AN ORDINANCE OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY,
ARIZONA, REZONING 65.58 ACRES LOCATED AT THE NORTHWEST CORNER OF 99TH
AVENUE AND DESERT RIVER BOULEVARD FROM THE DESERT RIVER PAD (PLANNED
AREA DEVELOPMENT) TO THE DESERT RIVER II PAD (PLANNED AREA DEVELOPMENT)
FOR A DEVELOPMENT PLAN ENTITLED "DESERT RIVER II"; AMENDING THE ZONING

Ms. Bower read the resolution and ordinance by title.
Ms. Collins said the request was for a Minor General Plan Amendment from BP (Business Park)
to EMU (Entertainment Mixed Use) and a zoning change from Desert River PAD to Desert River
II PAD. The property size was 65.58 acres.
Ms. Collins said two parcels were designated as multi -family and the remaining parcels were
office/commercial. She said the PAD proposal would result in a quality development product
which was consistent with the goals and objectives of the General Plan. The mixed use projects
provided urban clusters with housing, retail, restaurants, and integrated transit facilities in the
City.
Ms. Collins said staff found that the request conformed to the standards and recommended
approval subject to the following stipulations:
1. Conformance to the Desert River II PAD dated 09/09/20.
2. As part of the Master Developer Improvements, the powerlines along 99th Avenue shall
be placed underground.
3. The Developer shall work with the City and Salt River Project and Bureau of
Reclamation for required improvements on 99th Avenue in areas designated as USA fee
or easement land.
4. The proposed lift station(s) and force main shall be private, however, the developer shall

ensure the proposed design meets city standards.
5. The developer shall grant and record an avigation easement to the City of Glendale,
Glendale Municipal Airport for the site and incorporate a section within the community
Code Covenants and Restrictions (CC&R's) or residential leases or regulations that clearly
define the airport nuisances, aircraft noise and overflight issues prior to the final approval of
construction documents.
6. Form 7460-1 shall be filed with the Federal Aviation Administration (FAA) and the
development receive a "No Hazard Determination". If temporary equipment used during
construction exceeds the height of the permanent structure, a separate Form 7460-1 shall
be submitted to the FAA and a "No Hazard Determination" obtained prior to the
construction start date.

NEW BUSINESS
31. REAPPOINTMENT OF CITY JUDGE BURKHOLDER
Presented by: Jim Brown, Director of Human Resources & Risk Management
Ms. Bower read the item by title.
Mr. Brown requested Council reappoint City Judge John Burkholder to a four-year term. His
current term expired October 31, 2020. Judge John Burkholder had served as a City Judge in
Glendale since 1995 and was eligible for reappointment to a four-year term. The Judicial
Selection Advisory Board unanimously recommended Judge Burkholder's reappointment based
on the results of his reappointment interview, letters of recommendation received on his behalf,
confidential survey results conducted by a private research firm, and other reappointment
material.
Mayor Weiers administered the oath of office.

Hugh to reappoint Judge Burkholder.

Mr. Brown requested the appointment of Nicholas DiPiazza to a two-year term as presiding
judge. Council had conducted a recruitment for a new presiding judge. Mr. DiPiazza had met
the criteria and qualifications established by Council for appointment.

COUNCIL COMMENTS AND SUGGESTIONS
Councilmember Aldama thanked City staff for the great work everyone did for residents and Council.
Councilmember Clark echoed Councilmember Aldama's comments. She congratulated Judge DiPiazza
on his appointment as presiding judge.

Councilmember Hugh echoed the comments made by the other Councilmembers.
Councilmember Tolmachoff expressed her gratitude for all City staff and all the work done day -after -day.
The workshop presentation was an example of the good work done by staff. She also congratulated
Judge DiPiazza on his appointment.
Councilmember Turner said the workshop presentation had been excellent. He congratulated Judge
DiPiazza and Judge Burkholder on their appointments. Councilmember Turner extended his gratitude to
all City employees for the fine work they did.
Vice Mayor Malnar congratulated Judge DiPiazza and Judge Burkholder on their appointments. He
echoed the sentiments already expressed and especially thanked all the employees working out in the
trenches.
Mayor Weiers thanked his staff members, Kirsten Morgan and Tammy Phillips, and all City employees for
their good work. He thanked Judge Burkholder and Judge DiPiazza for making a difference.
