EASEMENT FOR DRAINAGE -- - ------ - --
For and in consideration of the sum of TEN DOLLARS ($10.00) DOLLARS, and other
valuable consideration, the City of Glendale, an Arizona Municipal Corporation (Grantor) does
hereby grant to the City of Peoria,an Arizona Municipal Corporation(Grantee),its successors,and
assigns, a permanent and perpetual easement for the following purposes, namely: constructing,
maintaining, operating, inspecting, repairing, replacement, of any drainage facilities consistent
therewith over, under, and across the following described Property situated in the County of
Maricopa, State of Arizona, described as follows:
(See attached description, Exhibit A, (the "Property")
To have and hold the easement unto Grantee and unto its successors and assigns forever,together
with the right of ingress and egress to permit the construction, operation, maintenance, and
replacement of drainage facilities.
And the Grantor hereby covenants that it is lawfully seized and possessed on this aforementioned
tract or parcel of land; that it has a good and lawful right to sell and convey it; and that they will
warrant the title and quiet possession thereto against the lawful claim of all persons.
The easement includes the right to cut back and trim such portion of the branches and tops of the
trees now growing or that may hereafter grow upon the above described premises, as may extend
over said easement, so as to prevent the same from interfering with the efficient maintenance and
operation of said drainage facilities.
In the event the right, privilege and easement herein granted shall be abandoned and permanently
cease to be used for the purposes herein granted,all rights herein granted shall cease and revert to
the Grantor, its successors or assigns.
Grantor, its successors or assigns, at its sole cost, shall be responsible for promptly replacing any
asphalt, landscaping, or any improvements placed on the Property by Grantor or its successors or
assigns which materially obstructs or impairs,the manner in which such storm water/surface drainage
flows at the date hereof. Grantee agrees that Grantor may use the drainage facilities constructed on
the Property for the purpose of allowing storm, flood, drainage, and other waters to pass into and
through the drainage facilities. -
Grantee shall be responsible for any damages, claims or loss occurring on the Property during the
Easement for Drainage

term of this easement caused by Grantee's negligent use of the Property or by the negligent acts of its
employees, agents, contractors or assigns.

A portion of that Tract"C", COUNTRY MEADOWS UNIT TWO, according to Book 185 of Maps, Page 39,
records of Maricopa County, being in the Northwest quarter of Section 32,Township 3 North, Range 1
East of the Gila and Salt River Base and Meridian, Maricopa County,Arizona, more particularly described
as follows:
Commencing at the Center quarter corner of said Section 32 from which the North quarter corner of said
Section 32 bears North 00 Degrees 00 Minutes 56 Seconds West(basis of bearing)a distance of
