Ms. Bower read the resolution and the ordinance by title.
Mr. Williams said the subject property, approximately 1.4 acres in size, was currently utilized as
a retention basin within the Dream City Church campus. The applicant was proposing an
amendment to the General Plan designation for the subject site to Planned Commercial (PC).
Mr. Williams said the applicant was also requesting to amend the existing Community of Joy
Planned Aread Development (PAD.) Amending the PAD required a rezoning application
process. The original PAD allowed church campus-related uses. The requested amendment
would allow, by right, commercial/retail uses on the subject property, including a single
drive-thru (convenience use).
Mr. Williams said the requested rezoning (PAD amendment) and minor General Plan
Amendment were appropriate for the site and would allow for development of a
neighborhood-scale commercial/retail development. At its meeting on April 4, 2019, the
Planning Commission unanimously recommended approval of the rezoning application, subject
to the five stipulations contained in the ordinance.
Councilmember Tolmachoff clarified that there would only be one drive-thru allowed on the site.
Mr. Williams said that was correct.
Councilmember Tolmachoff said the applicant had agreed that the illuminated, north-facing wall
sign would be turned off no later than 10:00 p.m. each day.

22. ORDINANCE NO. 019-46

Mr. Williams said the proposed ordinance approved an amendment to the Planned Area
Development (PAD) zoning for the 51 Campana project, located at the northwest corner of 51st
Avenue and Bell Road. The amendment would increase the allowed number of drive-thrus from
4 to 5. He said there was a separately-approved conditional use permit (CUP) for a sixth
drive-thru. The amendment would also increase the Floor Area Ratio (FAR) from .3 to 5.3 for
lot 11 of 51; and reduce the parking requirement for Lot 11 to 1 space per 100 self-storage
units.

Mr. Williams said a neighborhood meeting was held on January 16, 2019 and was attended by
three members of the public. The concerns expressed were traffic and the increase in size of
the self-storage facility from 33,000 square feet (SF) to 59,000 SF.
Mr. Williams said the amendment was consistent with the General Plan with development
standards common to PADs. The quantity of drive-thrus reflected an extraordinary market
demand. The traffic study had indicated "adequate serviceability." At its meeting on May 2,
2019, the Planning Commission unanimously recommended approval of the request.
Vice Mayor Clark asked why five drive-thrus was acceptable for the PAD.
Mr. Williams said because of the location on Bell Road. There was an extraordinary amount of
vehicle-oriented businesses. There would not be the typical conflicts with residential
properties.
Vice Mayor Clark asked the size of the site.
Mr. Williams said it was 20.7 acres.

Mr. Williams said the proposed zoning text amendment (ZTA), initiated by Justin Schudel of
Supurb, would permit off-site delivery by medical marijuana dispensaries within the City of
Glendale. Supurb was a provider of services to the medical marijuana industry. The requested
amendment was reviewed by the Glendale Police Department (GPD) and the GPD had no
objection to approval of the text amendment.
Mr. Williams said delivery was likely occurring in the City by dispensaries located in Phoenix
and other cities. It was impractical to enforce the current delivery ban and approval would
permit Glendale dispensaries to deliver to patients. Off-site delivery would only be permissible
if the dispensary maintained and accurately practiced procedures and policies that fully
complied with Arizona statutes and rules.
Mr. Williams said the Planning Commission recommended approval on a vote of 6-1.
Councilmember Tolmachoff asked how the delivery process would work.
Jason Schudel, Supurb, said the dispensary's process was as followed:
•Verification of patient's ID and medical marijuana card
• Delivery order submitted by patient
•Verification of patient's record with State
• If approved, order was delivered by licensed employee to a residential location
• Employee again checked online Department of Health Services (DHS) system
• Employee delivered only to the verified patient
• Employee completed trip plan for each delivery and entered transaction into the DHS
system
Councilmember Malnar asked what other reasons there were for delivery beyond patient
convenience.
Mr. Schudel said it allowed the City to collect taxes for the deliveries; increased transparency
and accountability; and allowed regulation of deliveries within the City. It would also allow
Glendale businesses to be competitive.
Councilmember Malnar asked what issues or problems other cities had experienced by allowing
deliveries.
Police Chief Rick St. John was not aware of any issues or concerns from other cities.
Mayor Weiers asked if a Glendale resident ordered from a dispensary located outside the City,
where would the sales tax be collected.
Vicki Rios, Assistant City Manager, said the sales tax was collected by the city where the
dispensary was located. If it was a Glendale dispensary, regardless of where the delivery
occurred, Glendale would receive the sales tax.

A motion was made by Councilmember Ian Hugh, seconded by Councilmember Lauren
Tolmachoff to adopt Ordinance No. 019-47.
Vice Mayor Clark would not be voting in favor of the ordinance. Because of State law, the
City had to permit the sale of medical marijuana but did not have to promote it. The product
did not represent the values of many people in America.
Councilmember Malnar was not a proponent of medical marijuana mainly because of the
abuses that could occur because of loose regulations. He wanted it regulated like all other
medicines. The additional sales tax for the City would be a benefit. The compelling reason
for why he would vote in support was because of the abuses by those unregulated and
unlicensed vendors. He hoped it would help reduce such illegal activity.
Mayor Weiers said there were a lot of people who were unable to travel to a dispensary and
delivery would have a positive impact on their lives. He also wanted Glendale businesses to
be competitive.

24. ORDINANCE NO. 019-48

(DEFINITIONS AND RULES OF CONSTRUCTION), ARTICLE 5 (ZONING DISTRICT
REGULATIONS)AND ARTICLE 7 (GENERAL DEVELOPMENT STANDARDS); PROVIDING
FOR AN EFFECTIVE DATE; AND ORDERING THAT A CERTIFIED COPY OF THE

Mr. Williams said the request received by Shaine Alleman, Tiffany & Bosco, would amend the
Zoning Ordinance related to wireless communication facilities (WCF). It would add new
definitions, increase the number of districts where WCFs were allowed, and change the
approval process regarding setbacks. The amendment divided facilities into three main
categories:

•WCF, Concealed —designed to be architecturally integrated into a building
•WCF, Disguised — designed to be minimally obtrusive
•WCF, Visible — not concealed or disguised
Mr. Williams said a concealed WCF would beermitted in all zoningdistricts if it was
P
fully-integrated into the structure and would require administrative review. The disguised WCF
would be permitted in all zoning districts with a maximum height of 65 feet or 80 feet if
co-located with other carriers; required a minimum setback of 150 feet in residential areas but
could be reduced to 50 feet with a CUP; and the setback to streets and driveways was 25 feet.
The visible WCF had a maximum height of 85 feet or 15 feet higher than the building rooftop;
required a 300-foot setback from residential property; was allowed only in commercial/industrial
zones; the setback to streets and driveways was 75 feet; and no setbacks from adjoining
commercial or industrial property.
Mr. Williams said the proposal was consistent with the General Plan, allowed infrastructure in
more locations and helped mitigate the aesthetic impacts of WCFs. He said neighborhood
meetings were held in three locations throughout the City with a total of three members of the
public attending. The Planning Commission unanimously recommended approval of the
request.
Mr. Williams said the request was discussed at an earlier workshop and the applicant supported
the recommended changes to prohibit visible WCFs in C-1, C-2, Shopping Center (SC) and
Neighborhood Shopping Center (NSC) commercial districts.
Mayor Weiers opened the public hearing.

Mr. Johnson said the proposed amendment provided changes to the language in the City Code
addressing fees for implementing and enforcing backflow prevention, and pretreatment
compliance inspections. The backflow prevention program protected the public potable water
supply system. The pretreatment program protected the wastewater collection system and
processes. Staff was proposing elimination of the annual fee for both programs and reallocating
the cost to commercial and industrial water and wastewater customers. It would result in a cost
savings by streamlining administrative efforts and would eliminate confusion and
inefficiencies.

subdivision. The developer, Taylor Morrison/Arizona Inc., of the subdivision, located at 85th
Lane and Glendale Avenue, had constructed new public streets and associated improvements
within the development. The right-of-way for the streets was dedicated on the Garden Grove
Final Plat, however, a 20-foot gap existed in the 85th Lane alignment due to the relocation of an
irrigation easement. The developer had agreed to dedicate the right-of-way for the street
improvements in order for the City to maintain the street.

63rd Avenue. The developer of the new Paradise Cove subdivision, located at 6515 West
Paradise Lane, was constructing a new public water line in order to meet the domestic water
demands and fire protection requirements of the City Code for the development. A portion of the
new water line would extend from the eastern boundary of Paradise Cove approximately 125
feet to 64th Drive and would be located within the playing field of Cactus High School. Peoria
Unified School District #11 was granting the City an easement for the water line so that the City
could maintain the new water line.

Councilmember Tolmachoff reminded Cholla District residents of the Cholla District meeting on June 5th
at the Foothills Recreation and Aquatics Center from 5:30 p.m. to 7:30 p.m. The topic was Summer

Vice Mayor Clark said the grand opening of the Heroes Regional Park Library on May 18th was enjoyed
by 1,330 attendees and over 270 library cards were issued.
Vice Mayor Clark invited Yucca District residents to attend the Yucca District meeting at 6:00 p.m. on
May 30th at the Heroes Regional Park Library.
