7:00 P.M.
The regular meeting was called to order at approximately 7:00 p.m. by the Vice Chairperson,
Douglas Ward, with the following members and representatives present:

Boardmember Ward called for a moment of silence to honor those killed in Tuesday's tragedies.
Boardmember Ward explained the Board's policies a.nd hearing procedures.
Boardmember Ward called for approval of the August 9, 2001 minutes.
Boardmember Piceno made a MOTION to APPROVE the minutes from the August 9,
2001 meeting. Boardmember Dietzman SECONDED the MOTION. The motion PASSED
by a vote of 5-0.
Boardmember Ward called for Business from the Floor. There was none.
Boardmember Ward asked staff if there were any requests for withdrawals or continuances.
There were none.

Boardmember Ward stated the Board is required to hold a public hearing before making a
decision on a variance or appeal request. He explained the purpose of the public hearing is to
provide interested parties an opportunity to present testimony for the Board's consideration.
Boardmember Ward called for the first public hearing item on the agenda.
APPLICATION NO.: ZV-01-15
REQUEST: A request by Charyn Elrich-Palmisano, Neighborhood
Revitalization Division, on behalf of Mr. Jose Munoz for a
variance to allow side setbacks of 5 feet where 20 feet is
required in the R-4 (Multiple Residence) zoning district.
The address is 6429 West Maryland Avenue. Staff
Contact: Tabitha Perry (Ocotillo District).
Ms. Perry presented the application, reviewing the site and request.
Ms. Elrich-Palmisano explained the request on behalf of the applicant.
Boardmember Piceno asked if other properties in the area have similarly reduced setbacks. Ms.
Perry answered yes, however, not by a variance request.
Boardmember Dietzman asked where is the property line. He also asked if a fence would be
built along the property line. Ms. Elrich-Palmisano stated that would be addressed during the
design phase.
Boardmember Piceno asked if the house would, in any way, obstruct traffic's line of sight. Ms.
Elrich-Palmisano assured the board that all traffic regulations would be adhered to.
Boardmember Ward asked if the site would be cleared of all additions. Ms. Perry stated it would
be.
Boardmember Ransom asked if staff is still suggesting this request be granted with the
stipulation regarding transportation. Ms. Perry said yes.
Boardmember Piceno asked if any of the zero site setback properties abut the applicant's
property. Ms. Perry explained that was hard to say. At this time there is only one house to be
concerned with. There will be an 8-10 foot separation in this situation.
Boardmember Ward opened the meeting up for public comment on this case. As no comments
were made, he closed the public hearing portion of the case.
Boardmember Piceno made a MOTION to APPROVE ZV-01-15 with the following
stipulation:

The location of the house shall be subject to review of the City's Transportation
Department for sight visibility.
Boardmember Ransom SECONDED the MOTION.
Boardmember Ward opened the floor to discussion. No further comments were made.
Boardmember Ward called for a Roll Call Vote. The MOTION PASSED by a vote of 5 to
0.
Boardmember Ward stated anyone wishing to appeal the Board's decision on this item may do
so by contacting the Planning Department within 15 calendar days of the date of this action.
APPLICATION NO.: ZV-01-16
REQUEST: A request by Charyn Elrich-Palmisano, Neighborhood
Revitalization Division, on behalf of Ms. Rosa Yanez for
a variance to allow side setbacks of 5 feet and 10 feet
where 20 feet is required in the R-3 (Multiple Residence)
zoning district. The address is 6642 North 53rd Drive.
Staff Contact: Tabitha Perry (Ocotillo District).
Ms. Perry presented the application, reviewing the site and request.
Ms. Elrich-Palmisano explained the request on the applicant's behalf.
Boardmember Ward asked if the lot has been cleared. Ms. Elrich-Palmisano replied the lot
would be cleared once the variance is granted.
Boardmember Ward opened the meeting up for public comment on this case. As no comments
were made, he closed the public hearing portion of the case.
Boardmember Ransom made a MOTION to APPROVE ZV-01-16.
Boardmember Piceno asked that the motion be amended to include the condition that the
variance not assure granting any special privileges inconsistent with the limitations of other
similar properties.
Boardmember Ransom agreed to AMENDED her MOTION. Boardmember Dietzman
SECONDED the AMENDED MOTION.
Boardmember Ward opened the floor to discussion. No further comments were made.
Boardmember Piceno stated he feels significant precedence has been set by the Board in granting
the previous variance since the locations are within a block of each other. Therefore, he has no
problem with this request.

Boardmember Ward called for a Roll Call Vote. The AMENDED MOTION PASSED by
a vote of 5 to 0.
Boardmember Ward stated anyone wishing to appeal the Board's decision on this item may do
so by contacting the Planning Department within 15 calendar days of the date of this action.
APPLICATION NO.: ZV-01-17
REQUEST: A request by Charyn Elrich-Palmisano, Neighborhood
Revitalization Division, on behalf of Mr. John Almanza
for a variance to allow side setbacks of 5 feet and 10 feet
where 20 feet is required in the R-3 (Multiple Residence)
zoning district. The address is 6645 North 55th Avenue.
Staff Contact: Tabitha Perry (Ocotillo District).
Ms. Perry presented the application, reviewing the site and request.
Boardmember Ransom asked if sight visibility could be included as a regulation. Mr. Flaaen
said the Neighborhood Revitalization Department could include it as part of their program. Ms.
Perry noted the side yard fulfills the line of sight requirement, but it could be included in the
requirements as requested. Mr. Luttrell reviewed the requirements as stated in the guidelines and
assured the Board that the process addresses this item. These stipulations were added in
tonight's presentation only because a finished house product was not available for review at this
time. Boardmember Ransom explained she is concerned that trees could eventually mature to
obscure the line of sight.
Ms. Elrich-Palmisano presented the request on behalf of the applicant. She said the
Neighborhood Revitalization Division provides a xeriscape landscaping package.
Boardmember Piceno made a MOTION to APPROVE ZV-01-17. Boardmember Ransom
SECONDED the MOTION.
Boardmember Ward opened the floor to discussion. No further comments were made.

0.

Boardmember Ward called for the Planning Staff Report. Mr. Luttrell asked for a tentative
attendance count of those boardmembers present. All replied they would be in attendance.

Vice-chairperson Ward called for Board Comments and Suggestions. No comments were made.
As there was no further business, the meeting was adjourned at 7:30 p.m.
