Meeting was called to order at 5:06 pm.

3. CITIZEN COMMENTS
Beverly Moore, Glendale Resident from the Ocotillo District, spoke about concerns regarding an easement
by her home.
Jane Short, Glendale Resident from the Cactus District, wanted to know why this committee is not saluting
the flag before the meeting.
4. APPROVAL OF THE MINUTES
Chairperson Malnar asked the committee members to make sure to speak clearly and to speak into the
microphone. He said when a motion is made it should be stated clearly and submitted in writing for the
minute taker. He also asked the members to be sure to state their name before speaking if it was not already
stated.
A motion was made by Committee Member Wilfong and seconded by Committee Member Knaack to
approve the minutes from the October 24, 2019 meeting.

5. ITEMS FOR DISCUSSION AND POSSIBLE ACTION
a. 1993 PARKING MEMO INTERPRETATION FOLLOW UP/FRONT YARD PARKING DISCUSSION
Lisa Collins, Planning Administrator, stated that she is working with the attorneys and staff to gather
information for the January meeting and will be providing diagrams regarding this concern at that time as well.
Vice Chairperson Turner asked about the difference of public and private property easements. Lisa Collins
stated that she will be providing a memo regarding this. She will also include who is responsible for
the maintenance of the easements.
6. UPDATES
a. CITY ATTORNEY'S OFFICE
There were no updates from the City Attorney's Office.
b. CODE CONSULTANT
Adam Pruitt with Michael Baker International stated they have completed a page by page analysis of the
zoning ordinance. He stated that there are 18 articles and chapters in the city code and that they have
created an annotated outline that will be reviewed by staff along with the analysis. Once the outline has
been reviewed this information will be put on a website for input from the public.
There was discussion among committee members regarding the review of the ordinances.
Chairperson Malnar asked what segments of the ordinance will be started on first.
Adam Pruitt stated that they have 5 modules that are being looked at. Module 1 is zoning districts,
development standards, and design guidelines. Module 2 is specific use provisions which will
include land use tables and regulations. Module 3 is general development standards. Module 4
is signage and module 5 is administration, general provisions and definitions.
7. SUBCOMMITTEE REPORTS AND POSSIBLE ACTION
a. RESIDENTIAL SUBCOMMITTEE
There were no updates from the Residential Subcommittee.
b. COMMERCIAL SUBCOMMITTEE
Committee Member Knaack spoke about right of way maintenance. She passed out a handout
with information regarding this. She stated that tall grass/weeds need to be above 6" to be addressed
now. She said that the 6" height should be reduced in the right of way areas due to safety concerns.
There was discussion between the committee members regarding the height of the grass/weeds.
The solution for the right of way maintenance is: Grass, weeds, and accumulated items on public
property such as sidewalks and easements adjacent to a commercial property or residence need
to be specifically called out in code that it is the owner who is responsible for maintenance. To wait
until the grass or weeds on a sidewalk are 6 inches creates a safety hazard. There are areas,
especially in downtown, that the grassy area between the sidewalk and the street is not maintained.
A motion was made by Committee Member Knaack and seconded by Committee member Wilfong,
to approve, as written, the right of way maintenance and possible solution. This will be forwarded to
the consultant for review.

Committee Member Knaack spoke about paint color on business properties. She suggested that
a standard commercial color palette be introduced.
There was discussion between the committee members regarding the suggested color palette.
Lisa Collins, Planning Administrator, stated that the City does have a design review requirement.
She said that it should be written that all alterations to commercial structures have to go through
that design review process and that if there is a disagreement it can be appealed. New construction
is already subject to this design review requirement.
A motion was made by Committee Member Knaack and seconded by Vice Mayor Clark to submit
a suggestion to the consultant to determine what can be done to introduce guidelines of paint
palettes and maintenance of paint on commercial properties.

Committee Member Knaack spoke about outdated signage on commercial properties. She stated
that the possible solution is to have the consultant include this on the review. If a new owner or
tenant moves into a commercial building the current signage would need to be updated to the
current code.
There was discussion between the committee members regarding the suggested signage
guidelines.
A motion was made by Vice Mayor Clark and seconded by Committee Member Knaack to
submit a suggestion that the consultant add to the signage ordinance: If a new owner or
tenant moves into a commercial building the current signage would need to be updated to the
current code. It should also include the ability to create new overlay districts.

MISCELLANEOUS SUBCOMMITTEE
Committee Member Short read aloud from a handout. He stated the first problem is that
some home-based businesses create excessive commercial and client traffic and improper
parking. The recommended solution is to create language that specifically defines types
of commercial vehicles and number of clients per day that will not impair the quality
of life of the residential neighborhood.
There was discussion between the committee members regarding this suggestion.
A motion was made by Committee Member Short and seconded by Vice Mayor Clark that

Committee Member Short stated the next problem is that it is too difficult for residents to complain
about habitual noise nuisances from animals and birds and other disturbances of the peace. He
said the sub -committee recommends eliminating the requirement of the two neighbors to file a
complaint as witnesses for barking dogs and loud birds and other noise disturbances. The
recommendation would be: the offender would be contacted in person for the first complaint, the
second complaint would be to cite the property owners and the third complaint would require
the complainant and offender to go to court with sound recordings and logs.
There was discussion between the committee members regarding this suggestion.
A motion was made by Committee Member Short and seconded by Vice Chairperson Turner
to amend the recommendation definition to the following: the offender would be contacted

to amend the recommendation definition to be amended to include odor as well. Stating

Committee Member Short stated that the third concern is in regard to auto sales in a
residential area. He stated that property owners should be cited after the second occurrence
for habitual violations.
Chairperson Malnar stated this is an addendum to a motion that was made at the last Code
Review Committee meeting.
There was discussion between the committee members regarding this addendum.
A motion was made by Committee Member Short and seconded by Vice Mayor Clark
to add to the recommendation an addendum that property owners should be cited after the
second occurrence for habitual violations.

d. PARKING SUBCOMMITTEE
Committee Member Wilfong read aloud from a handout that was distributed at the meeting.
There was discussion among the committee members regarding the recommendations
listed on the handout.
Chairperson Malnar read aloud Ordinance 5.211 and Ordinance 5.312 regarding front yard
parking. He stated that the Froke memo is now gone. He said they are asking for the Code
Compliance inspectors to be directed to enforce current city codes as it is written today. This request
is directed to the City Council Members and the City Manager. He stated that they would like for this
to happen now and not wait for the consultant to re -write that code.
There was further discussion among the committee members regarding this topic.
A motion was made by Committee Member Wilfong and seconded by Committee Member
Socaciu to recommend that the City Council and the City Manager direct the Code
Compliance inspectors to enforce current city codes as they are currently written today.

9. STAFF REPORT
There was no staff report.
10. COMMITTEE COMMENTS AND SUGGESTIONS
Committee Member Wilfong spoke about the code compliance inspectors needing more support
from upper management, the City prosecutors and in the courts. He suggested that this should be
addressed.
Vice Mayor Clark stated that the prosecutors should be willing to take on more cases from
the code compliance inspectors.
Vice Chairperson Turner asked about unhitched trailers parked on public streets. He stated
that he sees them quite often in his district. He asked if the code had been changed to allow them.
He asked to know what the current code and practice is regarding this. He also asked about
the abatement program and wanted an update on this.
11. NEXT MEETING
The next regular meeting of the Code Review Council Committee will be held on January 23, 2020 at
5:00 p.m., in conference room B3, located at 5850 West Glendale Avenue, Glendale, Arizona, 85301
12. ADJOURNMENT
Chairperson Malnar adjourned the meeting at 7:01 pm.
