GLENDALE, ARIZONA 85301 THURSDAY, JULY 16th, 2020 2:00 PM CALL TO ORDER The meeting was called to order at 2 PM. ROLL CALL Committee members present: Chairperson Joyce Clark, Vice Mayor Ray Malnar, Councilmember Lauren Tolmachoff, Vice Chairperson Bart Shea, Dale Adams, John Crow, Yvonne Knaack, and Ricardo Toris. Committee members absent: N/A City staff present: Lisa Collins (Interim Development Services Director) and Shannon Beck (Council Assistant) were present. CITIZEN COMMENTS There were no citizens present, so Chairperson Clark did not call for citizen comments. APPROVAL OF THE MINUTES A motion to approve the meeting minutes (with Mr. Toris' last name correction) from June 18th, 2020, was made by Mr. Toris, and it was seconded by Ms. Knaack. All were in favor, and none opposed. ITEMS a. Presentation review by Matthew Klyszeiko and Adam Pruett from Michael Baker International regarding the code rewrite. Mr. Klyszeiko began with starting on page 16 of the annotated outline, and Chairperson Clark noted of an issue in the first paragraph. It says some cities have taken a position that the Planning Commission has the ultimate authority to approve or deny a conditional use permit. Other cities have varying perspectives on this. Mr. Adams noted that having an ultimate, absolute authority might not be best for the community rather than having guidelines. Mr. Toris agreed with Mr. Adams by saying it's about the process and timing. Ms. Collins added in her employment with another city, there were different types of permits; each type was approved differently where there was some structure, but certain use in another district may be more open- ended for conditions to be added based on the area. Vice Mayor Malnar asked to clarify the difference between a variance and a conditional use permit. Ms. Collins explained a variance is when someone realizes "I cannot build on my property using the zoning ordinances, whereas a use permit is always something in the ordinance that's listed as a potential use, but it's conditionally permitted. Councilmember Tolmachoff brought up her own specific instance of a variance of what the zoning allowed, but it was brought to the Board of Adjustment anyway. The board passed it, but Councilmember Tolmachoff asked who determines where variances and conditional use permits are routed. Ms. Collins explained Development Services or Planning Administrator should determine the proper course of action for each case. Ms. Knaack then asked Mr. Klyszeiko what could be improved in Glendale that will make it more business -friendly but still following the guidelines. Mr. Klyszeiko noted it would be better to add elements to make it more of an administrative process as opposed to having them go through the conditional use permit process. Chairperson Clark asked how this fits in with neighborhoods. Mr. Klyszeiko noted this would be an area where the committee would need to evaluate whether or not it could be permitted with conditions. Chairperson Clark continued with page 16 and had a question about the "Zoning Districts and Boundaries." Chairperson Clark noted that Rl5 and R13 districts approved by city council, but neither are legal within the code. Ms. Collins explained the details of the code would need to be reviewed, but since Stonehaven is PAD, it acts as its own zoning district. Chairperson Clark asked for comments on "Article V: Zoning District Regulations," but there were none. Chairperson Clark asked for comments on page 17, but the one comment was Mr. Toris commending the ease of accessibility of the document thus far. Chairperson Clark asked for the supplemental use regulations on page 18, and there were no comments. Chairperson Clark began to discuss page 19 and asked for careful care and consideration with the diction and syntax of that section for the community. On page 20, Chairperson Clark agreed with the last sentence of the first paragraph and noted that developers have taken advantage of the concept of a PAD to include what may not actually be present in a PAD. Page 21 deals with General Development Standards, and Chairperson Clark had a comment asking for incorporating how to deal with the 303 loop. In the "landscaping, buffering, and walls" section, and Chairperson Clark requested explaining when 8 -foot walls would be appropriate. Vice Mayor Malnar asked about the medical marijuana facilities in section 7.800 in an effort to clarify the definition of what a school would be (ex: preschools) and the proximity to dispensaries. The council settled on having an understanding of precluded restrictions, but including the preschools would be wise. Ms. Collins said considering whether the location's "primary use" was for education would determine whether or not the location would be considered a school. While examining page 22, Ms. Knaack requested to make the note that Chairperson Clark and Vice Mayor Malnar are all on the code committee and have addressed much of these items. Chairperson Clark asked for comments on page 23, and there were none until later. Vice Mayor Malnar brought this up later and asked about the specific language used in the meaning of sexual oriented type businesses. Ms. Collins said they will look into this. In regards to page 24, Mr. Klyszeiko explained this is a perfect example of why a unified code enhancement is needed. Chairperson Clark explained one of the areas lacking in the downtown area is a unified look that characterizes the area as downtown. In addition, Chairperson Clark asked if it is an HOA's responsibility to enforce street parking, and it would depend on the parking areas specifically. Mr. Toris stated there was some statewide parking legislation enforcement with HOAs, but he was unsure about the details. 2 On page 25, Chairperson Clark asked about the final sentence on the page. It says there should be a Dedication and Exactions Appeal Officer for the city, and Ms. Collins made a note to look into this as well. Page 26 covers Chapter 29.1: Residential Rental Property and Chapter 31: subdivisions. Chairperson Clark asked who would be responsible for remediation when a tenant property is cited. Mr. Crow stated the owner is responsible. Page 27 deals with the summary, and there were no comments. Page 28 is proposed final outline for the new city code, and there were no comments. Page 29 is the continuation of the outline, and Mr. Toris asked if the city intends to create new zoning districts for residences? Ms. Collins explained it was the intention to keep the districts but review the development standards to ensure they're appropriately outlined and zoned. Page 30 is a continuation of the outline. Mr. Toris wondered if a public zoning district would be included and where it would be included. Ms. Collins said there isn't a category for this group at this point, but it is a good opportunity to do this. Chairperson Clark suggested calling it a "public purpose district." On page 31, Chairperson Clark suggested including the 303 loop as an overlay district. Mr. Toris asked if the zoning overlays with asterisks are something to go out the public to discuss? Mr. Klyszeiko said it would be a public process to get feedback from the community. Ms. Knaack asked about Article III's supplementary use standards and how this would affect hookah lounges. Mr. Klyszeiko explained if something would need to be added to the supplementary use standards list, it should be brought up now. Tobacco businesses (hookah and vape), tattoo shops, payday loans, were all suggested as additions. It is important to list these types of businesses, so there is ultimately some business variety within all areas of the city. On page 32, the accessory buildings and temporary use is discussed here. Chairperson Clark asked for more temporary use items to list. Seasonal sales and special events (like Glendale Glitters) were added. Outdoor lighting was touched on by Chairperson Clark because she was unsure if the city has a dark sky ordinance. Ms. Collins stated there isn't a dark sky ordinance for Glendale. Article V and VI are on subdivisions and administration. Chairperson Clark expressed concern that clarification is needed for the roles of the planning director and zoning administrator. Ms. Collins confirmed that adjustments will be made accordingly. Page 33 details zoning procedures. Chairperson Clark expressed hope for the procedures to be easier for the development community once this section is finalized. Chairperson Clark asked if there was anything anyone wished to ask the consultant. They are finalizing the residential parking consideration at that time, and then permitted uses and developing standards will be finalized the September meeting with the first module. Chairperson Clark suggested the committee forego the August meeting. OTHER BUSINESS No other business was discussed. STAFF REPORT No staff reports were discussed. COMMITTEE COMMENTS AND SUGGESTIONS There were no committee comments or suggestions made. 3 NEXT MEETING The next regular meeting of the Business Council Committee will be held on September 17th, 2020, ADJOURNMENT Chairperson Clark made a motion to adjourn the meeting.
