GLENDALE, ARIZONA 85301 SEPTEMBER 26, 2019 5:00 P.M. 1. CALL TO ORDER The meeting was called to order at 5:05 p.m. 2. ROLL CALL Present: Yvonne Knaack, Member Barbara Lentz, Member Ron Short, Member Michael Socaciu, Member Warren Wilfong, Member Bart Turner, Councilmember Ray Malnar, Councilmember Joyce Clark, Vice Mayor Absent: Rich LeVander, Assistant Police Chief Francis Sisti, Member Mark Lilly, Member Also Present: Chris Anaradian, Assistant City Manager Eric Fitzer, Development Services Director Tim Boling, Code Compliance Official Lisa Collins, Planning Administrator Deborah Gentry, Administrative Support Specialist Shelli Henson, Council Assistant 3. CITIZEN COMMENTS James Greeley, Glendale Resident from the Sahuaro District, expressed concerns about the inspection procedure of the Code Compliance Inspectors. Jim Brewer, Glendale Resident from the Sahuaro District, said that the Code Compliance inspectors are doing an outstanding job. He said that he sees the inspector in his area even more than he had before and he appreciates it. He suggested that an education process would be helpful due to some misconceptions with the inspection process. He also stated that the notes left on the violation notices should be clearer and more concise. Joyce Capson, Glendale Resident from the Sahuaro District, asked why current codes on the books are not being addressed. She also asked why the police officers do not enforce the nuisance codes. She stated that she would like to see a foreclosure program put into place. Beverly Moore, Glendale Resident from the Ocotillo District, wanted to thank the Code Compliance Division for work done to rectify excessive vehicle repair violations. 4. APPROVAL OF THE MINUTES A motion was made by Member Knaack and seconded by Vice Mayor Clark to approve the minutes from the June 27, 2019 meeting. ITEMS FOR DISCUSSION AND POSSIBLE ACTION a. 1993 PARKING MEMO INTERPRETATION FOLLOW UP Eric Fitzer said that he will negate the (2) 1993 parking interpretations and stated that the current parking code is being enforced. He stated that allowed improvements done during that time under that interpretation would be grandfathered. There was discussion among committee members regarding the 1993 parking memo interpretation. Eric Fitzer said that they will look into defining the word "maneuvering". He stated they will also look into long term time frames for the parking code. There will be a presentation at the next meeting showing diagrams of approved/unapproved parking areas. b. SITE PLAN REVIEW FOLLOW UP There were no updates at this time. 6. UPDATES a. CHRIS ANARADIAN, ASSISTANT CITY MANAGER There were no updates at this time. b. PRESENTATION BY CODE CONSULTANTS Matthew Klysceiko, consultant at Michael Baker International, spoke about the process of the code re -write. He stated they will address the unique issues of the community and will be working closely with the public and staff to make the new codes as user friendly as possible. They will utilize and address the latest trends and best practices to make sure that the code is consistent. This will be a 16 -month process. To start they will do an analysis, next develop an outline, and then develop a unified code. c. CITY ATTORNEY There were no updates at this time. 7. DISCUSSION REGARDING COMMITTEE PROCESS Chairperson Malnar spoke regarding the purpose of the committee. He stated that the subcommittees will identify an area of concern and then make recommendations. The recommendations will be discussed at the Code Review Council Meeting and then turned over to the code consultants who will write the code. 8. SUBCOMMITTEE REPORTS AND POSSIBLE ACTION a. RESIDENTIAL SUBCOMMITTEE Vice Chairperson Turner read aloud from a handout titled "Neighborhood Issues Subcommittee Topics 9/27/19". He spoke about the abatement process and suggested that the City be more aggressive in foreclosing on liened properties. Vice Chairperson Turner said that the code regarding where a violation can be viewed from should be amended to add "or from neighboring property". He spoke about required setbacks from alleys and said the City should eliminate required setbacks from the alley. Lastly, he spoke about not requiring permits for flagpoles but developing standards and educating the residents on this topic. There was discussion among committee members regarding these topics. b. COMMERCIAL SUBCOMMITTEE Committee Member Knaack read aloud from a handout titled "Code Regarding Palm Trees". She asked that the new language be submitted for approval. Committee Member Knaack stated that they will not address fireworks or Christmas lights. She said that the committee is currently working on the right of way codes. c. MISCELLANEOUS SUBCOMMITTEE Committee Member Short read aloud from a handout titled "Summary Report of Miscellaneous Sub -Committee Meeting August 16, 2019". There was discussion among committee members regarding the topics and definitions listed on the handout. d. PARKING SUBCOMMITTEE Committee Member Wilfong distributed and read aloud from a handout titled "Recommended Changes for Resident Parking Code". There was discussion among committee members regarding the vehicles and car covers and codes listed on the handout. Chairperson Malnar asked the Residential Subcommittee to speak more about the clean and lien properties. Vice Chairperson Turner lead a discussion among committee members regarding the clean and lien properties and a possible abatement program. Chairperson Malnar asked for a motion to have the consultants look into the abatement program. A motion was made by Vice Mayor Clark and seconded by Vice Chairperson Turner to approve the motion. Vice Chairperson Bart Turner asked for a motion to have the consultants look into adding the phrase "or from a neighboring property or other public means" to the code that addresses where a violation can be viewed from. A motion was made by Vice Mayor Clark and seconded by Committee Member Socaciu to recommend the phrase "or from a neighboring property or other public means" added to the code that addresses where a violation can be viewed from. NEXT MEETING The next regular meeting of the Code Review Council Committee will be held on October 24, 2019 at 5:00 p.m., in conference room B3, located at 5850 West Glendale Avenue, Glendale, Arizona, 85301. 13. ADJOURNMENT Chairperson Malnar adjourned the meeting at 6:37 p.m. The City Code Review Committee meeting minutes of September 26, 2019 were submitted and approved this 24th day of October, 2019.
