ROLL CALL Commissioners Present: Commissioners Crow, Harper, Nowakowski, Nyberg, Wilfong, and Chairperson Hirsch were present. Commissioner Present: Vice Chairperson Lenox was absent and excused. City Staff Present: George Gehlert, AICP, Planner, Jim Gruber, Chief Deputy City Attorney, Lisa Collins, Planning Administrator, and Diana Figueroa, Recording Secretary. CITIZEN COMMENTS Chairperson Hirsch called for citizen comments. There were none. APPROVAL OF MINUTES Chairperson Hirsch called for a motion regarding the October 3, 2019 Planning Commission Minutes. Motion made by Commissioner Crow to approve as written. Seconded by Commissioner Wilfong, which passed unanimously. WITHDRAWALS AND CONTINUANCES Chairperson Hirsch asked for Withdrawals and Continuances. There were none. PUBLIC HEARING ITEM Chairperson Hirsch called for the public hearing item. HOME DAYCARE CONDITIONAL USE PERMIT CUP19-07 A request by Ahmad Stanikzai, representing Tahmina Stanikzai, to allow a Conditional Use Permit to have a Home Child Care Center (home daycare) for no more than 10 children in the R1 -6 (Single Residence) zoning district. The site is located near the southwestern corner of Manzanita Drive and 56th Drive and is in the Barrel District. Staff Contact: Lisa Collins, Planning Administrator (623-930-2800). Mr. George Gehlert, AICP, Planner, made staff's presentation. Chairperson Hirsch called for questions from the Commission. November 7, 2019 Planning Commission There were few questions from the Commissioners, which were addressed by Mr. Gehlert. Mr. Ahmad Stanikzai, applicant, representing Ms. Tahmina Stanikzai, introduced himself, addressed the concerns of the Commissioners, and stated he was available for questions. There were a few questions. from the Commissioners, which were addressed by the applicant. Chairperson Hirsch opened the public hearing. With no one wishing to speak, he closed the public hearing. Commissioner Nowakowski wanted to add a stipulation to restrict outdoor activity after 6pm. Chairperson Hirsch called for a motion. Commissioner Crow made a motion to approve CUP19-07 subject to the four stipulations contained in the staff report including the modification to stipulation one. Commissioner Harper seconded the motion. The motion was approved unanimously. Mr. Jim Gruber, Chief Deputy City Attorney, stated this is final action for case CUP 19-07. Anyone wishing to appeal this motion may do so in writing within 15 days. OTHER BUSINESS FROM THE FLOOR Chairperson Hirsch asked if there was any business from the floor. There was none. PLANNING STAFF REPORT Chairperson Hirsch asked if there was a Planning Staff Report. There was none. COMMISSION COMMENTS AND SUGGESTIONS Chairperson Hirsch called for comments and suggestions. Commissioner Nowakowski had questioned related to sales tax. NEXT MEETING The next Planning Commission Public Hearing is scheduled for December 5, 2019, ADJOURNMENT With no further business, Chairperson Hirsch called for a motion to adjourn. Commissioner Crow made a motion to adjourn. Commissioner Wilfong seconded the motion, which was approved unanimously. The meeting was adjourned at 6:3 5pm. 2 of 2
