BIDS AND CONTRACTS
36. AWARD RFP 20-07 AND AUTHORIZATION TO ENTER INTO A PROFESSIONAL SERVICES
AGREEMENT WITH CREDIT MANAGEMENT GROUP, LLC FOR THE DOWNTOWN HOLIDAY
LIGHTS DISPLAY

Ms. Rabin read the item by title.
Chad Shimek, Custom Holiday Lights, LLC, had submitted a bid on the holiday lights proposal.
He said the bid process was flawed.
Aubree Denekemp, Custom Holiday Lights, LLC, had requested the scoring information on the
bids. References were 20% of the score but the company's references were not checked. She
said the calculations were incorrect and two of the panel members had indicated a relationship
with the other bidder.
Mr. Shimek did not know how references could be scored if the references were not checked.
He asked that the bids be reevaluated by a different panel.
Councilmember Tolmachoff was troubled by the information provided and did not think the item
could be moved forward.
Ms. Camacho said the request for proposals (RFP) had received two responses - Credit
Management Group, LLC and Custom Holiday Lights, LLC. Custom Holiday Lights had
protested the notice of award and a hearing was held. The hearing officer determined the basis
of the protest did not change the outcome of the RFP.
Ms. Camacho said the RFP did not state that the references would be checked. The references
were based on the information submitted by the vendors regarding experience. The most
responsive bidder was moving forward.
Councilmember Aldama asked that the item be tabled until the matter could be looked into
further. There were too many questions to proceed.
A motion was made by Councilmember Joyce Clark, seconded by Councilmember Jamie
Aldama, to table the award of RFP 20-07.
Mayor Weiers asked the consequences of tabling the matter since Council would not meet
again until August.
Mr. Phelps said installation generally began in August so it could have a negative impact.
He recommended that the City Attorney's Office review the process.
Councilmember Tolmachoff was not willing to move forward.
Mr. Bailey said the Code provided that in the event of a discrepancy, there was an
opportunity to appeal. The City Attorney's Office relied on the appeal process. His office
could review the process. He asked who was the hearing officer.
Ms. Camacho said she was the hearing officer. The City Attorney's Office did represent the
City. The basis of the protest was the scoring of the references. The information about the
panel member having a relationship with the successful bidder was not included in the
protest.
Councilmember Aldama asked if references were a significant amount of the total points
awarded.
Mr. Bailey recommended that the item be continued but said there could be an impact to the
cost and timing if delayed.

Councilmember Aldama said it was a matter of the City's integrity and should be looked into.
Ms. Camacho said references accounted for 20% of the points.
Councilmember Tolmachoff did not understand why the references were not checked.
Ms. Camacho said the RFP did not require the references to be checked. Points were
awarded based on the proof of experience provided by the vendors. No references were
checked.
Councilmember Clark did not think the department head was the appropriate person to be
the hearing officer and asked that the practice be reviewed.
Mr. Phelps asked for clear direction on what Council wanted reviewed. The relationship
indicated was based on the fact that the panelists had worked with the vendor on the holiday
lights in the past.
Councilmember Clark wanted the process reviewed and a determination be made if it should
be rebid.
Mr. Phelps said supplies had to be ordered in advance. If it was rebid, it could impact the
timing of the installation of the lights.
Councilmember Aldama said the successful bidder had 20 years of experience and had
perfected the process. He was willing to have no holiday lights this year if the process was
wrong.
Councilmember Tolmachoff supported the City Attorney's Office investigating the matter.
Councilmember Clark was more comfortable if the process was investigated by the City
Attorney's Office.
Councilmember Turner asked if the vendor received all of the reference points.
Ms. Camacho said the successful vendor received 200 points for references and Custom
Holiday Lights, LLC received 117 points. Even if the entire 200 points had been awarded,
the outcome would not have changed.
Councilmember Turner was willing to wait until August so that the City Attorney's Office could
look into the matter.

warehousing.

Ms. Collins said the traffic analysis would include recommendations regarding signals.

Ms. Collins said the request was to rezone approximately 340.22 acres from RR -45 (Rural) and
M-1 (Light Industrial) to PAD (Planned Area Development). The land use assumptions for the
property were 4 million square feet of light industrial. The blended net average annual fiscal
impact was $860,000. One-time revenues were $15.8 million. The proposed amendment was
consistent with the General Plan.
Ms. Collins said the developer would:
• provide right-of-way along Glendale Avenue, Bethany Home Road and Sarival Road
• comply with City standards
• construct half street improvements
• construct the Myrtle, Ocotillo, Maryland and Claremont extensions as private roadways

rezone approximately 9.49 acres from A-1 (Agricultural) to M-1 (Light Industrial) to permit the
development of a truck and trailer parking lot. The General Plan designated the property as
Business Park and the proposed use was consistent with the designation.
Ms. Collins said the applicant had provided 2 options for the site. Option A would propose
access to the site from New River Road. Option B would provide access to the site from the
north, possibly Orangewood Avenue or through the existing Conair site to the north.
Ms. Collins said the proposed zoning change was consistent with the General Plan and was
compatible with other existing land uses. A Design Review application was required for each
parcel within 18 months.

Ms. Collins said the Minor General Plan Amendments would reduce the area for residential
development and increase the area for industrial uses. The PAD (Planned Area Development)
was proposed for the entire property. The requests were as followed:
• GPA20-04 — Minor General Plan Amendment on 117 acres from LDR1-2.5 to LI (Light
Industrial)
• GPA20-05 — Minor General Plan Amendment on 250 acres from LDR 1-2.5 to MDR 2.5-3.5
• ZON20-06 — Rezone RU -43 to PAD for a master -planned community/employment center
(all 865 acres)
Ms. Collins said the proposal was compatible with the development that was taking place on
adjacent properties in the County. After neighborhood meetings, the residential site plan
proposed a total of 760 lots, a reduction of 24 lots from the original proposal.
Ms. Collins said the proposed amendments were consistent with the General Plan and were
compatible with other existing and planned development in the area. The Planning Commission,
at its June 4th meeting, recommended approval of ZON20-06 and GPA20-04 and denial of
GPA20-05.
Councilmember Tolmachoff had concerns regarding the streets in the residential portion of the
development. She had been told the roads would be gated but had learned that only portions
would be gated. She was fine with that as long as all of the roads were private. Councilmember
Tolmachoff did not believe it would have a negative impact on the property values of the existing
neighborhoods. She was concerned about who would be responsible for maintaining the roads.
Jason Morris, Withey Morris, applicant representative, said there had been a discussion about
the applicability of a private street network. Roughly half of the entire community had been
designed to accommodate gated private streets. The eastern lots would not accommodate

gated private streets. The applicant had committed $50 million for roadway investments and
construction. It would be a net benefit for the City.
Councilmember Tolmachoff asked for clarification regarding the gated and non -gated portions of
the residential development.
Mr. Morris said there was a collector road that divided the residential community in half. The half
with the larger lots that were adjacent to Russell Ranch would be gated. All of the gates would
be in the interior of the development off of the collector road. There would be only a handful of
lots that would side -on to Citrus Road. There would also be a significant landscaped buffer from
the road to the community wall.
Councilmember Turner said the neighborhoods to the east of the collector road could be private
without being gated. He said when the roads needed to be resurfaced in 7 to 10 years, who
would be responsible for the expense. He did not want existing residents to have to subsidize
the development and wanted all of the residential streets to be private.
Councilmember Clark asked what was the annual estimated revenue for the project.
Ms. Collins said it was $1.9 - $2 million.
Councilmember Clark said some of the revenue could be dedicated to cover future road
maintenance.
Mr. Friedline said it would be difficult to estimate the funding needed for road remediation
because there were many factors. The first 7 -year cycle would be relatively inexpensive.
Councilmember Tolmachoff asked if the assumptions for the annual net benefit estimate were
based on 30% of the industrial development employees would live and shop in Glendale.
Ms. Collins said that was correct.
Councilmember Tolmachoff was not comfortable with the estimate. The decisions being made
could have long term financial impacts for the City.
Vice Mayor Malnar said the project included industrial and residential and it had to be looked at
holistically. There would be sufficient resources and the residents would have opportunity to
shop in Glendale. He did not believe it would be a burden to the rest of the City.

residential development in Glendale that had private streets thrust upon them. It was a
dangerous precedent. Two-thirds of the property would be revenue -generating. There was
also a potential for sales tax being generated in the industrial portion.
Councilmember Turner said there were neighborhoods throughout Glendale with private
streets that were maintained by the homeowners' association. It was not unusual.
Councilmember Hugh was not in favor of requiring private streets. Requiring residents to
pay for the maintenance of their roads was a bad precedent to set.

Councilmember Turner said the presentation had indicated the roads of the residential
neighborhoods to the west of the collector road were designed to be gated. He asked if that
was a zoning stipulation.
Mr. Morris said it was designed to be gated. The residents and the developer had the option
to gate or not gate the communities.
A motion was made by Councilmember Bart Turner, seconded by Councilmember Lauren
Tolmachoff, to amend the motion to add a stipulation to require the neighborhoods west of
the collector road to be private roads whether or not the roads were gated.
Vice Mayor Malnar asked if the final plat would come before Council.
Ms. Collins said the preliminary plat would go to the Planning Commission and the final plat
would go to Council.
Vice Mayor Malnar asked if Council could request that it be a gated community.
Ms. Collins said the final plat was an engineering document and Council would not be able to
request gating at that point.
Vice Mayor Malnar asked if Council could deny the plat if it did not contain gated streets.
Mr. Bailey said the approval of a plat was a ministerial act by Council. If the criteria set by
Code was met, Council would not be able to add criteria.
Councilmember Tolmachoff said there had been concerns about creating a residential City
island in the area and gating the community would alleviate those concerns. She was told
the applicant had agreed to gate the community. Council was now being told that the
applicant might gate part of the community. She was disappointed that all of the information
was not provided up front.
Councilmember Aldama was not comfortable with gating a portion of the community. He
asked how many homes would be included in the gated portion.
Mr. Morris said gating the community should be left to the builder of the homes who would be
in the best position to determine the value of gating the community. The applicant was not
backing away from the privatization of the streets on the western portion which was less than
half of the community or 238 lots.
Councilmember Clark did not agree that it would be a residential island. There was
residential development near the project. It was a different type of project but it would add
value to the area.
Councilmember Aldama was not comfortable with splitting the community.

Councilmember Turner was not comfortable with residents of the Barrel District paying to
pave the roads when there was virtually no predictable tax revenue from the project.

understand why any Councilmember would vote no on the amendment.
Mayor Weiers said the applicant had agreed to the private streets and gating neighborhoods
would add variety and value.

Ms. Collins said the property was located at the northwest corner of Bethany Home Road and the
Loop 303. The request was to rezone 161 acres from A-1 (Agricultural) to PAD (Planned Area

Compatible Land Uses.

Ms. Collins said the plan included 47 acres of commercial, 94 acres of industrial and 19.5 acres
of flex. The annual net benefit was estimated to be $2.5 million and one-time revenues of $11.2

Councilmember Clark would be adding a fifth stipulation:
A truck stop would be permitted in the Cotton Properties PAD with the following conditions:
A. Only one truck stop use shall be allowed on the Cotton Properties PAD revised June 8, 2020
consisting of 161 acres.
B. If a truck stop use is developed within the Cotton Properties development, it shall be located
within in the 22.53 -acre parcel immediately adjacent to the Loop 303 on Bethany Home Road
identified as "commercial' on the "character plan" submitted as part of the PAD.
C. Signage prohibiting truck traffic west of Cotton Lane shall be installed in accordance with the
City of Glendale Transportation Department regulations.
D. All lighting shall be in accordance with Codes and Ordinances with additional security lighting
to be provided in accordance with best practices as determined by the Glendale Police
Department at the time of site plan approval.
E. Video surveillance cameras with access available to the Glendale Police Department shall be
installed to provide visual access to the entire site.
F. If a truck stop is constructed prior to the development on the adjoining parcel to the west, an
8 -foot screen wall shall be constructed during the first phase of the truck stop site development.
G. A "signed" office space within the truck stop shall be made available to the Glendale Police
Department, the Maricopa County Sheriffs Office, the Department of Public Safety and the
Goodyear Police Department.
H. Onsite security officers shall be provided by the truck stop if determined necessary by the
Glendale Police Chief.

Bill Lally, Tiffany & Bosco, applicant representative, said 21 million square feet of industrial use
had been approved during the meeting by Council. The location was appropriate to serve future
and existing trucking uses. It was adjacent to the Loop 303 and was not across the street from
residential. There was a buffer of 1,300 to 1,400 hundred feet. The truck stop would be located
on the other side of existing industrial development.
Mr. Lally said idling trucks would not be an issue because truckers used auxiliary power when
idling. There were stipulations that addressed almost every single issue that had been raised
especially regarding crime prevention. The applicant agreed to all of the stipulations.

Councilmember Tolmachoff asked if there was a policy that would address the concern
regarding teenagers loitering on the property.
Mr. Lally believed the stipulations for video enforcement and a police substation would prevent
loitering by teenagers.
Alex Fuller, Love's Travel Stops representative, said the parking lots would be signed for 1 -hour
parking. Employees were also trained to address loitering.
Councilmember Clark asked why the location had been chosen.
Mr. Fuller said 5,000 trucks traveled the Loop 303 every day. The existing and future industrial
development was also a factor.
Councilmember Tolmachoff said the speakers had made good points, but the Loop 303 had
been part of the Maricopa County Regional Transportation Plan since 1985. Commerce
developed around a freeway and that was what was happening. She was comfortable with the
stipulations and hoped that the residents realized progress had been made.
Vice Mayor Malnar had concerns about the Love's Truck Stop at the proposed location and was
not in support. He supported the industrial and commercial development moving forward.
Councilmember Turner said it was no surprise that the uses around the Loop 303 would be
truck -oriented uses. The uses and zoning being requested were in compliance with the City's
General Plan. Neighbors could and had influenced the uses. The stipulations specifically
addressed the concerns raised by the neighbors and would set the bar for future truck stops.
Councilmember Clark did not believe the truck stop would be a magnet for teenagers. Council
had decided that the Loop 303 corridor would be an employment center for the City. All
freeways had adjacent intense industrial and commercial uses. It was unrealistic to assume that
there would not be intense development which would include a safe place for trucks to stop.
A motion was made by Councilmember Joyce Clark, seconded by Councilmember Bart
Turner, to adopt Ordinance No. 020-44 with all five stipulations.
Vice Mayor Malnar understood what Council was trying to accomplish and appreciated the
stipulations. He challenged Love's to make it the best truck stop in the country.
Mayor Weiers had logged over a million miles driving a semi -truck and understood the
issues. He had previously lived across the street from a truck stop and had experienced
traffic issues. He had used the truck stop and had not experienced the problems speakers
had discussed. Truck drivers were required to stop and if drivers did not have a place to
stop, the trucks would park in the area. Growth was coming. There was no way to stop it,
only to control it.

Mr. Johnson said at its May 28, 2019 meeting, Council passed Ordinance No. 019-49 which
related to the fees associated with Backflow Prevention and Pretreatment Compliance
Inspection. The intent was to eliminate certain annual fees for the backflow and pretreatment
programs, effective June 27, 2019. The backflow program fee language in Section 33-98 was
eliminated as intended. However, the Grease Bearing Waste Discharger Fee remained in
Appendix 1 and Appendix B, and the Backflow Prevention Annual Processing Fee remained in
Appendix B in error. The proposed ordinance would correct the error and any fees collected as
a result of the error would be credited back to the affected customer account.

59. RESOLUTION NO. R20-87
A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY,
ARIZONA, AUTHORIZING THE CITY MANAGER TO EXECUTE A LICENSE AGREEMENT
FOR WIRED TELECOMMUNICATION SERVICE IN THE CITY OF GLENDALE
RIGHT-OF-WAY WITH CROWN CASTLE FIBER LLC.

Ms. Rabin read the resolution by title.
Mr. Bessler said the proposed resolution would authorize the City Manager to execute a license
agreement between the City and Crown Castle Fiber LLC, (Crown Castle) for the placement of
an underground fiber -based communications network within public rights-of-way. Crown Castle
had an existing license agreement with the City and had requested a new agreement that would
authorize it to expand the existing network. It would allow Crown Castle to meet current and
future clients' connection needs and the growing demand for fiber optic telecommunications
service including cable, telephone and internet.
Councilmember Tolmachoff thought there was a moratorium on digging up streets that had
recently been repaired.
Mr. Bessler said the City did not have a moratorium on pavement cutting in Code. It was
something that staff was reviewing. There were 16 different dry utilities that used the public
rights-of-way and it was a huge challenge. Staff would be holding a utility summit as soon as
possible and review the City's 5 -year capital improvement plan.
Mayor Weiers suggested micro -trenching as an option.
Councilmember Turner said there had been discusion about the City being proactive about
installing conduit.
Mr. Bessler said sleeves had been placed in the ground during the construction of Ballpark
Boulevard.

ARIZONA, DESIGNATING THE CITY'S CHIEF FINANCIAL OFFICER FOR OFFICIALLY
SUBMITTING THE FISCAL YEAR 2020 EXPENDITURE LIMITATION REPORT TO THE
ARIZONA AUDITOR GENERAL.

A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY,
ARIZONA, AUTHORIZING AND DIRECTING THE ENTERING INTO OF A GRANT
AGREEMENT (ERMT-20-043) WITH THE STATE OF ARIZONA OFFICE OF THE GOVERNOR
FOR ACCEPTANCE AND EXPENDITURE OF THE AZCARES FUND PROGRAM GRANT IN
THE APPROXIMATE AMOUNT OF $28,974,995.

Ms. Camacho said the resolution authorized the City Manager to accept funding in the amount of
$28,974,995 from the U.S. Department of the Treasury Coronavirus Aid, Relief, and Economic
Security (CARES) Act: Coronavirus Relief Fund.
A motion was made by Councilmember Bart Turner, seconded by Councilmember Joyce
Clark, to adopt Resolution No. R20-89.
Vice Mayor Malnar appreciated the funding from the federal government to overcome the
effects of the coronavirus pandemic. He urged staff to continue to work with the Governor's
Office to see if there would be another round of funding for the City. It had to be spent by the
end of the calendar year.

AID, RELIEF AND ECONOMIC SECURITY ACT (CARES ACT) IN THE APPROXIMATE
AMOUNT OF $339,943.

agreement (IGA) with Maricopa County to accept up to $339,943 in Coronavirus Aid, Relief and

associated with a rent/mortgage Financial Assistance Program.

COUNCIL COMMENTS AND SUGGESTIONS
Councilmember Clark was holding a virtual District meeting on Thursday, June 25 at 6:30 p.m.
Councilmember Turner said item 58 had been pulled because Council had reached consensus at the
workshop to raise fines for the illegal use of fireworks. The fine increase could be accomplished
administratively and did not require formal Council action.
Councilmember Turner thanked Civic Center staff for its assistance with accommodating the Council
meetings at the Civic Center.
Mayor Weiers said he and his wife would be celebrating 38 years of marriage on Thursday.
