The regular meeting was called to order at approximately 7:00 p.m. by Vice-Chairperson Carl Dietzman, with the following members and representatives present: BOARDMEMBERS PRESENT: Tommie Beck Carl Dietzman, Vice-Chairperson David Iwanski Carol Marx Richard Schwartz George Giarusso BOARDMEMBERS ABSENT: Douglas Ward, Chairperson CITY STAFF: Ray Jacobs, Zoning Administrator Tamika Cheatham, Assistant City Attorney John Fukasawa, Associate Planner Tabitha Perry, Associate Planner Sally Millward, Recording Secretary Vice Chairperson Dietzman explained the Board's policies and hearing procedures. Vice Chairperson Dietzman called for approval of the October 10, 2002 minutes. Boardmember Schwartz made a MOTION to APPROVE the minutes from the October 10, 2002 meeting. Boardmember Marx SECONDED the MOTION. The motion PASSED by a vote of 6-0. Vice Chairperson Dietzman called for Business from the Floor. Mr. Mel Smith, P.O. Box 12572, Glendale, stated he appeared before the Board on a previous request and was voted down by a three to two vote. He said he then appealed to the City Council who reversed the Board's decision. He stated he was fortunate enough to have some knowledge of the system and the means to follow through with an appeal, unlike some of the citizens who November 14, 2002 Board of Adjustment Page 2 appear before the Board. He offered to meet with the Board members in an effort to make the Board better and to ensure that all citizens receive a fair hearing. Vice Chairperson Dietzman asked staff if there were any requests for withdrawals or continuances. There were none. Vice Chairperson Dietzman called for public hearing items. APPLICATION NO.: ZV-02-12 REQUEST: A request by Mr. Daniel Torkhan to allow side yard setbacks of 35 feet and 37 feet where 50 feet is the minimum required and a lot coverage of 15% where 10% is the maximum allowed in the A-1 (Agricultural) zoning district. The property is located at 6107 West Greenbriar Drive. Staff Contact: Tabitha Perry (Cholla District). Ms. Perry presented the application, reviewing the site and request. In response to Boardmember Beck's question, Ms. Perry explained the existing setbacks are legal non-conforming and the applicant is required to obtain the variance before he can apply for a permit to build an addition. Boardmember Giarusso asked if other property owners in the immediate area would be required to apply for a variance. Ms. Perry responded yes. Mr. Torkhan approached the podium and offered to answer questions. Vice Chairperson Dietzman opened the meeting up for public comment on this case. As no comments were made, he closed the public hearing portion of the case. Boardmember Giarusso made a MOTION to APPROVE ZV-02-12, subject to the stipulations recommended by staff. Boardmember Iwanski SECONDED the MOTION. Vice Chairperson Dietzman opened the floor to discussion. No further comments were made. Vice Chairperson Dietzman called for a Roll Call Vote. The MOTION PASSED by a vote of 6 to 0. Vice Chairperson Dietzman stated anyone wishing to appeal the Board's decision on this item may do so by contacting the Planning Department within 15 calendar days of the date of this action. November 14, 2002 Board of Adjustment Page 3 APPLICATION NO.: ZV-02-20 REQUEST: A request by Jairo Giraldo to allow 10-foot 6-inch side yard setbacks where a 20-foot perimeter setback is required in the R-4 (Multiple Residence) zoning district. The property is located at 6138 West Glenn Drive. Staff Contact: John Fukasawa (Ocotillo District). Mr. Fukasawa presented the application, reviewing the site and request. Antonio Padilla, applicant, offered to answer the Board's questions. Boardmember Dietzman asked Mr. Padilla if he would live in the house. Mr. Padilla responded he would with his family. He confirmed the house would have three bedrooms. Vice Chairperson Dietzman opened the meeting up for public comment on this case. As no comments were made, he closed the public hearing portion of the case. Boardmember Iwanski made a MOTION to APPROVE ZV-02-20. Boardmember Schwartz SECONDED the MOTION. Vice Chairperson Dietzman opened the floor to discussion. Boardmember Marx voiced her full support of the application. No further comments were made. Vice Chairperson Dietzman called for a Roll Call Vote. The MOTION PASSED by a vote of 6 to 0. Vice Chairperson Dietzman stated anyone wishing to appeal the Board's decision on this item may do so by contacting the Planning Department within 15 calendar days of the date of this action. APPLICATION NO.: ZV-02-21 REQUEST: A request by Los Vecinos Housing Development to allow 7-foot and 6-foot 3-inch side yard setbacks where a 20- foot perimeter setback is required in the R-3 (Multiple Residence) zoning district. The property is located at 6825 North 60th Avenue. Staff Contact: John Fukasawa (Ocotillo District). Mr. Fukasawa presented the application, reviewing the site and request. Boardmember Giarusso asked if another zoning would be more appropriate and eliminate the need for variances. Mr. Fukasawa said another single family residence zoning district with November 14, 2002 Board of Adjustment Page 4 smaller side yard setback requirements could eliminate the need for a variance. He pointed out most of the lots in the area are 50 feet wide and that almost any development would require a variance from the 20-foot setback requirement. Mr. Jacobs noted the Commission did not approve a request to rezone the area to R1-6 approximately three years ago. Boardmember Schwartz suggested they require five and nine foot setbacks, pointing out it would allow for 15 feet of separation between the two homes. He said continuing with similar setbacks throughout the neighborhood would result in 15 feet of separation between all homes. Boardmember Dietzman asked if approval of the variance would allow the applicant to build two structures on the lot. Mr. Fukasawa explained, while the property meets the minimum square footage requirements for two units, other multi-housing requirements would not be met. Mr. Jacobs pointed out the Board could include a stipulation restricting the property to the site plan. Mike Fitz, applicant's representative, assured the Board that only one house would be built on the lot and that the house would be owned by a family. Boardmember Giarusso asked if Los Vecinos uses local laborers. Mr. Fitz responded yes. Vice Chairperson Dietzman opened the meeting up for public comment on this case. As no comments were made, he closed the public hearing portion of the case. Boardmember Beck made a MOTION to APPROVE ZV-02-21, subject to staff's stipulation. Boardmember Giarusso SECONDED the MOTION. Vice Chairperson Dietzman opened the floor to discussion. No further comments were made. Vice Chairperson Dietzman called for a Roll Call Vote. The MOTION PASSED by a vote of 6 to 0. Vice Chairperson Dietzman stated anyone wishing to appeal the Board's decision on this item may do so by contacting the Planning Department within 15 calendar days of the date of this action. Vice Chairperson Dietzman called for the Planning Staff Report. No report was given. Vice Chairperson Dietzman called for Board Comments and Suggestions. No comments were made.
