Glendale Ave. Glendale, AZ MEMBERS PRESENT: Mayor Jerry Weiers, Board Member, Chair Charles Erickson, Board Member and Acting Chair City Manager Kevin Phelps, Board Member Capt. Joe Hester, Board Member STAFF PRESENT: Jim Brown, Director Human Resources and Board Secretary Nancy Mangone, Assistant City Attorney Chris DeChant, Assistant Fire Chief Vicki Moss, HR Administrator, Benefits Marcia Zientek, Human Resources Support Staff MEMERS ABSENT: Capt. Anthony Butch, Board Member Call to Order Local Fire Board Meeting Charles Erickson, Acting Chair, called to order the Local Fire Board meeting at 9:05 a.m. Review and Approval of the November 16, 2016 Local Fire Board Meeting Minutes The minutes of the November 16, 2016 Local Fire Board meeting were reviewed. Mayor Jerry Weiers moved to accept the minutes as presented. City Manager Kevin Phelps seconded the motion. The Board voted and passed the motion unanimously. Review and Approval of Application for Enrollment into the Deferred Retirement Option Plan ("D.R.O.P.") — Alex Morales, Jr. The Local Fire Board reviewed Alex Morales, Jr.'s D.R.O.P. Enrollment Application. Alex Morales, Jr., Fire Battalion Chief, has 31.822 years of credited service. He elected to participate in the D.R.O.P. on February 9, 2017. He chose to participate in the D.R.O.P. for a period of sixty (60) months. He must terminate employment with the City of Glendale Fire Department on or before February 28, 2022. Alex Morales, Jr. has been a member of the Public Safety Personnel Retirement System since February 9, 1987. The action requested of the Board is to approve the Application for Enrollment in D.R.O.P. Retirement submitted by Alex Morales, Jr., Fire Battalion Chief. Capt. Joe Hester made a motion to approve the Application for Enrollment in D.R.O.P. Retirement submitted by Alex Morales, Jr., Fire Battalion Chief. City Manager Kevin Phelps seconded the motion. The Board voted and passed the motion unanimously. Page 1 of 3 PSPRS Local Fire Board Meeting Minutes 01/25/17 Reemployment Determination — Retired Fire Captain Wayne Smith Jim Brown, Director Human Resources, stated that Wayne Smith is a retired Fire Captain from the City of Glendale. He retired from the City on August 9, 2006. Since retirement, Mr. Smith has held the following positions at the City of Glendale: Fire Battalion Chief..........................August 21, 2006 — August 31, 2008 Deputy Fire Chief............................September 1, 2008 — February 28, 2010 Public Safety Tech Services ................March 1, 2010— June 24, 2016 Fire Physical Resources ..................... June 25, 2016 — Current The Board was provided with the Job Descriptions of each of the positions held by Mr. Smith. Mr. Brown advised the Board that Arizona Revised Statutes (A.R.S.) Section 38-849 (2002-2008) applied at the time of Mr. Smith's reemployment on August 21, 2006. After discussion, Mr. Brown presented the four (4) items that the Board must acknowledge were addressed. 1. As it relates to the positions held by Mr. Smith, was Mr. Smith reemployed in the `same position" from which he retired as a Fire Captain? The Board unanimously declared `No' to this question. 2. Excluding the Fire Battalion position, did the retiree wait one (1) year from the effective date of retirement to return to work in any capacity to the same employer? The Board unanimously declared `No' to this question. 3. Excluding the Fire Battalion position, did the retiree wait 60 days from the effective date of retirement to return to work in an entry level, non -supervisory position and compete in an open competitive process? The Board unanimously declared `No' to this question. 4. Does this Board acknowledge that the City of Glendale is not responsible to pay the Alternative Contribution Rate (ACR)? The Board unanimously declared `Yes' to this question. Charles Erickson, Acting Chair, acknowledged the unanimous consensus on the four (4) items presented. Commencement of Executive Session — 9:16 a.m. Charles Erickson, Acting Chair, asked for a motion to recess the Open Session and convene into Executive Session to review and discuss the medical evaluation of one (1) new Fire person. City Manager Kevin Phelps made a motion to recess Open Session and convene into Executive Session. Capt. Joe Hester seconded the motion. Page 2 of 3 PSPRS Local Fire Board Meeting Minutes 01/25/17 Adiourned Executive Session and Reconvened into Open Session — 9:20 a.m. Charles Erickson, Acting Chair, asked for a motion to adjourn Executive Session and reconvene in Open Session. City Manager Kevin Phelps made a motion to adjourn Executive Session and to reconvene into Open Session. Capt. Joe Hester seconded the motion. Charles Erickson, Acting Chair asked for a motion to accept the one (1) application for the new Fire person. Capt. Joe Hester made a motion to accept the application of the following new Fire person into the PSPRS with any pre-existing conditions noted: Ryan Kiser City Manager Kevin Phelps seconded the motion. The Board voted and passed the motion unanimously. New Business There was no new business. Adjournment Charles Erickson, Acting Chair, asked for a motion to adjourn the meeting. Mayor Jerry Weiers made a motion to adjourn the Fire Board meeting. City Manager Kevin Phelps seconded the motion.
