3. CITIZEN COMMENTS
Alisa Lyons with Valley Partnership sent in a comment to be read. "On behalf of
Valley Partnership and its 350 Company Partners and almost 2,000 Members
advocating for responsible development throughout Maricopa County, I want to
thank the City for working on this important project. As we do in so many other
cities in the Valley, Valley Partnership plans to be engaged in discussing the
draft language the consultant brings forward. We are committed to working
closely with staff and will bring constructive feedback to the process. We look
forward to helping create a Code that allows developers to bring quality projects
to market, driving new tax revenue in support of the Glendale community."

5. ITEMS FOR DISCUSSION AND POSSIBLE ACTION
a. Code Consultant update and discussion with possible voting action
Matt Klyszeiko, consultant at Michael Baker International, stated there is a
project website which is the clearing house of all information relative to the
zoning code update. There is also a survey that Glendale residents can take to
give their input and will be open for the life of the project. All upcoming events
will be posted here as well. The website address is: zoneglendaleaz.com.
Mr. Klyszeiko gave a PowerPoint presentation regarding the following residential
parking sections of the code re -write. 1.1.2 Special Parking Requirements -1.
Single Residence Dwellings - Required Parking and Driveway Placement and
Size: For lots less than 12,000 square feet in area and for lots 12,000 square
feet or more in area. 2. Vehicle Parking and Storage. 3. Recreational Vehicle
Parking and Storage. 1.1.1 Standards for Specific Accessory Buildings,
Structures and Uses. He spoke in depth about the subject and provided
example photos and diagrams.
There was a lengthy discussion among the committee members and the code
consultant regarding the presentation.
Member Socaciu asked about cul-de-sac driveways and stated that they are not
mentioned in the document. He asked if the 30' maximum that a driveway can
be starts at the street or the house? His concern is that these driveways are not
the same size from the street to the home. He also asked what the difference is
between the lots that are over 12,000 square feet and under 12,000 square
feet. He stated that some lots are not a normal lot shape as some are pie
shaped. He stated this should be addressed. He asked for a few diagrams that
include cul-de-sac lots. Mr. Klyszeiko answered that this a continuous width
which is a 30' maximum. The only nuance is some lots that have a front facing
garage and then a one car side entry garage, this would be an exception. Mr.
Klyszeiko stated that they will look further into the percentages on the lots and
they will provide the graphics of the cul-de-sac lots in the future.
Member Wilfong asked what a maneuvering area is. Mr. Klyszeiko answered
that the definition is that portion of the lot that is an improved dust free surface
used by vehicles for access circulation in loading and unloading. Member
Wilfong stated that he is concerned that someone may park on a rock yard
because this is an approved surface. Mr. Klyszeiko stated that he will circle
back to this comment later. Member Wilfong stated that they would like to
emphasize legal driveways and not approved driveways. Mr. Wilfong would like
the portion of the code that states that courtyards, hardscape, walkways and
patios shall not be parked on to be more specific.
Councilmember Turner asked for clarification regarding accessory parking
spaces that are usually on the side of the driveway, do they need to be
contiguous to the driveway? Mr. Klyszeiko said that the two parking areas will
need to be separated to minimize the visual impact of a large area of pavement.
The intent is to break up the monolithic pavement and have a strip in there that
can support landscaping so there is not a streetscape of large parking areas.
This is not retroactive. Councilmember Turner asked to clarify — if there is a 30'
wide driveway and then you can have additional parking area, as along as it is
separated by a planting area, you can have additional parking? Mr. Klyszeiko
said there can be additional pavement up to the 40-50% max depending on
what size the lot is.
Councilmember Clark stated that she feels the language in the proposed code is
confusing and said that this should be as simple and clear as possible to be
understood by all Glendale residents. She would like the residents to be able to
consult with the Planning Department for anything different than what is
referenced in a standard parking schematic. She says something simple and
standardized should be written.
Mr. Klyszeiko went on to speak about the parking and storage portion of the
discussion. He read from the draft code and referenced to the graphics provided
for this section.
Member Socaciu asked how to differentiate between crushed rock, aggregate
rock, and landscape crushed rock that is found in most front yards. Mr.
Klyszeiko stated that boarders are required to distinguish between the
landscaped area and the maneuvering material.
Vice Mayor Malnar asked about the example of the parking areas and asked if
they are over limiting the residents of Glendale in this ordinance as far as not
being able to park on an approved surface if the vehicles are drivable? Allowing
parking on some of these areas may be something for the committee to
consider. He said they do not want to see commercial vehicles and RVs and
non -running vehicles parked on these spaces.
Councilmember Turner asked if there is a way to break down the vehicle weights
to address some personal vehicles that may be up to 14,000 lbs. Assistant
Police Chief LeVander suggested the use of pictures to show what can be
parked on the driveway. Mr. Klyszeiko said they will take another look at this.
Mr. Klyszeiko spoke about the storage of a vehicle on the residential lot. He
stated that enforcing time limits on storage can be a challenge, so they applied a
definition to the word "storage" to help with this. The definition states: For the
purposes of this ordinance, references to vehicle storage shall not be
determined based on duration, but rather on the negative effects commonly
associated with prolonged parking and/or abandonment. A vehicle shall be
deemed stored if any of the following effects exist: accumulation of spiderwebs,
dirt and debris, flat tires, damaged or missing body parts, or broken or unusable
windows. Vehicles placed on blocks or similar devices where all or part of the
vehicle is not touching the ground shall be considered inoperable. Member
Wilfong stated that the list is missing unlicensed or unregistered vehicles. Mr.
Klyszeiko said this can be added if the committee feels it should be. Vice Mayor
Malnar suggested that the definition should include: The vehicle storage shall
not solely be determined based on duration.
Mr. Klyszeiko spoke about item j. "Utility trailers shall only be parked or stored in
a garage or on a dustproof surface within a side yard or rear yard area located
behind a solid six (6) foot tall wall, fence or gate, or landscaping. No utility trailer
parking or storage is allowed in the front yard or unscreened, street side yard."
He gave the alternative wording as: "Where access to a screened side or rear
yard is not feasible, one (1) utility trailer may be parked or stored in a front yard
on an approved dustproof surface that meets all other parking and storage
requirements. Unenclosed utility trailers parked or stored in an unscreened front
yard shall be empty, excluding ancillary equipment utilized in association with an
active trade, during any period in which the trailer is parked or stored." Member
Socaciu stated that storage of utility trailers should be in the side or backyard.
Member Wilfong asked about the size of the trailer and if this will be addressed.
Mr. Klyszeiko said this will be addressed. Vice Mayor Malnar said they should
take into consideration small business owners and one trailer should be allowed.
Mr. Klyszeiko read from section 3. Recreational Vehicles Parking and Storage.
There was discussion among the committee members and the consultant
regarding this item. Member Wilfong stated that he feels this wording is not
acceptable. Councilmember Turner wanted clarification regarding what would
be allowed regarding the alternative language. Would the recreational vehicle
be allowed in the front yard in front of the driveway or carport as long as it is less
than 30'-40' if they do not have access to the back or side yard but it wouldn't be
allowed on the opposite side of the front yard if they may have a maneuvering
surface? Mr. Klyszeiko stated that this should be clarified. Member Socaciu
and Councilmember Turner both feel that storage of these vehicles should be in
the rear or side yards or off site at a storage facility. Vice Mayor Malnar stated
that he disagrees and feels that this would not be fair to the homeowners who
may have purchased these larger lots for the purpose of storing a small RV on
their property. This may be too stringent.
Mr. Klyszeiko read from section item 131 regarding inoperable vehicles. He
stated that this section is not just talking about residential parking. This is why
there is a secondary provision that says " This subsection shall not apply to a
principal use of a property where the storage, repair or restoration of inoperable
vehicles and similar equipment is customary and incidental to the principal use;
provided however, the principal use is operated in accordance with all other
provisions of this Code." He wanted to clarify that this deals with residential
areas, but it also deals with the larger code as well.
Vice Mayor Malnar thanked Mr. Klyszeiko for the work that has been done so
far. He stated that he would like each subcommittee to take a section of the
codes spoken about and come back with their findings.
The Miscellaneous subcommittee will look at the recreation vehicle parking
section, the Residential subcommittee will look into the utility vehicles portion,
the Commercial subcommittee will look into the inoperable vehicles portion of
the code, and the Parking subcommittee will look at the special parking areas.

The next regular meeting of the Code Review Council Committee will be held
on June 25, 2020 at 5:00 p.m., in conference room B3, located at 5850 West
Glendale Avenue, Glendale, Arizona, 85301.

1.1.2 Special Parking Requirements
A. Single Residence Dwellings
1. Required Parking and Driveway Placement and Size
a. Parking spaces for single residence dwellings, as required
in Section 7.403, may be located anywhere on a
residential lot, provided all other applicable requirements
of Section 1. 1.2 are met. The placement of enclosed or
covered parking areas within required setback areas is
prohibited.
b. Required spaces for all single residence dwellings shall at
a minimum measure nine (9) feet wide by twenty (20) feet
deep with no obstructions and each space shall be
independently accessible.
c. All residential lots shall provide a dustproof driveway
between a public street or private drive and all required
parking spaces. If access to a public street is provided via
an alley, the alley and driveway shall be a dustproof
surface.

d. For lots less than 12,000 square feet in area,
i) no more than 50% of the portion of a property that is
located on the street side of an approved solid wall,
fence, or gate may be improved with a dustproof
driveway, parking, or maneuvering area. Where such
screening does not exist, the identified front yard shall
serve as the basis for calculating the permitted driveway,
parking, or maneuvering area. For corner lots, the
identified front yard shall also be used to calculate the
maximum, permitted dustproof driveway, parking, and
maneuvering area, however, the calculated maximum
area may be allocated across both front and street side
yards. Areas specifically devoted to hardscape elements,
such as walkways, courtyards or patios shall not be
considered as part of the maximum dustproof driveway,
parking, and maneuvering area; and
ii) the maximum, continuous width of any driveway, parking,
or maneuvering area shall not exceed thirty (30) feet,
however, this width may be expanded to accommodate
side entry garages.

All vehicles shall be parked, stored or maneuvered on a dustproof surface such as
concrete, pavers, asphalt, or crushed rock or aggregate that is a minimum of three
inches thick. All crushed rock or aggregate shall be contained by a permanent border.
Permanent borders for asphalt surfaces are recommended. All dustproof surfaces shall
be maintained and kept free from weeds, grass, or other vegetative growth.
Vehicle parking, storage or maneuvering in landscaped areas shall be prohibited.
Vehicle parking in a front yard or unscreened side yard shall only be permitted
a dustproof driveway that leads to a garage, carport, or required parking spaces; or
a dustproof surface that is contiguous to or is separated by a plantable landscape
strip, that is more than three (3) feet but less than ten (10) feet wide, from said
driveway. Contiguous shall include semi -circular driveways or similar
configurations; or
corner lots with legal nonconforming driveways that are less than twenty (20) feet in
length and lead to a garage or carport, may utilize a dustproof surface located on
the secondary frontage for vehicle parking, provided said area meets all other
requirements of this zoning code.

d. Parked vehicles shall at no time overhang into or obstruct any portion of a public
sidewalk or alleyway.
e. Within the front yard, all vehicles shall be parked at least one (1) foot from the
side property line.
f. Parking or storing any personal vehicle having a gross vehicle weight rating
(GVWR) exceeding ten thousand (10,000) pounds shall be prohibited, except:

h. Any vehicle stored on a residential lot shall be owned or
leased by the owner or occupant of the principal use of the
property.
i. Vehicles shall only be stored in a garage or on a dustproof
surface within a side yard or rear yard area located behind

No vehicle storage is allowed in the front yard or
unscreened, street side yard.

3. Recreational Vehicle Parking and Storage
a. The parking or storage of recreational vehicles including campers, travel
trailers, motor homes, or boats and personal watercrafts is permitted on
any residential lot subject to the following:
i) Such equipment shall be parked or stored in a garage or on a
dustproof surface within a side yard or rear yard area located behind
a solid six (6) foot tall wall, fence or gate, or landscaping, except lots
in the Rural Residential (RR) zoning districts shall be exempt from
this screening requirement;
ii) Such equipment shall not exceed forty (40) feet in length, eight (8)
feet in width, and ten (10) feet in height unless parked or stored in a
garage, in which case shall have no maximum size; and
iii) Such equipment shall be parked or stored so as to maintain a
minimum 3 -foot clearance on at least one side yard for emergency
access.
Alternatively
iv) Where access to a screened side or rear yard is not feasible, one
(1) recreational vehicle with a GVWR of not more than eight
thousand (8,000) pounds may be parked or stored in a front yard on
an approved dustproof surface that meets all other parking and
storage requirements.

b. Temporary parking of recreational vehicles that exceed
the size limitations stated above in a front yard or side
yard, driveway or maneuvering area is permitted for
load inglunloading or repairs for no more than seventy-two
(72) hours within 7 consecutive days. The Zoning
Administrator may authorize a longer period of time if an
emergency exists, up to a maximum of five (5) days.
c. Recreational vehicles shall be prohibited for human
occupancy as a permanent residence. Any temporary
occupancy shall be required to obtain a temporary
occupancy permit from the Development Services
Department.
d. Recreational vehicles shall not be used for storage of
goods, materials, or equipment other than those items
considered to be a part of the recreational vehicle or
essential for its use as a recreational vehicle.

B. Inoperable Vehicles
1. Any personal vehicle, commercial vehicle, recreational
vehicle and/or similar equipment which is inoperable,
including any vehicle or equipment being repaired or
restored shall only be parked or stored in an enclosed
structure, garage, carport, or on a dustproof surface
within a side or rear yard area located behind a solid
six (6) foot tall wall, fence or gate, or landscaping.
2. This subsection shall not apply to a principal use of a
property where the storage, repair or restoration of
inoperable vehicles and similar equipment is
customary, and incidental to the principal use;
provided however, the principal use is operated in
accordance with ail other provisions of this Code.

1. Within any residential district, no person shall dismantle, repair,
restore or otherwise perform any work on any vehicle, machine,
motor, or similar device not owned or leased by the owner or
occupant of the property. In addition, any work performed beyond
basic maintenance (tune-ups, service of fluids, replacement of
minor parts) shall be:
a. Incidental to a permitted use and completely within a garage
or carport, or conducted on a dustproof surface that is wholly
enclosed from view of surrounding properties and rights-of-
way by a solid six foot (6'0") tall wall, fence or gate, or
landscape barrier;
b. limited to no more than three (3) vehicles repaired during any
calendar year; and
c. limited to work being performed on no more than one (1)

City Code 24-65: Sale, storage and repair of vehicles and 25-22: Vehicles.
(a) No person shall park or permit to be parked any vehicle for the purpose of
sale upon any public street or private property including vacant property except
where the sale of a vehicle is customary and incidental to the principal use of
the property and in accordance with the Zoning Ordinance of the City of
Glendale, Arizona, except as follows:
(1) The display of one (1) vehicle for sale is permitted at a residence when
the vehicle is titled to the owner or occupant of the property, is parked on
an improved parking surface on the property and is not being sold in
connection with an automobile sales business.
(2) No more than three (3) vehicles may be displayed for sale at the same
residence within a calendar year and only one (1) vehicle shall be displayed
for sale at one (1) time.
(b) No person shall park or permit to be parked any vehicle, including but not
limited to semi -tractors, semi -tractor trailers, or limousines on any property or
vacant property except where the parking of such vehicles is customary and
incidental to the principal use of the property and in accordance with the
Zoning Ordinance of the City of Glendale, Arizona.
(c) Vehicle covers placed on any vehicle that is visible from any public street or
sidewalk must be properly maintained and made exclusively for covering
vehicles. A proper cover does not include bed linen, paper, cardboard, plastic
sheeting, tarps or any other item or material not manufactured specifically as a
vehicle cover. The use of a vehicle cover on any abandoned or inoperable
vehicle as defined in this subsection is limited to a vehicle that is stored in a
carport.
(d) The unsheltered storage of any abandoned or inoperable vehicle,
including any vehicle being repaired or restored, that is visible from any
public street or sidewalk is prohibited except where the storage, repair or
restoration is customary and incidental to the principal use of the property
and in accordance with the Zoning Ordinance of the City of Glendale,
Arizona.
(e) An abandoned or inoperable vehicle, including any vehicle being repaired
or restored, may be stored in a carport if the vehicle is covered with a
properly maintained vehicle cover made exclusively for covering vehicles as
described in this section.
(f) Within any residentially zoned district, any vehicle undergoing repair
must be titled to the owner or occupant of the property. No more than
three (3) vehicles shall be repaired during any calendar year. Vehicle repair
work shall be performed on no more than one (1) vehicle at one (1) time.
(g) Within any residentially zoned district, no person shall park or store any
vehicle such as but not limited to watercraft, camper shell, truck camper, or
utility trailer in any portion of the side yard unless screened from the street
or the surface area is improved with gravel, concrete, asphalt or paving
bricks.
(h) No person shall leave, place or park any abandoned vehicle or inoperable
vehicle upon any public street, alleyway, parking lot or other city property.
(i) Within any residentially zoned district, no person shall park or permit to
be parked any vehicle within a front yard area except in accordance with the
Zoning Ordinance of the City of Glendale, Arizona.
(j) A violation of any paragraph in this section shall constitute
a misdemeanor punishable by a fine of not less than one
hundred dollars ($100.00)
