HomeMy WebLinkAboutProperty #: P19-008 - 1/8/2019 OFFICIAL RECORDS OF MARICOPA COUNTY RECORDER When recorded,mail to: ADRIAN FOLATES ELECCity Clerk, City of Glendale 019 0725039,0 01 2099 12 RECORDING, 5850 West Glendale Avenue P19008-5-1-1--,N Glendale,Arizona 85301 CONVEYANCE OF EASEMENT P19-008 For Ten Dollars and other valuable consideration, I or We, BEARDSLEY OUTER LOOP LLC, an Arizona limited liability company ("Grantor"), do hereby convey to the City of Glendale, an Arizona municipal corporation("Grantee"), an easement to install, repair, operate, maintain, remove and replace if necessary a water line and appurtenances ("facilities") upon, over and under the surface of the following described property (referred to herein as the"Easement's Property"): See Attached Description, "Exhibit A" Together with the right of ingress and egress to, from, across and along the Easement Property; the right to operate, repair, replace, maintain, and remove facilities and appurtenances from said Easement Property; to add to or alter said facilities at any reasonable time within the Easement Property; and to trim or remove any trees or shrubs within the Easement Property that in the judgment of the City may interfere with the construction, operation or maintenance of said facilities. Subject to the rights granted to Grantee herein, Grantee will, at all times after doing any work in connection with this Easement, at its sole cost, restore the surface of the Easement Property to substantially the same condition as it was prior to the undertaking of such work. Grantor expressly reserves the right to the use and enjoyment of the surface of the Easement Property for any and all purposes, including right to construct or locate across the Easement Property driveways,roads, walkways, and sidewalks; provided, however, that such use and enjoyment does not impair or adversely impact Grantee's water line and appurtenances and any of Grantee's rights hereunder and provided prior to commencement of such construction or installation, Grantor, its successors or assigns, shall obtain the prior written approval of Grantee of the plans and specifications for such construction or installation within the Easement Property, which approval shall not be unreasonably withheld or conditioned.
