said it was not locked in at this point. The properties would be used as collateral
for the financing and the goal was to achieve a higher amount of collateral.
Councilmember Turner asked if there were other City -owned properties being considered that
were not on the list.
Ms. Rios said it took a lot of work to get to the needed dollar amount so all of the properties on
the list were needed. There were no other properties that fit the criteria to be added to the list.
Councilmember Turner said it was a prudent measure to take but was disappointed that
Council had not received more information. He wanted residents to be informed at a pace
that allowed them to process and understand the actions being taken.
Councilmember Tolmachoff asked at what rate of interest would it not be beneficial for the City
to issue the certificates.
Mr. Freund said the ordinance had a maximum rate of 5%. If the rate was anywhere near
that, he would not recommend proceeding. If Council approved the ordinance, the transaction
would be put together, meetings would be held with rating agencies and staff would monitor
the interest rates. Currently, the rate was less than 3%. There were two factors — the interest
rate that was paid and the interest rate that was earned. The City had control over the first
factor. The City would learn the rate earned over time.
Ms. Rios said if the rates became unfavorable, staff would put the transaction on hold.
Councilmember Tolmachoff asked if the action would increase the City's bond rating.
Mr. Freund said the short answer was no. The City would save money so that was a positive.
Councilmember Tolmachoff said Council action would be required on the set aside policy once
the transaction was complete.

Ms. Rios said the estimate for the set aside was approximately $28 million but staff would
work with the rating agencies on the amount. Once established, it would be brought back to
Council as part of the pension funding policy.

Lauren Tolmachoff to adopt Ordinance No. 021-28.
Councilmember Malnar said the action made a lot of sense. He had included information
in his district newsletter and had received positive feedback.

Ms. Chapin said in 1990, a drainage easement was recorded over Lot 4 of the Glendale
Spring Training Complex located at 5216 North Ballpark Boulevard in the City of Phoenix.
Since then, regional drainage infrastructure improvements had been constructed eliminating
the need for drainage facilities to be located in the easement area. There was no need for a
drainage basin or the easement. The City of Phoenix owned Lot 4 and was in the process of
selling it to Camelback Spring Training, LLC. Camelback Spring Training, LLC was willing to
execute a Release of Claims holding the City harmless from any claims associated with the
Release of Drainage Easement. Staff was recommending approval of the ordinance.

could be placed quickly while others would be placed as construction projects moved forward.

Ms. Rabin read the resolution by title.
Mr. Ebersole said the proposed resolution would authorize the City Manager to enter into
development agreements with developers of industrial projects in the West Glendale Service
Area to assess and collect a Street In -Lieu Fee (SILF). The action would address the
extensive growth and rapid rate of development applications in the West Glendale Service
Area. It was necessary and appropriate to collect an in -lieu fee, formally called the Streets
In -Lieu Fee ("SILF") to ensure new growth paid its proportionate share of street infrastructure
improvements.
Mr. Ebersole said the agreement would lock in an equitable rate for each development and
provided an expeditious process. The same rate was utilized in the East Glendale Service
Area for the streets fee. The rate was accepted and uncontested by the development
community and provided the same level of infrastructure improvement for both areas.
