Vice Mayor Malnar said it was a Council goal to support and strengthen local businesses. Item
8 was a perfect example of staff recognizing that goal. With the cooperative purchasing
agreement with Sands Motor Company, the City was retaining sales tax and supporting a local
business. He encouraged staff to continue that support.

Ms. Perry said the existing land use designation was CCC (Corporate Commerce Center) and
the first request was to amend the land use designation on 7 acres of the 10-acre site to
high-density residential.
Ms. Perry said the second request was to rezone the entire 10-acre site from PAD (Planned
Area Development) to PAD to allow for a mixed-used development. Uses included office, retail,
restaurant and hotel.
Ms. Perry said the development was comprised of 3 areas. Area 1 was intended for a
multi-family development. Area 2 was intended for additional multi-family or office space. Area
3 was projected for office space. Area 1 had received design review approval contingent upon
approval of the General Plan amendment and the rezoning request. The design for Area 1
included a 189-unit, 4-story, age-restricted, gated multi-family complex on 7.34 acres designed
for active adults aged 55 years or older.
Ms. Perry said the General Plan request was consistent with the rezoning request. The
rezoning request was similar to existing zoning. The citizen participation process was
completed, and the school district had verified adequate school facilities. The Planning
Commission unanimously recommended approval for both requests at its meeting on January
16, 2020.

Ms. Collins said the request by the Barclay Group was to annex approximately 97 acres of land
located at the southwest corner of Glendale Avenue and the Loop 303. The applicant sought to
develop the property for industrial and commercial uses including freeway-oriented billboards.
The property had received zoning from Maricopa County and no further zoning action was
required.
Ms. Collins said the southern portion of the property was designated Luke Compatible Land Use
(LCLU) and the northern portion was designated Regional Mixed Use (RMU). Portions of the
property were located within the 65 DNL (Day/Night average sound level) and 70 DLN contour of
Luke Air Force Base and were not appropriate for residential development.

Following annexation, the applicant sought to rezone the property to allow an industrial and
warehouse development. The PAD had been approved by the Planning Commission contingent
upon the approval of the annexation.

Ms. Collins said the rezoning request was for the "West 303 Crossing" project, approximately 76
acres located at the northeast corner of Sarival Avenue and Maryland Avenue. The property
was located within the Luke Compatible Land Use (LCLU)Area within noise contours of 70 DNL
and 75 DNL.
Ms. Collins said the request was to rezone the property from RU-43 to PAD with proposed land
uses such as industrial, manufacturing, warehouse, e-commerce and office for a total of 1.25
million square feet. The applicant was requesting additional building height and floor area ratio
(FAR).
Ms. Collins said the Planning Commission recommended unanimous approval at its meeting on
December 19, 2019. The proposal was consistent with the General Plan and supported future
growth and employment opportunities for the City.
Councilmember Turner asked if it was correct that it was an annexation case and a zoning case
working its way through the process at the same time.
Ms. Collins said that was correct. The zoning case was contingent upon approval of the
annexation.
Councilmember Turner said for an annexation case only the property owners were notified.
Surrounding neighbors were notified in a zoning case. He asked if the property was posted for
both the annexation and the zoning and notification through the mail for the zoning.

Ms. Collins said all of the notification requirements for the rezoning were followed.
Councilmember Turner was concerned because at the voting meeting two weeks ago, there
were people in attendance who were concerned about the zoning on the property. There were
statements made that the zoning could take up to a year to occur. Two weeks later, the property
was given its ultimate zoning and no one was present to speak to the request. He was
concerned that there had not been adequate notice and that interested parties were misinformed
two weeks ago.
Ms. Collins believed the participation two weeks ago related to an annexation case for the Cotton
properties that was on the agenda. It did not yet have a zoning case. There were multiple
cases that night.
Councilmember Turner said there were speakers who addressed the annexation and zoning for
the subject property currently being discussed. He remained concerned about the notification
process.

Ms. Chapin said the request was to abandon public right-of-way at the West Discovery Drive
alignment between 67th Avenue and 69th Avenue and a portion of a roadway easement on 67th
Avenue adjacent to 6208 North 67th Avenue. Both abandonments were in support of the
Glendale 10 residential subdivision. A 10-foot utility easement would be retained.

RESOLUTIONS
20. RESOLUTION NO. R20-08
A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY,
ARIZONA, AUTHORIZING AND DIRECTING THE ENTERING INTO OF A DEVELOPMENT
AGREEMENT WITH RBNA LLC.
Presented by: Randy Huggins, Economic Development Officer, Economic Development
Ms. Bower read the resolution by title.
Mr. Huggins said the proposed resolution authorized the City Manager to enter into a
Development Agreement (DA) regarding certain fees between the City and RBNA.
Mr. Huggins said RBNA planned to construct a 700,000 square foot beverage distribution facility
which would support and distribute items produced from the Rauch/Ball/Red Bull production
facility that was currently under construction at Reems Road and Peoria Avenue. The new
beverage distribution facility would create 115 new jobs with average wages above $50,000 per
year.
Mr. Huggins said the DA had no direct expense to the City but would result in the City foregoing
$750,000 in plan review, permit and inspection fees. The total direct revenue to the City was
expected to reach $2.8 million over the first ten years. RBNA was also constructing nearly $1
million in roadway and transportation improvements. The transportation impact fees would be
credited against transportation improvements constructed and dedicated. RBNA would pay all
other development impact fees related to the project.

Councilmember Clark was delighted to see the project and the potential jobs it would create
for Glendale residents.
Mayor Weiers was also delighted that RBNA had chosen Glendale for its project.

Mr. Huggins said JAWS 303 planned to construct two 565,000 square foot buildings for
industrial, e-commerce and high-tech manufacturing uses. The project would be a catalyst for
the installation of new water, sewer, power, communication and transportation infrastructure.
Mr. Huggins said the DA had no direct expense to the City but would result in the City foregoing
up to$169,000 of development fees such as review and permit fees. The direct benefit to the
City for phase 1 would be more than $1 million in the first year and over$2.2 million over 10
years. If phase 2 developed, the benefit would double. The fee waiver did not include
development impact fees.

Ms. Camacho said the proposed resolution supported the acceptance of grant funds in the

23. RESOLUTION NO. R20-11
A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY,
ARIZONA, AUTHORIZING AND DIRECTING THE ENTERING INTO OF A DEVELOPMENT
AGREEMENT WITH BEARDSLEY 101 INVESTMENTS, LLC REGARDING COMMUNITY
DEVELOPMENT FEES.

Mr. Friedman said the resolution authorized the City Manager to enter into a Development
Agreement (DA) regarding certain fees between the City and Beardsley 101 Investments, LLC.
Mr. Friedman said Visionary Automotive Group recently announced the award of new Land
Rover and Jaguar franchises. The new dealerships would be constructed immediately north of
the existing Arrowhead BMW dealership on approximately 9.2 acres. Additionally, Berkshire
Hathaway Automotive Group announced its plan to relocate its existing Volvo dealership to the
same site. A luxury collision, cosmetic repair and paint center was also planned.
Mr. Friedman said there was no direct expense to the City. The DA would result in the City

foregoing $500,000 of development fees which included the waiving of fees related to the initial
design and construction of, or the issuance of a certificate of occupancy for Beardsley 101's
project, including, any plan review or permit fees. The waiver did not include development
impact fees and Beardsley 101 agreed to pay all development impact fees related to the project.
Mr. Friedman said the investment would result in 250 jobs for Glendale and new sources of
sales tax revenue.

COUNCIL COMMENTS AND SUGGESTIONS
Councilmember Aldama said there was a senseless act of violence in the downtown area on Saturday,
January 25th and the community now mourned the loss of a longtime merchant, Ray Watkins. He offered
his deepest condolences to Mr. Watkins' family and all those affected by the tragedy. Mr. Watkins would
be remembered as a kind, generous and passionate individual who added to the fabric of Glendale.
Councilmember Clark added her condolences to the family and friends of Ray Watkins.
Councilmember Hugh thanked the Economic Development team for the addition of three new
dealerships. Glendale was thriving.

Councilmember Hugh thanked the City's Public Safety employees. He said the City supported those
employees who were suffering from post-traumatic stress disorder and hoped the media would not
feature any more stories on employees who were suffering.
Councilmember Tolmachoff welcomed Visionary Automotive Group and Berkshire Hathaway Automotive
Group to the City.
Councilmember Turner also offered his condolences to the family and friends of Ray Watkins. It was a
tragic thing that happened to a very fine man.
Vice Mayor Malnar sent his condolences to Ray Watkins' family for its loss.
CITIZEN COMMENTS
James Deibler, Phoenix resident, expressed concern about people loitering on the northwest corner of
43rd Avenue and Maryland Avenue.
