Ms. Rios was offering an amendment to the item. She had been responsible for calculating the
amount of contingency request on behalf of the Engineering Department but had failed to
incorporate a previously Council-authorized contingency transfer that occurred in November
2018. The correct amount for the contingency transfer was $1,147,412, not the $1,308,724
indicated in the Council report.
A motion was made by Councilmember Lauren Tolmachoff, seconded by Vice Mayor Joyce
Clark to approve item 14 with an amended amount of$1,147,412.

Ms. Bower read the item by title.
Mr. Anaradian said Council was briefed on the City's Annexation Policy west of 115th Street, at a
work session in December 2018. Objectives were laid out, both at a policy level which was
approved by Council and at a staff level on how to process applications in the future.
Mr. Anaradian said the item codified both of the policies and some of the staff work that would
occur in the future to process annexation applications.
Councilmember Tolmachoff asked when Council would be made aware of annexation
applications.
Mr. Anaradian said Councilmember Tolmachoff had requested that there be a workshop
scheduled for a high-level overview of any application received. The pre-application process
would now include the high-level overview workshop. If Council wanted to green light the
annexation, the formal application process would start and Council would see a much more
thorough review of the seven criteria.

Ms. Bower read the item by title.
Vice Mayor Clark said the agreement piggy-backed on another entity and was approved twice,
probably in 2012 and then again on another date. She asked at what point did a linking
agreement became so stale that perhaps a request for proposal (RFP) might be the better option
to use.
Ms. Rios said it was the responsibility of the Finance Department and the Procurement Division
to review the request and work with the departments to determine when it was appropriate to do
a linking agreement versus when it was appropriate to do an RFP.
Ms. Rios said the Procurement Division conducted a market evaluation. A new tool had been
implemented that allowed staff to review the market nationally. Staff considered the market
price, how much it had changed over time and was it appropriate to link to the agreement.

Ms. Bower read the item by title.
Vice Mayor Clark asked why a 6-year contract with Amazon was being requested.
Ms. Rios said the contract included the ability to renew it 3 additional times for 2 years, so it was
potentially a 9-year contract with Amazon. The City spent approximately $166,000 with Amazon
over the past fiscal year. The contract would not require the City to purchase only from
Amazon. Purchases would be reviewed to determine if it was the best deal for the City each
time.
Vice Mayor Clark asked if there was any oversight over orders that were placed with Amazon.
Ms. Rios said staff would be able to see all of the purchases for the City in one place. It was the
responsibility of her staff to review all purchases and if there was discovered that a large
quantity ordered from one or multiple departments for the same item, staff would work with the
departments to see an RFP or a consolidation of purchases was in order.
Vice Mayor said, as was her habit and practice, she would be voting "no" on both items.

Mr. Williams said the Mack Glendale Industrial Project was located in Glen Harbor Business
Park. The General Plan Amendment would change the General Plan from Business Park (BP)
to a Light Industrial (M-1) designation.
Mr. Williams said the applicant was proposing the building of a 185,000 square foot industrial
building with a flexible building interior for single or multiple tenants on the 11-acre site. Public
participation letters were mailed out on August 27, 2018 but no citizen responses were received.
Mr. Williams said the property was an underutilized infill site and the owners had been working
with the Economic Development Department to try to get the project moving forward. It would
provide a building site with a variety of possibilities for industrial uses and new employers in the
City.
Mr. Williams said the item was heard by the Planning Commission on January 17, 2019,with the
recommendation for approval of both the General Plan Amendment and the rezoning request
subject to two stipulations:
1. Development shall be in substantial conformance with the applicant's development booklet
received December 27, 2018.
2. Dedication of right-of-way for the streets shall occur in conjunction with the development of
the property and street improvements are required with the development of the property
and any portion thereof.

Judge Finn said A.R.S. Sec. 28-3308 had been amended effective January 1, 2019, which
allowed courts to suspend drivers' privileges for individuals who failed to pay criminal traffic
violations. Previously, courts were only allowed to do that for individuals who failed to pay civil
traffic violations. A discrepancy had been identified where individuals who failed to pay civil
traffic fines were being assessed a default fee pursuant to Glendale City Code Sec. 13-9 but
individuals who failed to pay criminal traffic fines were not assessed the fee.
Judge Finn said the proposed ordinance would amend Section 13-9 to add a default fee for
individuals that failed to pay criminal traffic fines.

27. RESOLUTION NO. R19-18
A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY,
ARIZONA, AUTHORIZING AND DIRECTING THE ENTERING INTO OF A DEVELOPMENT
AGREEMENT WITH M-GLENDALEAVEAZ LLC.

Mr. Huggins said the proposed resolution authorized the City Manager to enter into a
development agreement regarding certain City fees between the City of Glendale and
M-GLENDALEAVEAZ, LLC otherwise known as Mack.
Mr. Huggins said initially Mack came through the normal design review process to develop its
$15 million, 183,000 square foot light industrial and manufacturing facility. During that
pre-application meeting, the development team realized that numerous infrastructure issues
plagued the infill property. The pre-existing issues were not created by Mack but would prevent
development of the site as well as parcels north of the site. Collaboration was the least
expensive and fastest method to accomplish the needed regional infrastructure and safety
improvements.
Mr. Huggins said Mack would be responsible for addressing the additional infrastructure required
at a cost of$325,000. The development agreement had no expense to the City but would result
in the City foregoing $200,000 of plan review permit and inspection fees for the issuance of a
certificate of occupancy for Mack's new facility.
Mr. Huggins said staff analyzed the benefit of the project and determined the City would receive
$282,000 in construction sales tax alone in the first year. The waiver did not include
development impact fees estimated at$178,00 which the developer agreed to pay in full.
Council had the authority to waive community development fees as an economic development
incentive upon finding that the waiver was in the best interest of the City.

28. REAPPOINTMENT OF PRESIDING CITY JUDGE ELIZABETH FINN

Ms. Bower read the item by title.
Mr. Brown said the request was to reappoint Presiding City Judge Elizabeth Finn to a two-year
term. Her current term expired March 25, 2019. Judge Finn had served as Presiding City Judge
since 2003 and was eligible for reappointment to a two-year term. The Judicial Selection
Advisory Board unanimously recommended the reappointment based on the results of her
reappointment interview, letters of recommendation, confidential survey results conducted by a
private research firm and other reappointment materials.
A motion was made by Councilmember Bart Turner, seconded by Councilmember Lauren
Tolmachoff to approve the reappointment of the Honorable Elizabeth Finn as the Presiding
City Judge for the City of Glendale for a term expiring March 25, 2021.

Mayor Weiers said it was an honor to have Judge Finn as the City's presiding judge and that
she had done an outstanding job for the City. When Judge Finn came to the City, the court
was in turmoil and she turned things around. She had been a great advocate for citizens and
the City.
REQUEST FOR FUTURE WORKSHOP AND EXECUTIVE SESSION
A motion was made by Vice Mayor Joyce Clark, seconded by Councilmember Ian Hugh to
hold a Special Budget Workshop on Tuesday, February 19, 2019 at 9:00 a.m., in City
Council Chambers and to hold the next regularly scheduled City Council Workshop on
Tuesday, February 26, 2019 at 12:30 p.m. in the City Council Chambers, to be followed by
an Executive Session pursuant to A.R.S. 38-431.03.

COUNCIL COMMENTS AND SUGGESTIONS
Councilmember Aldama announced that a third vegan restaurant had opened in the City. Casa Tierra
was a Mexican-style vegan restaurant located at 6835 North 58th Drive and would be opening sometime
in February.
Councilmember Aldama said Haus Murphy's, located at 5739 West Glendale Avenue, had started its City
Workers Appreciation Day on Fridays from 3:00 to 6:00 p.m.
Councilmember Aldama held his monthly mobile office hours on January 30, 2019. He thanked members
of the Glendale Police Department, the Transportation Department and Code Enforcement for addressing
constituents' concerns.
Councilmember Tolmachoff thanked everyone who participated in the shred event that she and
Councilmember Malnar co-hosted on February 2nd. There were four trucks to accommodate the 400
cars that dropped off 12,560 pounds of paper to be shredded.
Councilmember Bart Turner congratulated the Arizona Early Day Gas Engine and Antique Tractor
Association for its successful 29th Annual Antique Engine and Tractor Show held at Sahuaro Ranch last
weekend.
Vice Mayor Joyce Clark said her episode of"Beyond the Headlines"was presently running on Channel
11. It was everything a person would want to know about the new branch library that was under
construction. Construction was supposed to be finished in approximately a month. Once the library was
completed, there would be a grand opening celebration. She planned to hold an official Yucca District
meeting in the new library.
