GLENDALE, ARIZONA 85301 JANUARY 27, 2020 5:30 P.M. 1. CALL TO ORDER Chair Roy Whitehead called the meeting to order at 5:30 p.m. 2. ROLL CALL Present: Roy Whitehead, Chair Larry Sandigo, Vice Chair Joshua Conway, Board Member Michael Kielsky, Board Member Magdalena Osborn, Board Member Elizabeth Finn, Presiding Judge, Non -Voting Board Member Absent: Ana Botello, Board Member Andrew Gould, Board Member Also Present: James Gruber, Chief Deputy City Attorney Jenna Goad, Assistant Director, Public Affairs Christopher Phelps, Court Administrator Jim Brown, Human Resources Director Debbie Burson, Human Resources Assistant Director Alyssa Bethel, Human Resources Business Partner Lisa Chill, Human Resources Staff 3. CITIZEN COMMENTS There were no citizens present. 4_ APPROVAL OF THE MINUTES The Board voted to approve the Judicial Selection Advisory Board Minutes of January 15, 2019. OPEN MEETING LAW James Gruber, Chief Deputy City Attorney, provided a brief refresher on Arizona's Open Meeting Law. 6. 2020 CENSUS OUTREACH Jenna Goad, Assistant Director of Public Affairs, gave a brief presentation on the upcoming census. The next census will be conducted on April 1, 2020. Having an accurate count is critical because census figures are used to distribute more than $675 billion dollars in federal funds and each resident counted will equal approximately $3,000 yearly in state, federal, and regional funds for our community. 7. BOARD ORGANIZATION A. Each present Board Member introduced themselves. Maggie Osborn was appointed to the Judicial Selection Advisory Board on January 22, 2019 to fill the vacant seat of the Arizona State Bar Appointee. Her first term expires on January 31, 2022. She is eligible to serve one additional three-year term. Michael Kielsky was appointed to the Judicial Selection Advisory Board on January 22, 2019 to fill the vacant seat of the Maricopa Bar Appointee. His first term expires on January 31, 2022. He is eligible to serve one additional three-year term. Joshua Conway was appointed to the Judicial Selection Advisory Board on January 22, 2019 to fill the vacant seat of the At -Large member for the Barrel district. His initial term expires on January 31, 2021. His subsequent first term will expire January 31, 2024. He is eligible to serve one additional three-year term. Roy Whitehead, Designee of Presiding Judge of Superior Court, was reappointed by Council on January 13, 2020 for a second and final term expiring January 31, 2023. Larry Sandigo's, At -Large member for the Yucca district, first term will expire January 31, 2021. He is eligible to serve one additional three-year term. B. Human Resources Business Partner Alyssa Bethel explained the process required by the JSAB By-laws regarding the Chair and Vice -Chair positions. The Board nominates and votes for their recommendation for both positions, and those recommendations go to the City Council for approval and appointment. Current Chair Whitehead's first term as chair expires on January 31, 2020. He is eligible to serve one additional one-year term. Board members nominated and voted to recommend the re -appointment of current Chair Whitehead as Chair of the Judicial Selection Advisory Board for an additional one-year term from 2/1/2020 through 1/31/2021. Motioned by Board Member Magdalena Osborn, seconded by Vice Chair Larry Sandigo AYE: Chair Roy Whitehead Vice Chair Larry Sandigo Board Member Joshua Conway Board Member Michael Kielsky Board Member Magdalena Osborn Other: Board Member Ana Botello (ABSENT) Board Member Andrew Gould (ABSENT) Passed Per JSAB By -Laws, if the Board selects the chair for a second term on the expiration of that chair's first term, the vice -chair shall remain in office for a second term. The current Vice -Chair Larry Sandigo will continue as vice -chair of the Judicial Selection Advisory Board for an additional one-year term from 2/1/2020 through 1/31/2021. 8. GOAL SETTING AND TOPICS OF DISCUSSION FOR THE UPCOMING YEAR A Board and Commission Policy effective 5/7/2019 requires that each board discuss and approve its goals, topics of discussion, and/or issues it would like to consider for the upcoming year. The Board discussed and voted to adopt the following goals for the Judicial Selection Advisory Board for 2020: The Board will make recommendations to City Council regarding appointments or re -appointments to the positions of Glendale Presiding Judge and City Judge. The Board will review investigative materials, survey results and other background information to assess qualifications of candidates for appointment and reappointment. The Board will seek and encourage qualified individuals to apply for these positions in the event of a vacancy. STAFF REPORT Alyssa Bethel, Human Resources Business Partner, updated the Board with the anticipated timeline of what to expect in the coming year. The next reappointment for the Board to consider will be City Judge John Burkholder whose term expires October 31, 2020, and Judges Finn and Delgado whose terms expire in March 2021. The Board would typically meet in July or August, then again in January 2021. She also explained that in the event of a vacancy, a recruitment process would be needed. This process would require at least two additional meeting dates; one to review applicants and decide who to interview, and another to interview selected applicants. JSAB recommends 3 to Council, at which point Council can request additional information and/or new candidates. Ms. Bethel also provided a reminder from the JSAB Bylaws on how the board uses surveys in the reappointment process. Because responses to surveys is voluntary, they do not scientifically measure a judge's performance and are only used as one piece of information in a larger picture. Ms. Bethel provided dates for the upcoming Boards and Commissions Coyotes Game on March 18, 2020 and Boards and Commissions Dinner on March 19, 2020. Judge Finn gave an update on how survey recipient information would be collected on the court side. She also indicated she would not be seeking reappointment and would be retiring soon, but did not have a firm date yet. 10. BOARD COMMENTS AND SUGGESTIONS Board Member Kielsky requested an item be added to the next agenda: Discussion on appointment of Presiding Judge. 11. NEXT MEETING The Judicial Selection Advisory Board will tentatively meet in July or August 2020 at 5:30 p.m., in the Council Chambers, located at 5850 W. Glendale Ave., Glendale, Arizona, 85301. 12.
