HomeMy WebLinkAboutCity Clerk - Administration and Management Records - Policy & Procedure Records (26) Page 1 of 1 PUBLIC FACILITIES, RECREATION & SPECIAL EVENTS DEPARTMENT POLICY NUMBER 1.36 ENCROACHMENT PROCEDURES 6/3/2009 2/19/2014; 11/25/2020 Section 1 - Administration I. PURPOSE To ensure the department assets are protected from outside encroachment and preserve the parks and facilities of a community. This procedure will provide direction and give detail on the efforts of the division to control and prevent encroachment. II. PROCEDURES Public Facilities, Recreation & Special Events staff are instructed to actively observe lands and facilities for possible encroachment as part of its regular work assignments and report any potential encroachment violations to their supervisor. The supervisor researches encroachment concern through Engineering Mapping Division and/or Information Technology Department GPS mapping. o If a citizen is in the act of a permitted construction, then the project is under the supervision of Building Safety and contact by a Parks and Recreation Division representative to that department will initiate a follow-up visit. In this case, the homeowner has the responsibility to prove to the City that he or she is not encroaching on City property. o If the citizen is building a fence or structure that is less than 6 feet in height and so does not require a permit, or any other construction has already been concluded, then it is a Code Enforcement Department issue and documentation provided to that department will initiate contact with the citizen. In this case, it is the City’s responsibility to prove that the citizen is encroaching on City property. If encroachment is found to be a valid concern, then the Department Director is to be notified and supplied with appropriate documentation. Results of a field assessment are forwarded to the offending party for voluntary compliance by either the Building Safety or Code Compliance Departments. If voluntary compliance is not achieved, the matter is referred to the city attorney’s office for review and guidance by either Building Safety or Code Compliance. If litigation is warranted, that action is managed b y the City Attorney’s Office.
