PUBLIC HEARING - LAND DEVELOPMENT ACTIONS
Mayor Weiers said item 38, Resolution No. R20-121 and Ordinance No. 020-67, would be heard first,
followed by items 36 and 37.
36. RESOLUTION NO. R20-136
A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY,
ARIZONA, AMENDING THE GENERAL PLAN MAP OF THE CITY OF GLENDALE, ARIZONA,
BY APPROVING MAJOR GENERAL PLAN AMENDMENT MGPA20-01 FOR PROPERTY
LOCATED AT 5450 WEST NORTHERN AVENUE.

Ms. Rabin read the resolution by title.
Ms. Collins said her presentation would cover item 36, the Major General Plan Amendment and
item 37, the rezoning request for Trevino at Glen Lakes. The property was located at 5450 West
Northern Avenue and was approximately 42.8 acres in size.
Ms. Collins said the Major General Plan Amendment was a change from POS (Parks and Open
Space) to MDR 5 (Medium Density Residential). The rezoning request was from A-1
(Agricultural) to R1-6 PRD (Planned Residential Development).
Ms. Collins said the proposal provided:
• residential and open space land uses and was consistent with surrounding uses
• a new neighborhood that could encourage other investment in the area
• housing type and site plan that promoted interaction between new and existing
neighborhoods
• infill development to enhance existing neighborhoods
• new development to revitalize a property that was costly to the City
• continuous walking path and public park
• adequate school facilities
• environmental sustainability
Ms. Collins said the proposal was consistent with the development objectives of the General
Plan and was compatible with other existing and planned development in the area. The proposal
met or exceeded the City's subdivision design expectations and would result in a quality living
environment.
Ms. Collins said project amenities included pedestrian trails, bike paths, landscaped areas, entry
features, decorative theme walls, parks, playgrounds and other commonly -owned open space.
The type and quality of house products would be consistent with the intended character of the
development.
Councilmember Turner asked if the 35.8 acres for Northern Horizons Park included the large,
unusable water retention area.
Ms. Collins said it was the whole area.
Councilmember Turner had researched how much had been spent on the Glen Lakes Golf
Course and found that millions had not been spent on the property as some had previously
stated.
Councilmember Turner said the slide depicting the public park area had several areas
designated as lawn and play area. He asked if that also doubled as water retention areas for the
subdivision.
Ms. Collins said that was correct. All parks had some retention areas.
Councilmember Turner asked if it would be maintained by the homeowner's association or the
City.
Ms. Collins said the developer was responsible for construction and the City would maintain the
park.
Councilmember Turner did not recall any recent developments where the City was responsible

for maintaining retention areas.
Councilmember Turner asked if there was a rezoning form that applicants were required to
complete that indicated the relationship to the property. Residents were unable to get copies of
the form.
Ms. Collins said the City required the owner of the property to submit the application. The City
owned the golf course property. It was processed at the request of Council and that was
considered the application.
Councilmember Turner said the Zoning Code required that a rezoning request for R1-6
designation meet one or more specific findings. He did not see the findings in the presentation
and did not believe it met any of the findings to be eligible for R1-6 zoning.
Ms. Collins said the PRD booklet included all of the findings. The project did meet all of the PRD
findings and requirements.
Councilmember Turner asked if the Planning Commission agreed with the findings.
Ms. Collins did not know if they made specific findings but did make a recommendation.
Councilmember Turner said the Planning Commission recommended denial but did not make the
findings. The Code required both the Planning Commission and the Council to make the
findings.
Councilmember Clark said the City purchased the golf course in 1979 for $1,419,113. Since
then, Golf Maintenance Solutions had been paid $120,500 in 2018, $394,537 in 2019 and
$166,691 in 2020. The City had spent $261,634 in maintenance since the course closed. The
total spent since 2018 was $943,569. The City had spent a minimum of $2.5 million. Staff was
unable to provide maintenance costs for Glen Lakes on an annual basis. She estimated another
$1 million had been spent on maintenance over the forty years of ownership.
Councilmember Clark said Glen Lakes was not a course that had been ignored for forty years.
The heyday of attendance for the course was in 2005 when 47,469 rounds of golf were played.
In 2018, it had dropped by 75% to 12,240 rounds of golf played. These were important facts to
consider during deliberation on the items.

Councilmember Tolmachoff said there needed to be lighting in the park for safety reasons.
She asked if an effort would be made to save some of the mature trees.
Councilmember Tolmachoff said the issue had been debated for over two years. She took
no pleasure in casting her vote but it did not make financial sense to have two 9 -hole
municipal courses. There was no other option but to move forward. The project was
supported by the Glendale Chamber of Commerce.
Councilmember Turner said the demise of the course was due to municipal neglect. The
deteriorating condition was responsible for the decline in play. The number of proposed lots
had been increased from less than 100 to 170. The City could afford to restore the property
as a golf course or a park. The estimate to restore it as a park was less than $4 million. It
was a shame. He appreciated the residents who had fought to keep it as open space.
Vice Mayor Malnar said it was not feasible to keep the course open. Residents tonight had
commented on improvements that were needed at other City parks. Council had a
responsibility to upgrade the parks systems. He had concluded that the City needed to
upgrade what it had and turning the entire property into a park was not a wise decision.
There had been concerns expressed about traffic and congestion. Turning it into a
mega -park would create traffic and congestion all days of the week.
Mayor Weiers said the current Council had been strapped with debt. It was incumbent on
the Council to maintain what the City had and move forward.

du/ac) to MDR -5.0 (Medium Density Residential 3.5 -5.0 du/acre) and an ordinance to rezone
from R1-10 PRD (Single Family — Planned Residential Development) to R1-6 PRD (Single

Residence, Planned Residential Development) for a project titled "Palermo" for a 12 -acre
property located at the southeast corner of Northern Avenue and 87th Avenue.
Ms. Collins said the proposal would provide infill development, pedestrian and bicycle
connectivity and was consistent with the policies and objectives of the General Plan. Staff
recommended approval subject to: substantial conformance to the project narrative and PRD
Booklet; placement of an 8 -foot tall decorative masonry wall along Northern Avenue; and
providing proximity to airport information to home buyers. The applicant had also agreed to the
following stipulations:
• East half of 87th Avenue shall be a private roadway
• West half of 87th Avenue shall remain public right-of-way
• Developer and subsequent homeowners' association shall maintain both public
right-of-way and private roadway
• Subdivision shall be gated
• Row of trees shall be planted approximately 20 feet on center along the south property line
north of the SRP easement as approved by the Planning Department
• Lots south of Frier Drive shall have a minimum lot area of 6,500 square feet

39. ORDINANCE NO. 020-73
AN ORDINANCE OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY,
ARIZONA, AUTHORIZING CASH AND APPROPRIATION BALANCE TRANSFERS BETWEEN
BUDGET ITEMS IN THE ADOPTED FISCAL YEAR 2019-2020 BUDGET.

Ms. Camacho was requesting approval of certain Fiscal Year 2019-2020 (FY2019-20) budget
amendments. Total budget appropriation across all funds remained unchanged with the action.
Lines 1-53 of Exhibit A included a transfer of cash of unspent balance of Development Impact
Fees (DIF) collected before January 1, 2012. Arizona Revised Statutes 9-463.05 required the
unspent balance to be distributed equally among the remaining categories of DIF.
Councilmember Clark asked why City departments could not figure out how to spend DIF from
2012 over the past eight years but waited until the fees had to be distributed evenly over all
remaining categories.
Ms. Camacho said there had been a push to spend remaining DIF balances. There were criteria
for spending the funds and some expenditures did not qualify.
Councilmember Turner asked if the funds should have already been transferred.
Ms. Camacho said because FY2020 had not yet been completed, the transfers were being done
after the fourth quarter of the fiscal year.
Councilmember Turner said there was $266,000 in unspent DIF funds for open space and staff
had never asked Council for ideas on how to spend the funds.
Ms. Camacho said the unspent funds were not being lost but were being transferred to the
remaining DIF categories.
Councilmember Turner said the money could have been spent anywhere in the City but was now
being split up into parcels of $38,000 that were not citywide. He asked if there was an option not
to transfer the funds.

Ms. Camacho said the City was required by statute to transfer the funds.
A motion was made by Vice Mayor Ray Malnar, seconded by Councilmember Ian Hugh to
adopt Ordinance No. 020-73.
Councilmember Clark would support the motion only because of the time constraints. She
was surprised the matter had not been brought to Council earlier in the year. The money
was collected in 2012 when Zone West was farmland. Zone West would now benefit from
funds that were supposed to go to 2012 parks and recreation projects. The City had failed to
do an adequate job in handling the DIF funds.
Councilmember Tolmachoff asked what the deadline was for transferring the funds.
Ms. Camacho said the transfer had to be made prior to the DIF audit. She did not know what
would happen if the funds were not transferred prior to the audit.
Mr. Bailey said it was a result of the new DIF statute that provided there was a limited time to
spend the DIF funds. If the fees had not been spent, the fees had to be equitably rolled over
to the new funds. It had to be used for growth -related projects. He was unsure what the
process would be if the funds were not transferred but reimbursement might be required.
Funds had been spent and the amounts being transferred were what was left over.
Councilmember Clark had been searching for funding for Heroes Park and some of the funds
could have been used for that project.
Mr. Phelps said more detailed information would be provided to Council. It was not
uncommon to pool the DIF funds and apply it to a specific project.
Councilmember Turner felt the explanation was unacceptable.
Mayor Weiers said it would have been nice to have spent the funds in a more timely manner
but the funds were not being lost.
Councilmember Tolmachoff requested a future discussion regarding how DIF funds were
spent.

Councilmember Turner said by adopting the changes, it was Council's commitment to keep

COUNCIL COMMENTS AND SUGGESTIONS
Councilmember Aldama said Ocotillo residents could request yard signs to remind drivers to slow down.
Councilmember Aldama said residents who were interested in serving on City boards and commissions
could find information on the City's website or contact the City Clerk's office.
Councilmember Clark said Councilmembers took no pleasure in rezoning Glen Lakes Golf Course, but it
was something that needed to be done. Residents had remarked on the view of the trees and water. It
was not the responsibility of every City taxpayer to maintain residents' views.
Councilmember Clark reminded residents that Glendale's question 1 on the November ballot would
allocate $31,819,400 expressly for infrastructure improvements in all City parks. The City was
developing the bond capacity to maintain and improve existing parks. She encouraged people to vote
yes on question 1.
Councilmember Clark had emailed staff on item 29, striking the concept of "no property tax being leveled
by revitalization districts." She did not understand the response received and would be following up on it.
CITIZEN COMMENTS
James Deibler, Phoenix resident, spoke about issues regarding COVID-19.
Taylor Earl, Phoenix resident, expressed his thanks for Council's work with his late father, Stephen Earl.
Mayor Weiers said Stephen Earl was a joy to work with and always tried to do the right thing for the right
reason. His passing was a massive loss.
