19. RESOLUTION NO. R19-123
A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY,
ARIZONA, AMENDING THE GENERAL PLAN MAP OF THE CITY OF GLENDALE, ARIZONA,
BY APPROVING GENERAL PLAN AMENDMENT GPA19-05 FOR PROPERTY LOCATED
NEAR THE NORTHWEST CORNER OF CAMELBACK ROAD AND 83RD AVENUE (5070
NORTH 83RD AVENUE).
ORDINANCE NO. 019-83
AN ORDINANCE OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY,
ARIZONA, REZONING PROPERTY LOCATED NEAR THE NORTHWEST CORNER OF
CAMELBACK ROAD AND 83RD AVENUE (5070 NORTH 83RD AVENUE) FROM SC
(SHOPPING CENTER) TO PAD (PLANNED AREA DEVELOPMENT) FOR A DEVELOPMENT
PLAN ENTITLED "83RD AND CAMELBACK"; AMENDING THE ZONING MAP; PROVIDING

Mr. Fitzer said the applicant was Eric Gerster, Sustainability Engineering Group, LLC and the
request was to amend the General Plan Land Use Map from PC (Planned Commercial) to GC
(General Commercial) and to amend the existing zoning from SC (Shopping Center) to PAD
(Planned Area Development).
Mr. Fitzer said the applicant had mailed notification letters on July 25, 2019 and no questions,
comments or concerns had been received regarding the proposal.
Mr. Fitzer said the project had met applicable findings in the Zoning Ordinance and would not
be materially detrimental to the community. The project would help provide economic viability
and develop an underutilized vacant property. The Planning Commission recommended
approval of GPA19-05 as filed and ZON19-11 subject to the five stipulations outlined in the
ordinance.
Vice Mayor Clark said the neighborhood was very supportive of the project.
Mayor Weiers opened the public hearing.

ARIZONA, AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE AN
AMENDMENT TO LEASE WITH ARIZONA DEPARTMENT OF CHILD SAFETY (DCS), AN
AGENCY OF THE STATE OF ARIZONA, FOR SUITES 150, 200, 225, 300, 315-320, 325, 350
AND 360 OF THE BANK OF AMERICA PLAZA OFFICE BUILDING LOCATED AT 5800 WEST
GLENN DRIVE IN GLENDALE, ARIZONA.

Ms. Chapin said the proposed ordinance would approve an amendment to the lease
agreement between the City and the Arizona Department of Child Safety (DCS), for
approximately 36,540 square feet (SF) of office space in the City-owned Bank of America Plaza
office building at 5800 West Glenn Drive. DCS was the largest tenant in the building and
occupied approximately 63% of the space. The amendment would change the termination date
from December 31, 2020 to December 31, 2025.

Clark to adopt Ordinance No. 019-84.

21. RESOLUTION NO. R19-124
A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY,
ARIZONA, AUTHORIZING AND DIRECTING THE ENTERING INTO OF A PRE-ANNEXATION
DEVELOPMENT AGREEMENT WITH MOSS FAMILY TRUST TO FACILITATE THE
ANNEXATION AND DEVELOPMENT OF PROPERTIES WITHIN THE LOOP 303 CORRIDOR
AND DIRECTING THAT THE CITY CLERK RECORD ANY AND ALL NECESSARY
DOCUMENTS.

Mr. Fitzer said the proposed resolution authorized the City Manager to enter into a
Pre-Annexation Development Agreement (PADA) between the City and the Moss Family Trust
in order to facilitate the annexation of the owner's property and the development of the property
within the City. It would allow the owner to seek an expansion of sewer service from EPCOR.
Councilmember Tolmachoff asked what the County zoning was on the parcel.
Mr. Fitzer said the current zoning was R-143. Staff did not know what the intended use would
be for the property.

COUNCIL COMMENTS AND SUGGESTIONS
Councilmember Aldama reminded residents of the 25th annual Front Porch Festival taking place on
October 12, 2019 in Catlin Court.
Councilmember Hugh reminded Cactus District residents of his District Fall meeting on October 23,
2019, 5:00 p.m. to 7:00 p.m. at Manistee Ranch Park.
Councilmember Turner reminded Barrel District residents of his District Fall meeting on October 17,
2019, 5:00 p.m. at Sahuaro Ranch Park.
Vice Mayor Clark said she, Mayor Weiers, Councilmembers Aladama and Tolmachoff and Mr. Phelps
attended a funeral mass for Bill Bidwill, owner of the Arizona Cardinals. It was a tribute to and
celebration of Mr. Bidwill's life. He was a generous benefactor to many organizations in the community
and would be greatly missed. She offered her condolences to the Bidwill family.
CITIZEN COMMENTS
Bill Demski, Sahuaro District, commented on taxes and employee salaries.
James Deibler, Phoenix Resident, commented on the Starbuck's being constructed at 59th Avenue and
Olive Avenue.
Steve Einstman, Sahuaro District, commented on issues regarding streets and community meetings.
Terry Newhart, Barrel District, commented on issues with a neighborhood group home.
Maride Newhart, Barrel District, commented on issues with a neighborhood group home.
Carla Hosler, Barrel District, commented on issues with a neighborhood group home.
