Glendale Ave. Glendale, AZ MEMBERS PRESENT: Charles Erickson, Citizen Board Member and Acting Chair City Manager Kevin Phelps, Board Member Police Officer Justin Harris, Board Member Police Officer Cody Carmichael, Board Member STAFF PRESENT: Jim Brown, Director Human Resources and Board Secretary Nancy Mangone, Assistant City Attorney Michele Blanco, Police Officer Vicki Moss, HR Administrator, Benefits Marcia Zientek, Human Resources Support Staff MEMBERS ABSENT: Mayor Jerry Weiers, Board Member, Chair Call to Order - Police Board Charles Erickson, Acting Chair, called to order the Local Police Board meeting at 9:25 a.m. Review and Anbroval of the November 16. 2016 Local Police Board Meeting Minutes The minutes of the November 16, 2016 Local Police Board meeting were reviewed. City Manager Kevin Phelps moved to accept the minutes as presented. Officer Justin Harris seconded the motion. The Board voted and passed the motion unanimously. Review and Annroval of Annlication for Enrollment into the Deferred Retirement Option Plan ("D.R.O.P.") — Charles Carroll Buffington The Local Police Board reviewed Charles Carroll Buffington's D.R.O.P. Enrollment Application. Charles Carroll Buffington, Police Officer, has 20.292 years of credited service. He elected to participate in the D.R.O.P. on December 31, 2016. He must terminate employment with the City of Glendale Police Department on or before December 31, 2021. He has been a member of the Glendale Police Department since September 16, 1996. The action requested of the Board is to approve the Application for Enrollment into D.R.O.P. Retirement submitted by Charles Carroll Buffington, Police Officer. Officer Justin Harris moved to approve the Application for Enrollment in D.R.O.P. Retirement submitted by Charles Carroll Buffington, Police Officer. Officer Cody Carmichael seconded the motion. The motion passed unanimously. Page 1 of 6 PSPRS Local Police Board Meeting Minutes 01/25/17 Review and Approval of Application for Enrollment into the Deferred Retirement Option Plan ("D.R.O.P.") — Joseph K. Gallagher The Local Police Board reviewed Joseph K. Gallagher's D.R.O.P. Enrollment Application. Joseph K. Gallagher, Police Officer, has 23.167 years of credited service. He elected to participate in the D.R.O.P. on October 1, 2016. He must terminate employment with the City of Glendale Police Department on or before October 31, 2021 He has been a member of the Glendale Police Department since August 2, 1993. The action requested of the Board is to approve the Application for Enrollment into D.R.O.P. Retirement submitted by Joseph K. Gallagher, Police Officer. Officer Justin Harris moved to approve the Application for Enrollment in D.R.O.P. Retirement submitted by Joseph K. Gallagher, Police Officer. Officer Cody Carmichael seconded the motion. The motion passed unanimously. Review and Approval of Application for Retirement from the Deferred Retirement Option Plan ("D.R.O.P.") — Glen L. Vance The Local Police Board reviewed Glen L. Vance's D.R.O.P. Retirement Application. Glen L. Vance, Police Sergeant, has elected to retire from the D.R.O.P. and terminate his employment with the Glendale Police Department on March 4, 2017. On March 28, 2012, the Local Police Board had approved an Application for Enrollment in D.R.O.P. submitted by Glen L. Vance. He had elected to participate on May 4, 2012 and at that time, he had completed 24.620 years of credited service. He was required to terminate employment with the City of Glendale Police Department on or before May 31, 2017. Glen L. Vance is eligible to retire from the D.R.O.P. and to receive a Lump Sum distribution. He will begin receiving his normal retirement pension on or about April 30, 2017. The action requested of the Board is to approve the Application for Retirement from the D.R.O.P. and Lump Sum distribution for Glen L. Vance, Police Sergeant. Charles Erickson, Acting Chair, asked for a motion to approve the Application for Retirement from the Deferred Retirement Option Plan (D.R.O.P.). Officer Justin Harris moved to approve the Application for Retirement from the D.R.O.P. submitted by Glen L. Vance, Police Sergeant. Officer Cody Carmichael seconded the motion. The Board voted and passed the motion unanimously. Reemployment Determination — Retired Police Sergeant Mark Durham Jim Brown, Director Human Resources, stated that Mark Durham is a retired Police Sergeant from the City of Glendale. He retired from the City on June 30, 2006. Since retirement, Mr. Durham has held the following positions at the City of Glendale: Temporary Property Evidence..............July 1, 2006 — February 28, 2008 Police Property/Property Evidence ......... March 1, 2008 — July 1, 2014 Temporary General Clerical ...............February 10, 2015 — April 15, 2016 The Board was provided with the Job Descriptions of each of the positions held by Mr. Durham. Mr. Brown advised the Board that Arizona Revised Statutes (A.R.S.) Section 38-849 (2002-2008) applied at the time of Mr. Durham's reemployment on July 1, 2006. After discussion, Mr. Brown presented the four (4) items that the Board must acknowledge were addressed. Page 2 of 6 PSPRS Local Police Board Meeting Minutes 01/25/17 1. As it relates to the positions held by Mr. Durham, was Mr. Durham reemployed in the `same position" from which he retired as a Police Sergeant? The Board unanimously declared `No' to this question. 2. Excluding the Temporary Property Evidence position, did the retiree wait one (1) year from the effective date of retirement to return to work in any capacity to the same employer? The Board unanimously declared `Yes' to this question. 3. Excluding the Temporary Property Evidence position, did the retiree wait 60 days from the effective date of retirement to return to work in an entry level, non -supervisory position and compete in an open competitive process? The Board unanimously declared `Yes' to this question. 4. Does this Board acknowledge that the City of Glendale is not responsible to pay the Alternative Contribution Rate (ACR)? The Board unanimously declared `Yes' to this question. Charles Erickson, Acting Chair, acknowledged the unanimous consensus on the four (4) items presented. Reemployment Determination — Retired Police Officer Robert Gustafson Jim Brown, Director Human Resources, stated that Robert Gustafson is a retired Police Officer from the City of Glendale. He retired from the City on July 30, 2008. Since retirement, Mr. Gustafson has held the following positions at the City of Glendale: Police Reserve Volunteer .........................July 31, 2008 — September 30, 2008 Temporary Stadium Police Event Staff......... September 21, 2009 — August 27, 2010 Temporary Security ........................... ..August 28, 2010 — May 4, 2012 Temporary General Evidence Clerk..............May 5, 2012 — July 12, 2014 Police Property/Evidence Custodian .............July 14, 2014 - Current The Board was provided with the Job Descriptions of each of the positions held by Mr. Gustafson. Mr. Brown advised the Board that Arizona Revised Statutes (A.R.S.) Section 38-849 (2002-2008) applied at the time of Mr. Gustafson's reemployment on July 31, 2008. After discussion, Mr. Brown presented the four (4) items that the Board must acknowledge were addressed. As it relates to the positions held by Mr. Gustafson, was Mr. Gustafson reemployed in the `same position" from which he retired as a Police Officer? The Board unanimously declared `Yes' to this question. Charles Erickson, Acting Chair, acknowledged the unanimous consensus on the four (4) items presented. Jim Brown, Director Human Resources, stated that Peter Gutierrez is a retired Police Sergeant from the City of Goodyear. He retired from the City of Goodyear on May 1, 2013. Mr. Gutierrez was subsequently hired by the City of Glendale as a Police Community Services Officer on November 28, 2016. The Board was provided with the Job Description of the position held by Mr. Gutierrez Mr. Brown advised that: In accordance to the Arizona Revised Statute Section 38-849, if a retiree is hired by a DIFFERENT PSPRS employer (not the same employer from which they retired), the new/hiring local board MUST review thefollowing: 1. Did Mr. Gutierrez retire (Normal or Disability) from their former PSPRS employer? The Board unanimously declared `Yes' to this question. 2. Is Mr. Gutierrez hired into a covered Non-PSPRS covered position? The Board unanimously declared `Yes' to this question. 3. Does this Board acknowledge that the City of Glendale is not responsible to pay the Alternative Contribution Rate (ACR)? The Board unanimously declared `Yes' to this question. Charles Erickson, Acting Chair, acknowledged the unanimous consensus on the three (3) items presented. Page 4 of 6 PSPRS Local Police Board Meeting Minutes 01/25/17 Reemployment Determination — Retired Police Officer Bruce Lowe Jim Brown, Director Human Resources, stated that Bruce Lowe is a retired Police Officer from the City of Glendale. He retired from the City on June 23, 2006. He was subsequently rehired by the City as a Management Aide in the Police Department on June 26, 2006 — October 29, 2016. The Board was provided with the Job Description of the position held by Mr. Lowe. Mr. Brown advised the Board that Arizona Revised Statutes (A.R.S.) Section 38-849 (2002-2008) applied at the time of Mr. Lowe's reemployment on June 26, 2006. After discussion, Mr. Brown presented the one (1) item that the Board must acknowledge was addressed. 1. Was Mr. Lowe reemployed in the `same position" from which he retired as a Police Officer? The Board unanimously declared `No' to this question. Charles Erickson, Acting Chair, acknowledged the unanimous consensus on the one (1) item presented. Commencement of Executive Session — 9:50 a.m. Charles Erickson, Acting Chair, asked for a motion to enter into Executive Session. Officer Justin Harris made the motion and Officer Cody Carmichael seconded the motion. The motion was unanimous. Review and Consider Acceptance of Four (4) New Police Personnel into the Public Safety Personnel Retirement System (PSPRS) The Board reviewed the medical evaluations submitted for the four (4) new Police Personnel. Adjourn Executive Session — 9:55 a.m. Charles Erickson, Acting Chair, asked for a motion to adjourn Executive Session and reconvene in Open Session. Officer Justin Harris made the motion and Officer Cody Carmichael seconded the motion. The motion was unanimous. Consider and Vote on Adminssion of Four (4) New Police Personnel for Membership into the PSPRS with Any Pre -Existing Conditions Noted Police Officer Michele Blanco stated for the record that the following new Police personnel met the standards of the Glendale Police Department and the Arizona Peace Officer Standards and ;Training Board: Casey Philip Barnes Miguel Edward Sauceda Joel Anthony Hanson Lamyaa Samier Terrell Page 5 of 6 PSPRS Local Police Board Meeting Minutes 01/25/17 Charles Erickson, Acting Chair, asked for a motion to accept the four (4) applications for the new Police personnel. Officer Justin Harris made a motion to accept the following new Police personnel in the PSPRS with any pre-existing conditions noted: Casey Philip Barnes Joel Anthony Hanson Miguel Edward Sauceda Lamyaa Samier Terrell Officer Cody Carmichael seconded the motion. The Board voted and passed the motion unanimously. New Business There was no new business. Adiournment Charles Erickson, Acting Chair, asked for a motion to adjourn the meeting. Officer Justin Harris made a motion to adjourn the meeting. Officer Cody Carmichael seconded the motion.
