GLENDALE AVE. GLENDALE, ARIZONA 85301 JANUARY 22, 2020 9:30 A.M. 1. CALL TO ORDER THE LOCAL POLICE BOARD Chair Charles Erickson called the meeting to order at 9:35 a.m. 2. ROLL CALL Present: City Manager & Board Member Kevin Phelps Board Member & Chair Charles Erickson Board Member Cody Carmichael, Police Officer Board Member Justin Harris, Police Officer Absent: Mayor Jerry Weiers Staff Present: Jim Brown, Board Secretary & Director of Human Resources & Risk Mgmt. Kurt Christianson, Assistant City Attorney Charlotte Beadles, HR Specialist, Benefits Lisa Chill, Admin Support Supervisor, HR Other Attendees: Board Attorney Carrie O'Brien Matthew Schneider, Glendale Police Officer Jeannette Schneider, wife of Matthew Schneider Judith Abramsohn, Attorney for Matthew Schneider 3. CITIZEN COMMENTS There were no citizen comments. 4. APPROVAL OF THE MINUTES The Board approved the Public Safety Personnel Retirement System Local Police Board Minutes of December 18, 2019. Motioned by City Manager & Board Member Kevin Phelps, seconded by Board Member Cody Carmichael AYE: Board Member Cody Carmichael Chair & Board Member Charles Erickson Board Member Justin Harris City Manager & Board Member Kevin Phelps Other: Mayor & Board Member Jerry Weiers (ABSENT) Passed 5. NEW BUSINESS A. Board Secretary Jim Brown read the pertinent information from the application and the Board reviewed the Application for Normal Retirement from the Public Safety Personnel Retirement System (PSPRS) submitted by Wence Arevalo, Police Sergeant. Wence Arevalo has completed 24.386 years of credited service. He retired on December 18, 2019. He had been a member of the Glendale Police Department since July 31, 1995. The Board voted to approve the application. Motioned by Board Member Justin Harris, seconded by Board Member Cody Carmichael AYE: Board Member Cody Carmichael Chair & Board Member Charles Erickson Board Member Justin Harris City Manager & Board Member Kevin Phelps Other: Mayor & Board Member Jerry Weiers (ABSENT) Passed - B. Mr. Brown read the pertinent information and the Board reviewed the Application for Enrollment into the Deferred Retirement Option Plan (D.R.O.P.) submitted by Timothy R. Newman, Police Officer. Timothy R. Newman has 25.079 years of credited service. He elected to participate in the D.R.O.P. on January 2, 2020 and must terminate employment with the City of Glendale Police Department on or before January 31, 2025. The Board voted to approve the application. Motioned by Board Member Justin Harris, seconded by Board Member Cody Carmichael AYE: Board Member Cody Carmichael Chair & Board Member Charles Erickson Board Member Justin Harris City Manager & Board Member Kevin Phelps Other: Mayor & Board Member Jerry Weiers (ABSENT) Passed C. Mr. Brown read the pertinent information and the Board reviewed the Application for Enrollment into the Deferred Retirement Option Plan (D.R.O.P.) submitted by Ronald R. Swanson, Police Sergeant. Ronald R. Swanson has 29.214 years of credited service. He has elected to participate in the D.R.O.P. on February 12, 2020 and must terminate employment with the City of Glendale Police Department on or before February 28, 2025. The Board voted to approve the application. Motioned by Board Member Justin Harris, seconded by Board Member Cody Carmichael AYE: Board Member Cody Carmichael Chair & Board Member Charles Erickson Board Member Justin Harris City Manager & Board Member Kevin Phelps Other: Mayor & Board Member Jerry Weiers (ABSENT) Passed D. Mr. Brown stated that Larry A. Dallmann is a retired Glendale Police Officer. He retired from the City of Glendale on December 31, 2016. Mr. Dallmann was hired by the City of Glendale as a Temporary Police Property Evidence Clerk on January 7, 2020. The Board was provided with the job description. Mr. Brown advised the Board that according to Arizona Revised Statutes (A.R.S.) Section 38-849, there are three (3) questions that the Board must answer: 1. Did Mr. Dallmann become reemployed in any capacity by the City of Glendale before one year after his date of retirement? The Board unanimously declared 'No' to this question. 2. Is Mr. Dallmann assigned voluntary duties acting as a limited authority peace officer, pursuant to the Arizona peace officer standards and training board rules? The Board unanimously declared 'No' to this question. 3. Was Mr. Dallmann reemployed in the same position from which he retired as a Police Officer? The Board unanimously declared 'No' to this question. E. Mr. Brown stated that the Application for Accidental Disability Retirement from the Public Safety Personnel Retirement System (PSPRS) and the medical records submitted by Aaron Aldridge, Police Sergeant, would be reviewed by the Board during Executive Session. F. Mr. Brown stated that the Application for Accidental Disability Retirement from the Public Safety Personnel Retirement System (PSPRS) and the medical records submitted by Matthew Schneider, Police Officer, would be reviewed by the Board during Executive Session. Chair Erickson stated that the Board would not be voting on either application until after Executive Session. Judith Abramsohn, Attorney for Matthew Schneider, asked that her client and his wife be allowed to address the Board during Executive Session. After some discussion, Board Attorney Carrie O'Brien recommended that the Board conduct separate Executive Sessions to allow for the applications and medical records to be discussed separately and to allow for Matthew and Jeannette Schneider, accompanied by their attorney, to address the Board during Executive Session. 6. EXECUTIVE SESSION Upon a public majority vote of a quorum of the Local Police Board, the Board may hold an executive session, which will not be open to the public, regarding any item listed on the agenda but only for the following purposes: (i) discussion or consideration of records exempt by law from public inspection (A.R.S. § 38-431.03(A)(2)); (ii) discussion or consultation for legal advice with the Board's attorneys (A.R.S. § 38-431.03(A)(3)); The Board voted to adjourn open session and go into Executive Session in order to receive legal advice from their attorney and to review the Application for Accidental Disability Retirement from the Public Safety Personnel Retirement System (PSPRS) and medical records submitted by Aaron Aldridge, Police Sergeant. Motioned by Board Member Cody Carmichael, seconded by Board Member Justin Harris AYE: Board Member Cody Carmichael Chair & Board Member Charles Erickson Board Member Justin Harris City Manager & Board Member Kevin Phelps Other: Mayor & Board Member Jerry Weiers (ABSENT) Passed All attendees except for Board Members, Board staff and Board Attorney left the room during the time that the Board met in Executive Session. After Executive Session, all other attendees were invited back into the conference room. 7. ADJOURN EXECUTIVE SESSION AND RECONVENE IN OPEN SESSION 8. CONSIDERATION AND POSSIBLE VOTE ON EXECUTIVE SESSION ITEMS The Board acknowledged that Police Sergeant Aaron Aldridge has filed an Application for Accidental Disability Retirement from the Public Safety Personnel Retirement System (PSPRS). The Board voted to order an Independent Medical Examination. Motioned by City Manager & Board Member Kevin Phelps, seconded by Board Member Cody Carmichael AYE: Board Member Cody Carmichael Chair & Board Member Charles Erickson Board Member Justin Harris City Manager & Board Member Kevin Phelps Other: Mayor & Board Member Jerry Weiers (ABSENT) Passed 9. Mrs. Schneider addressed the Board. Mr. Schneider addressed the Board. Mr. and Mrs. Schneider, along with Ms. Abramsohn, left the room to allow the Board to continue in Executive Session in order to review the Application for Disability Retirement and medical records submitted by Matthew Schneider and to receive advice from the Board's attorney. After Executive Session, all other attendees were invited back into the conference room. 10. ADJOURN EXECUTIVE SESSION AND RECONVENE IN OPEN SESSION 11. CONSIDERATION AND POSSIBLE VOTE ON EXECUTIVE SESSION ITEMS The Board acknowledged that Police Officer Matthew Schneider has filed an Application for Accidental Disability Retirement from the Public Safety Personnel Retirement System (PSPRS). BOARD COMMENTS AND SUGGESTIONS There were no Board comments or suggestions. 13. NEXT MEETING The next regular meeting of the Public Safety Personnel Retirement System Local Police Board will be held on February 26, 2020 at 9:30 a.m., in the 4th Floor Conference Room, located at 5850 W. Glendale Ave., Glendale, Arizona, 85301. 14. ADJOURN THE LOCAL POLICE BOARD MEETING Chair Erickson adjourned the meeting at 10:31 a.m. The Public Safety Personnel Retirement System Local Police Board meeting minutes of January 22, 2020 were submitted and approved this 26th day of February, 2020.
