GLENDALE AVE. GLENDALE, ARIZONA 85301 OCTOBER 28, 2020 9:30 A.M. 1. CALL TO ORDER THE LOCAL POLICE BOARD Chair Charles Erickson called the meeting to order at 9:56 a.m. 2. ROLL CALL Present: City Manager & Board Member Kevin Phelps (by telephone) Board Member & Chair Charles Erickson Police Board Member Justin Harris, Police Officer Absent: Mayor & Board Member Jerry Weiers Police Board Member Cody Carmichael, Police Sergeant Staff Present: Jim Brown, Board Secretary & Director of Human Resources & Risk Mgmt. Vicki Moss, HR Administrator, Benefits Nancy Mangone, Assistant City Attorney Nancy Rodriguez, HR Analyst Charlotte Beadles, HR Specialist, Benefits Lisa Chill, Admin Support Supervisor, HR Other Attendees: Board Attorney Carrie O'Brien Court Reporter Donna Terrell Glendale Police Officer Jarod Behrens 3. CITIZEN COMMENTS There were no citizens present. 4. APPROVAL OF THE MINUTES The Board voted to approve the Public Safety Personnel Retirement System - Local Police Board Minutes of September 23, 2020 Motioned by Board Member Justin Harris, seconded by Board Member Kevin Phelps AYE: Board Member Kevin Phelps Board Member Charles Erickson Board Member Justin Harris Other: Mayor Jerry Weiers (ABSENT) Board Member Cody Carmichael (ABSENT) Passed 5. NEW BUSINESS A. Board Secretary Jim Brown read the pertinent information and the Board reviewed an Application for Retirement from the Deferred Retirement Option Plan (D.R.O.P.) submitted by Andre Anderson, Police Commander. Andre Anderson has elected to retire from the D.R.O.P. and terminate his employment with the Glendale Police Department on November 1, 2020. On November 20, 2019, the Local Police Board had approved his Application for Enrollment into the D.R.O.P. and he had elected to participate on November 30, 2019. He was required to terminate his employment with the City of Glendale Police Department on or before November 30, 2024. Andre Anderson is eligible to retire from the D.R.O.P. and to receive a Lump Sum distribution. The Board voted to approve the application. Mr. Brown read the pertinent information and the Board reviewed the Application for Enrollment into the Deferred Retirement Option Plan (D.R.O.P.) submitted by Travis M. Darby, Police Officer. Travis M. Darby has 22.149 years of credited service. He elected to participate in the D.R.O.P. on October 2, 2020 and must terminate employment with the City of Glendale Police Department on or before October 31, 2025. The Board voted to approve the application. Mr. Brown read the pertinent information from the Application for Survivor's Benefits from the Public Safety Personnel Retirement System (PSPRS) submitted by Josephine Reardon, spouse of deceased Glendale Police Officer, Timothy Reardon. Timothy passed away on September 19, 2020. The Board voted to approve the application. EXECUTIVE SESSION Upon a public majority vote of a quorum of the Local Police Board, the Board may hold an executive session, which will not be open to the public, regarding any item listed on the agenda but only for the following purposes: (i) discussion or consideration of records exempt by law from public inspection (A.R.S. § 38-431.03(A)(2)); (ii) discussion or consultation for legal advice with the Board's attorneys (A.R.S. § 38-431.03(A)(3)); The Board voted to adjourn open session and go into Executive Session in order to review confidential medical records and to receive legal advice from the Board's attorney at 10:02 a.m. Prior to Executive Session discussion began, Police Office Jarod Behrens exited the conference room. During Executive Session the Board reviewed Medical Evaluations for four (4) New Police Personnel: • Kayla Brooke Dallmann • Alexander Paul Exum • Maryn Lyse Ferguson • Cole Elliott Philbrook B. During Executive Session the Board reviewed the Application for Accidental Disability Retirement from the Public Safety Personnel Retirement System (PSPRS) submitted by Jarod Behrens, Police Officer, along with the Independent Medical Examination report from the Medical Board. 7. ADJOURN EXECUTIVE SESSION AND RECONVENE IN OPEN SESSION The Board reconvened in open session at 10:07 a.m. Officer Behrens returned to the conference room. 8. CONSIDERATION AND POSSIBLE VOTE ON EXECUTIVE SESSION ITEMS A. Mr. Brown confirmed that the following new Police Personnel met the standards of the Glendale Police Department and the Arizona Peace Officer Standards and Training Board. The Board voted to accept four (4) New Police Personnel into the Public Safety Personnel Retirement System (PSPRS) with any pre-existing conditions noted: • Kayla Brooke Dallmann • Alexander Paul Exum • Maryn Lyse Ferguson • Cole Elliott Philbrook Motioned by Board Member Justin Harris, seconded by Board Member Kevin Phelps AYE: Board Member Kevin Phelps Board Member Charles Erickson Board Member Justin Harris Other: Mayor Jerry Weiers (ABSENT) Board Member Cody Carmichael (ABSENT) Passed B. Mr. Brown stated that there are 8 (eight) statutory questions that need to be discussed and answered by the Local Board in regard to the Application for Accidental Disability Retirement submitted by Police Officer Jarod Behrens. Chair Erickson asked Mr. Behrens if he wanted to make any comments to the Board. Mr Behrens replied "No, thank you." Mr. Brown read each statutory question and the Board answered each question. 1. Did the employee file the application after the disabling incident, or within one (1) year of ceasing to be an employee? The Board unanimously agreed that the answer is 'yes'. 2. Did, or will, the employee terminate by reason of disability? The Board unanimously agreed that the answer is 'yes.' 3. Did employment terminate based on a disciplinary issue? The Board unanimously agreed that the answer is 'no.' 4. If the member's period of DROP has ended, if applicable, did (or will) the employee terminated by reason of disability? The Board unanimously agreed that the answer is 'not applicable'. 5. Is the employee still working a position within their job classification that the Local Board considers a reasonable range of duties? The Board unanimously agreed that the answer is 'no' because he is on modified duty. 6. Has the employee refused a job within their job classification that the Local Board considers a reasonable range of duties position? The Board unanimously agreed that the answer is 'no'. 7. Did the injury or condition occur prior to the current PSPRS membership date? The Board unanimously agreed that the answer is 'no'. 8. Was the injury or condition the result of an event incurred during the performance of the employee's duty? Board Member Justin Harris answered "no," followed by Board Member Kevin Phelps agreeing. Chair Erickson said, "I don't know." Board Attorney Carrie O'Brien stated that the Board had the option to go back into Executive Session to receive legal advice. The Board voted to adjourn open session and go into Executive Session again in order to receive legal advice at 10:14 a.m. Prior to Executive Session discussion began, Mr. Behrens exited the conference room. Motioned by Board Member Justin Harris, seconded by Board Member Kevin Phelps AYE: Board Member Kevin Phelps Board Member Charles Erickson Board Member Justin Harris Other: Mayor Jerry Weiers (ABSENT) Board Member Cody Carmichael (ABSENT) Passed EXECUTIVE SESSION During Executive Session the Board had further discussion on the Application for Accidental Disability Retirement from the Public Safety Personnel Retirement System (PSPRS) submitted by Jarod Behrens, Police Officer, and consulted with the Board's attorney for legal advice. ADJOURN EXECUTIVE SESSION AND RECONVENE IN OPEN SESSION The Board reconvened in open session at 10:34 a.m. Officer Behrens returned to the conference room. CONSIDERATION AND POSSIBLE VOTE ON EXECUTIVE SESSION ITEM The Board voted to pend and table a vote on the Application for Accidental Disability Retirement submitted by Jarod Behrens pending additional information and questions to be posed to the Independent Medical Examiner. BOARD COMMENTS AND SUGGESTIONS There were no Board comments or suggestions. 10. NEXT MEETING The next regular meeting of the Public Safety Personnel Retirement System Local Police Board will be held on November 18, 2020 at 9:30 a.m., in the HR Training Room, located at 5850 W. Glendale Ave., Glendale, Arizona, 85301. 11.
