The regular meeting was called to order at approximately 7:00 p.m. by the Chairperson, Doug Ward, with the following members and representatives present: BOARDMEMBERS PRESENT: Douglas Ward, Chairperson Tommie Beck Carl Dietzman, Vice-chairperson David Iwanski Carol Marx Richard Schwartz George Giarusso BOARDMEMBERS ABSENT: None CITY STAFF: Ray Jacobs, Zoning Administrator Jim Flenner,Deputy City Attorney Tabitha Perry, Associate Planner Sally Millward, Recording Secretary Chairperson Ward explained the Board's policies and hearing procedures. Chairperson Ward called for approval of the July 11, 2002 minutes. Vice-chairperson Dietzman made a MOTION to APPROVE the minutes from the July 11, 2002 meeting. Boardmember Schwartz SECONDED the MOTION. The motion PASSED by a vote of 7-0. Chairperson Ward called for Business from the Floor. There was none. Chairperson Ward asked staff if there were any requests for withdrawals or continuances. There were none. September 12, 2002 Board of Adjustment Page 2 Chairperson Ward explained four out of the seven members present have to vote in the affirmative for a motion to pass. Chairperson Ward called for public hearing items. APPLICATION NO.: ZV-02-18 REQUEST: A variance request by James Parkin to reduce the side yard setback to 5 feet where 15 feet is required in the SR- 17 (Suburban Residence) zoning district. The property is located at 7026 West Wagoner Road. Staff Contact: Tabitha Perry (Sahuaro District). Ms. Perry presented the application, reviewing the site and request. Boardmember Giarusso asked if there are restrictions on the driveway setbacks. Mr. Jacobs responded no. Boardmember Ward asked if the applicant's request represents the minimum necessary to add both additions. He said it appears the additions could be located in other areas on the property and still fall within the zoning. Ms. Perry explained the applicant originally intended to locate the additions in the back, however, it would have required a two-part variance. Mr. Jacobs agreed other options are available, stating, however, the proposed variance represents a satisfactory solution. Boardmember Beck asked if other houses in the neighborhood have five foot setbacks. Ms. Perry answered no, however, several 10-foot setback variances have been approved. Jim Parkin, applicant, stated, while they considered various locations for the additions, locating them elsewhere would have required removing the pool. He distributed booklets, stating more than 20 homes in the neighborhood have setbacks of 10 feet or less. Boardmember Beck asked when most of the homes in the area were built. Mr. Parkin stated, according to the prior homeowner, his house was the second home built in the subdivision. He said the rest of the homes were built after 1976. In response to Chairperson Ward's question, Mr. Parkin indicated where the neighbors who wrote letters in support of, or in opposition to, his request live. Ms. Perry noted the subdivision was annexed in 1979 and the side yard setbacks were in place at that time. Mr. Jacobs stated there are a variety of setbacks in the area because of different zoning requirements at various times. Boardmember Giarusso asked if the neighbor to the east has any problem with the overhang on the structure. Mr. Parkin explained the two foot overhang is in character with the house, September 12, 2002 Board of Adjustment Page 3 however, he would be willing to adjust the overhang if necessary. Mr. Jacobs pointed out the five foot setback is measured to the face of the wall, therefore, a two foot overhang would be the maximum allowed. Boardmember Beck suggested they reduce the garage overhang by one foot. Vice-chairperson Dietzman asked when the two previous variances were approved. Mr. Jacobs stated 1998 and late-2000. He confirmed for Vice-chair Dietzman that nothing has been built at 6911 West Stockman as yet, stating, however, construction on the lot could occur in the future. Chairperson Ward opened the meeting up for public comment on this case. As no comments were made, he closed the public hearing portion of the case. Boardmember Schwartz made a MOTION to APPROVE ZV-02-18, subject to the stipulations contained in the staff report and adding a stipulation restricting the overhang to no more than two feet. Boardmember Iwanski SECONDED the MOTION. Chairperson Ward opened the floor to discussion. Boardmember Iwanski stated, while other alternatives may be available to the applicant, he does not believe they offer a considerably better solution. Boardmember Schwartz said he would likely have opposed the request had the property not been annexed into the area after the properties were already built. He stated the request does not appear to be detrimental to the neighborhood. Therefore, he is in support of the request. Boardmember Giarusso stated he supports the applicant's request. Boardmember Marx said she does not oppose the variance, but hopes the additions will resemble the existing structure. Board member Beck stated he supports the request with the same stipulation. Chair and Vice-chair Ward and Dietzman stated they support the applicant's request. In response to Boardmember Giarusso's question, Ms. Perry confirmed a utility easement is not located on that side of the property. No further comments were made. Chairperson Ward called for a Roll Call Vote. The MOTION PASSED by a vote of 7 to 0. Chairperson Ward stated anyone wishing to appeal the Board's decision on this item may do so by contacting the Planning Department within 15 calendar days of the date of this action.
