The regular meeting was called to order at approximately 7:00 p.m. by Vice-Chairperson Carl Dietzman, with the following members and representatives present: BOARDMEMBERS PRESENT: Carl Dietzman, Vice-Chairperson Tommie Beck George Giarrusso David Iwanski Carol Marx Michael Schroth BOARDMEMBERS ABSENT: Douglas Ward, Chairperson CITY STAFF: Ray Jacobs, Zoning Administrator Jim Flenner, City Attorney John Fukasawa, Associate Planner Sally Millward, Recording Secretary Vice-Chairperson Dietzman explained the Board's policies and hearing procedures. Vice-Chairperson Dietzman called for approval of the March 13, 2003 minutes. Boardmember Iwanski made a MOTION to APPROVE the minutes from the March 13, 2003 meeting. Boardmember Schroth SECONDED the MOTION. The motion PASSED by a vote of 6-0. Vice-Chairperson Dietzman called for Business from the Floor. There was none. Vice-Chairperson Dietzman asked staff if there were any requests for withdrawals or continuances. There were none. Vice-Chairperson Dietzman called for public hearing items. April 10, 2003 Board of Adjustment Page 2 APPLICATION NO.: VAR-03-02 REQUEST: A request by Lucchesi Construction for Harley and Deanna Hembd to allow a 12-foot, 6-inch side yard setback where a 15-foot side yard setback is required in the SR-17 (Suburban Residential) zoning district. The property is located at 7618 West John Cabot Road. Staff Contact: John Fukasawa (Cholla District). Mr. Fukasawa presented the application, reviewing the site and request. Boardmember Iwanski asked if the other properties' reduced setbacks were the result of a Board action. Mr. Fukasawa stated there were no other variances on record. He said they were most likely the result of the previous zoning ordinance's smaller setbacks. Boardmember Schroth asked about the height of the garage. Harry Lucchesi, applicant's representative, stated the elevation of the garage matches that of the house. Boardmember Beck asked if the oversized vehicle mentioned in the applicant's letter refers to a bus. Mr. Lucchesi responded no, explaining the oversized vehicles are large, extended-cab pick- up trucks. Vice-Chairperson Dietzman opened the meeting up for public comment on this case. As no comments were made, he closed the public hearing. Boardmember Beck asked when the house was constructed. Mr. Lucchesi estimated the house was built in the early 1970's. Mr. Jacobs clarified the subdivision was approved in the county in 1977. The house may have been constructed soon after that date. Boardmember Iwanski made a MOTION to APPROVE VAR-03-02 as recommended by staff. Boardmember Beck SECONDED the MOTION. Vice-Chairperson Dietzman opened the floor to discussion. Boardmember Giarrusso commented the owner has made every effort to accommodate his vehicles without impacting surrounding neighbors. Boardmember Marx urged the applicant to ensure the garage and house are aesthetically pleasing. No further comments were made. Vice-Chairperson Dietzman called for a Roll Call Vote. The property is located at 6701 North 51st Drive. Staff Contact: John Fukasawa (Ocotillo District). APPLICATION NO.: VAR-03-04 REQUEST: A request by Habitat for Humanity to allow 4-foot side yard setbacks where 5 and 10-foot side yard setbacks are required in the R1-6 (Single Residence) zoning district. The property is located at 6713 North 51st Drive. Staff Contact: John Fukasawa (Ocotillo District). APPLICATION NO.: VAR-03-05 REQUEST: A request by Habitat for Humanity to allow 4-foot side yard setbacks where 5 and 10-foot side yard setbacks are required in the R1-6 (Single Residence) zoning district. The property is located at 6736 North 51st Drive. Staff Contact: John Fukasawa (Ocotillo District). Mr. Fukasawa presented applications VAR-03-03, VAR-03-04, and VAR-03-05, reviewing the sites and requests. Mr. Jacobs pointed out, unlike typical Habitat for Humanity requests, these requests call for the garages to be adjacent to the homes, resulting in the need for reduced side- yard setbacks. Heidi Kimzey, applicant's representative, offered to answer questions. Vice-Chairperson Dietzman opened the meeting up for public comment on this case. As no comments were made, he closed the public hearing. Boardmember Beck made a MOTION to APPROVE VAR-03-03 with stipulation as recommended by staff. Boardmember Marx SECONDED the MOTION. The property is located at 6738 North 55th Drive. Staff Contact: John Fukasawa (Ocotillo District). APPLICATION NO.: VAR-03-08 REQUEST: A request by Habitat for Humanity to allow 5 and 10-foot side yard setbacks where a 20-foot perimeter setback is required in the R3 (Multiple Residence) zoning district. The property is located at 6730 North 55th Drive. Staff Contact: John Fukasawa (Ocotillo District). Mr. Fukasawa presented applications VAR-03-06, VAR-03-07, and VAR-03-08, reviewing the sites and requests. Boardmember Giarrusso asked if the C-3 property located behind the property in Application VAR-03-06 will interfere with access. Mr. Fukasawa responded no, explaining, while the property is zoned C-3, it appears to be developed as a residential structure. Heidi Kimzey, applicant's representative, offered to answer questions. Vice-Chairperson Dietzman called for the Planning Staff Report. Mr. Jacobs welcomed Commissioner Schroth to the Board. Mr. Jacobs noted the May 8 meeting might be cancelled. Vice-Chairperson Dietzman called for Board Comments and Suggestions. No comments were made.
