Mayor Weiers called the meeting to order at 12:31 p.m.

WORKSHOP SESSION
1. COUNCIL COMMITTEES
Presented by: Brent Stoddard, Public Affairs Director
Ms. Bower read the item by title.
Mr. Stoddard said Section 9 of the Council Guidelines required Council to make appointments to
Council committees and sub-committees during the first workshop in June. The Temporary
Business Council Committee and Temporary City Code Review Committee needed no action.
Appointments were necessary for the new Audit Committee, which included three members of
Council. Terms would be for two years and would begin on July 1, 2019.
Vice Mayor Clark recommended Councilmembers Hugh, Malnar and Tolmachoff.
Councilmember Turner said the committee should have one member of Council who was skeptical
of the process, for a critical point of view. He expressed interest in serving on the committee.
Mayor Weiers said there was not consensus for the recommendation of Councilmember Turner.
Mayor Weiers said there was consensus for the recommendation of Councilmember Malnar.
Mayor Weiers said there was consensus for the recommendation of Councilmember Hugh.
Mayor Weiers said there was consensus for the recommendation of Councilmember Tolmachoff.
Mr. Stoddard said the current members of the Government Services Committee were Vice Mayor
Clark, Councilmember Turner and Councilmember Hugh. The Council Guidelines limited service
to two consecutive terms. Councilmember Turner and Councilmember Hugh were appointed in
June 2017 and were not eligible for reappointment. Vice Mayor Clark was appointed in June 2018
and was eligible for reappointment.
Vice Mayor Clark was willing to serve another term. She recommended the appointment of
Councilmember Aldama and Councilmember Tolmachoff.

Mayor Weiers said there was consensus.
Mr. Stoddard said the Council Compensation Commission would have five members that were not
City employees or elected officials. Staff would come before Council at the June 25th meeting to
form and charge the committee. Council would determine how to handle fulfilling the membership
of the committee.
Councilmember Hugh recommended John Crow, Tom Traw, Vern Crow, Diane McCarthy, and
Jack Rose for the Commission.
Councilmember Turner expressed concern regarding the committee nominations, which were not
part of the workshop's Council report.
Mr. Bailey said the purpose was to provide a general overview to staff in order to prepare for
discussion at a later date. Council was not bound by the discussion. If Council was not
comfortable, it could be brought back for future consideration and discussion.
Councilmember Aldama supported postponing the discussion.
Mayor Weiers clarified that the recommendations would be voted on at the June 25th voting
meeting.
Mr. Stoddard said staff would prepare a resolution for the June 25th voting meeting to officially
form and charge the committee. If Council had recommendations for members, the appointments
could be made at the same meeting.
Councilmember Aldama said it was possible that some of those nominated might not wish to serve
and additional nominations would be necessary.
Mayor Weiers said it was a matter of selecting five willing members at the workshop and making
appointments at the voting meeting.
Councilmember Aldama was open to staff deciding which members would serve on the
committee. He did not have recommendations prepared.
Councilmember Tolmachoff said the City Charter stated members must be appointed by the
Council. She supported discussing member selection at the June 25th workshop and making
appointments at the following voting meeting.
Mayor Weiers said additional member recommendations could be added and discussed at the
next workshop.
Councilmember Turner was disappointed that all members of Council were not aware that
recommendations would be made during the workshop.
Councilmember Hugh had made the request at the last workshop for the item to be brought
forward.
2. COTTON PROPERTIES ANNEXATION AN-199

Ms. Bower read the item by title.
Mr. Williams said Cotton Properties was located on the west side of Loop 303 between Glendale
Avenue to Bethany Home Road and was currently farmland. Staff was recommending annexation
of the parcel.
Councilmember Tolmachoff asked about the current zoning of the parcel.
Mr. Williams said the parcel was zoned RU-43, which was a one-acre minimum, residential rural
zone.
Councilmember Tolmachoff said similar City zoning would be given to the parcel at annexation.
Mr. Williams said if the parcel was annexed, the City was legally required to translate it to the
nearest equivalent zoning.
Councilmember Tolmachoff asked if there was a zoning case associated with the parcel.
Mr. Williams replied there was a rezoning case on file, proposing M1, light industrial zoning and C2
commercial district.
Councilmember Tolmachoff asked who was responsible for Cotton Lane, from Glendale Avenue to
Bethany Home Road.
Mr. Williams said the development would pay its own way, but road responsibility had not yet been
determined.
Councilmember Tolmachoff asked about the agreement with the county regarding road
improvements and how it would be affected by the annexation.
Mr. Williams said staff worked cooperatively with the Maricopa County Department of
Transportation regarding the development standards for roadways. The Arizona Department of
Transportation (ADOT) had jurisdiction of Glendale Avenue west of the development and had to
accept any planned improvements as well.
Vice Mayor Clark asked for clarification on the term "generally compatible" regarding the Luke
Airforce Base contour noise lines.
Mr. Williams said the zoning proposal provided for a range of uses. The rezoning application had
minimal conflicting uses in conjunction with the Luke Airforce Base Land Use Zones. Discussions
had been held with Luke Air Force Base regarding the property.
Vice Mayor Clark asked whether Cotton Properties had held any preliminary discussions with the
water utility, EPCOR.
Mr. Williams was not aware of any discussions between Cotton Properties and EPCOR. EPCOR
had been notified of the rezoning application.
Councilmember Turner asked where the annexation property line was located.
Mr. Williams said the annexation only included the private property owned by Cotton Properties,
not any public rights-of-way.

3. PROPOSED REVISIONS TO GLENDALE CITY CODE, CHAPTER 2, ARTICLE III, DIVISION 3 -
MEET AND CONFER PROCESS

Ms. Bower read the item by title.
Mr. Phelps said a draft meet and confer ordinance was presented to Council on April 30th. He
said the reason for the revisions was due to a recent arbitration process and the need for clarity on
procedures.
Mr. Phelps said the proposed change was to clarify the purpose of the meet and confer outcome
as a budget proposal that would be brought before Council for final approval in the budget process
and to clarify how disputes with regard to the memorandum of understanding (MOU)would be
resolved
Councilmember Aldama asked who chose the arbitrator.
Mr. Phelps replied each side submitted names for the arbitrator and there was one similar name
submitted by both Local 493 and the City.
Councilmember Aldama said the arbitrator had agreed with the association.
Mr. Phelps said the arbitrator ruled the methodology used by the City Manager to calculate
comparative data for salary analyses was inconsistent with past practices, annualized salary
versus hourly wages.
Councilmember Aldama stated the calculation had been in place for approximately ten to fifteen
years. He asked the status of Mr. Phelps' meetings with the police and fire associations.
Mr. Phelps said the meetings with the associations were open and collaborative. He had stressed
with both associations the need to clarify the authority of the Council.
Councilmember Aldama asked if the input from both associations was included in the proposed
ordinance.
Mr. Phelps replied the substantive changes included input from both associations. There were
some items that were proposed which moved away from the core intent and were not included.
Councilmember Aldama asked about the wording regarding working conditions and employee
discipline.
Mr. Phelps said the language was from the existing meet and confer ordinance.
Councilmember Aldama asked if there was a proposal to change the language.
Mr. Phelps said there was not.
Vice Mayor Clark stated 80% of the ordinance was the same and there were four changes. One
was in regard to the budget. Council was the ultimate decision maker and she was pleased it had
been memorialized. Two other changes regarded mediation and arbitration. The fourth change
was the 52 hours versus 56 hours for salary comparison. Glendale firefighters were on a 52-hour

schedule and other Valley fire departments were on a 56-hour schedule. She supported the
changes to the process as presented.
Councilmember Turner noted the arbitration process was taken to court and there was an appeal.
He asked for a synopsis of the appeal.
Mr. Bailey said the Superior Court ruled in favor of the City. The language at issue mandated
Council to take a specific budgetary action. The Superior Court struck the mandate.
Councilmember Turner noted there were questions regarding the 56-hour work week with paid
time-and-a-half versus a 52-hour work week with Kelly Days. He wanted an explanation of Kelly
Days.
Councilmember Tolmachoff asked if the MOU was silent on the methodology used to calculate the
compensation.
Mr. Phelps said the current MOU did not specify the methodology nor that past practices must be
used. It was reasonable to look at the comparison on an hourly basis and that had caused the
disagreement. Council had agreed to a 2.5% increase, which had been adopted in the budget.
Councilmember Tolmachoff also wanted a better understanding of Kelly Days.
Councilmember Malnar asked if the 52 or 56-hour work week would be discussed during the
meeting or at a later date.
Mr. Phelps said it would be discussed at a later date.
Councilmember Turner had not seen any language regarding the 52 versus 56-hour work week
and asked if there would be discussion at a later time.
Mr. Phelps said it was a scheduling issue and through the meet and confer process, the
discussion could be held. The goal was for the City to remain competitive with salaries. It could
be done in a number of different ways through the use of proper comparative data. A
compensation agreement that was fair to the associations was the goal. Staff would come up with
a thoughtful proposal when meeting with both associations in the fall.
Mayor Weiers said there was consensus to bring the item back for consideration and adoption by
Council.

consider its position, and to provide instruction/direction to the City Attorney and City
Manager regarding Glendale's position in connection with contracts or agreements regarding
unclassified employees pursuant to A.R.S. §§ 38-431.03 (A)(1)(3)(4));
• Discussion/consultation with the City Attorney and City Manager to receive an update, to
consider its position, and to provide instruction/direction to the City Attorney and City
Manager regarding Glendale's position in connection with a contract relating to property in
