AZ Mayor Jerry Weiers, Board Member, Chair Charles Erickson, Citizen Board Member and Acting Chair City Manager Kevin Phelps, Board Member Police Officer Justin Harris, Board Member Jim Brown, Director Human Resources and Board Secretary Nick DiPiazza, Deputy City Attorney Michele Blanco, Police Officer Vicki Moss, HR Administrator, Benefits Marcia Zientek, Human Resources Support Staff Police Offrcer Cody Carmichael, Board Member Call to Order- Police Board Charles Erickson, Acting Chair, called to order the Local Police Board meeting at 9:35 a.m. Review and Annroval of the October 26.2016 Local Police Board Meetine Minutes The minutes of the October 26,2016 Local Police Board meeting were reviewed. Officer Justin Hanis moved to accept the minutes as presented. Mayor Jerry Weiers seconded the motion. The Board voted and passed the motion unanimously. Distribution of the June 30.2015 Annual Actuarial Valuation of Members for Glendale Police Covered Bv the PSPRS Charles Erickson, Acting Chair, acknowledged that the board members received, in their board books, the June 30,2015 Annual Actuarial Valuation report of Glendale Police covered by the PSPRS. Review and Approval of Aoplication for Enrollment into the Deferred Retirement Option Plan ("D.R.O.P.") - Alan B. Combs The Local Police Board reviewed Alan B. Combs' D.R.O.P. Enrollment Application. Alan B. Combs, Police Officer, has 25.503 years of credited service. He has elected to participate in the D.R.O.P. on December 31, 2016. He chose to participate in the D.R.O.P. for a period of sixty (60) months. He must terminate employment with the City of Glendale Police Department on or before December 31,2021. He has been a member of the Glendale Police Deparfinent since July l, 1991. The action requested of the Board is to approve the Application for Enrollment into D.R.O.P. Retirement submitted by Alan B. Combs, Police Officer. Page I ofS PSPRS Local Police Board Meeting Minutes n^61t6 Officer Justin Hanis moved to approve the Application for Enrollment in D.R.O.P. Retirement submitted by Alan B. Combs, Police Officer. City Manager Kevin Phelps seconded the motion. The motion passed unanimously. Reemplovment Determination for Eieht (8) Retired Police Personnel Jim Brown, Board Secretary, advised the Board that there are eight (8) retroactive reemployment determinations to be reviewed by the Board for retired Police personnel. These people retired from their Police positions and were subsequently rehired by the city into another position. The Board will need to determine if the personnel were rehired in the 'same position' as the one from which they retired. Seven (7) of the personnel would fall under the A.R.S. Section $33-849 D (2002-2008) state statute and one (l) would fall under A.R.S. Section $33-849 E (2016). Board members were given copies of the job descriptions for both the position they held in the Police Department before retiring and the position they were rehired into by the City. Mr. Brown then acknowledged each of the eight retired Police personnel and their positions. Reemplovment Determination - Retired Police Oflicer John Burns The Board reviewed the Reemployment Determination of John Burns in accordance with A.R.S. $38-849 D (2002-2008). Retired Police Officer John Burns was rehired by the City to the position of Management Aide on June 26,2006. The Board is required review the job descriptions for both Police Officer and Management Aide and to respond to the statute questions with regard to his reemployment by the City. Reemplovment Determination - Retired Police Ollicer Mark Campbell The Board reviewed the Reemployment Determination of Mark Campbell in accordance with A.R.S. $38-849 D (2002-2003). Retired Police Sergeant Mark Campbell was rehired by the City to the position of Police Technical Services Manager on January 9,2006. The Board is required to review the job descriptions for both Police Officer and Police Technical Services Manager and to respond to the statute questions with regard to his reemployment by the City. Reemployment Determination - Retired Police Ollicer Robert Gustafson Jim Brown, Board Secretary, requested that the Board table this Reemployment Determination of retired Police Officer Robert Gustafson who was rehired by the City to the position of Police Reserve Volunteer on July 31, 2008. Mr. Brown would like to provide additional information to the Board so that they will have all documents needed to respond to the statute questions with regard to Mr. Gustafson's reemployment by the City. Charles Erickson, Acting Chair, asked for a motion to table the Reemployment Determination of retired Police Offrcer Robert Gustafson. Officer Justin Hanis made the motion to table the Reemployment Determination of retired Police Offrcer Robert Gustafson. City Manager Kevin Phelps seconded the motion. The motion passed unanimously. Page 2 of5 PSPRS Local Police Board Meeting Minutes lt/t6l16 Reemplovment Determination - Retired Police Officer Georse Ybarra The Board reviewed the Reemployment Determination of George Ybarra in accordance with A.R.S. $38-849 D (2002-2008). Retired Police Officer George Ybana was rehired by the City to the position of Police Aide on August 7, 2006. The Board is required to review the job descriptions for both Police Officer and Police Aide and to respond to the statute questions with regard to his reemployment by the City. Reemplovment Determination - Retired Police Oflicer Michael Robbins The Board reviewed the Reemployment Determination of Michael Robbins in accordance with A.R.S. $38- 849 D (2002-2008). Retired Police Officer Michael Robbins was rehired by the City to the position of Auto Theft Case Manager on April 6, 2007. The Board is required to review the job descriptions for both Police Officer and Auto Theft Case Manager and to respond to the statute questions with regard to his reemployment by the City. Reemplovment Determination - Retired Police Sereeant Mark Smith The Board reviewed the Reemployment Determination of Mark Smith in accordance with A.R.S. $38-849 D (2002-2008). Retired Police Sergeant Mark Smith was rehired by the City to the position of Security Services Coordinator on September 17, 2007. The Board is required to review the job descriptions provided for both Police Sergeant and Security Services Coordinator and to respond to the statute questions with regard to his reemployment by the City. The Board reviewed the Reemployment Determination of James Trammell, Jr. in accordance with A.R.S. $38- 849 D. Retired Police Sergeant James Trammell, Jr. was rehired by the City to the position of Code Compliance Inspector on April l,2OO2. The Board is required to review the job descriptions provided for both Police Sergeant and Code Compliance Inspector and to respond to the statute questions with regard to his reemployment by the City. Consider and Vote on the Reemnlovment Determination for Six (6) Retired Police Personnel Charles Erickson, Acting Chair, asked for a motion on the Reemployment Determinations of the six (6) Police personnel covered under the A.R.S. $38-849 D statute. Excluding the one (l) reemployment that was tabled, the Board reviewed the remaining six (6) positions held before retirement and the positions in which they were rehired. The Board must determine if the employee was reemployed in the 'same position' from which they retired. City Manager Kevin Phelps made a motion that John Burns, Mark Campbell, George Ybana, Michael Robbins, Mark Smith and James Trammel, Jr. were not reemployed in the 'same position' from which they retired. Officer Justin Harris seconded the motion. The motion passed unanimously. Reemplovment Determination - Retired Police Ollicer Christonher Krvstek The Board reviewed the Reemployment Determination of Christopher Krystek in accordance with A.R.S. $38- 849 E (2016) which is a revised statute from the previous A.R.S. $38-849 D covering the earlier reemployments. Retired Police Offrcer Christopher Krystek was rehired by the City to the position of Security Officer on September 19, 2016. Under the revised statute, the Board is required to determine if there was a sixty (60) day waiting period between Mr. Krystek's retirement and his reemployment by the City. Mr. I3ystek retired on July 3,2014 and was rehired on September 19, 2016. Also, the Board must determine if there was a preexisting agreement to rehire Mr. Krystek. The Board must also review the job descriptions for Page 3 of5 PSPRS Local Police Board Meeting Minutes lln6n6 both police Officer and Security Officer and to respond to the statute questions with regard to his reemployment by the City. Mr. Brown advised the Board, in regards to the question of any preexisting agreement, that the Human Resources Department had no record of any such agreement. Charles Erickson, Acting Chair, asked for a motion to accept the reemployment determination of retired Police Officer Christopher Krystek to the City of Glendale in accordance with A.R.S. $38-849 E. Officer Justin Hanis made the motion to accept the reemployment determination of retired Police Officer Christopher Krystek. City Manager Kevin Phelps seconded the motion. The motion passed unanimously. Commencement of Executive Session - 9:55 a.m. Charles Erickson, Acting Chair, asked for a motion to enter into Executive Session. Offrcer Justin Haris made the motion and City Manager Kevin Phelps seconded the motion. The motion was unanimous. Review and Consider Accentance of One (l) New Police Person into the Public Safetv Personnel Retirement Svstem (PSPRS) The Board reviewed the medical evaluation submitted for the one (l) new Police Person. Adiourn Executive Session - 9:58 a.m. Charles Erickson, Acting Chair, asked for a motion to adjourn Executive Session and reconvene in Open Session. City Manager Kevin Phelps made the motion and Officer Justin Hanis seconded the motion. The motion was unanimous. Consider and Vote on Adminssion of One (l) New Police Person for Membership into the PSPRS with Anv Pre-Existine Conditions Noted Police Offrcer Michele Blanco stated for the record that the following new Police person met the standards of the Glendale Police Department and the Arizona Peace Officer Standards and Training Board: Marcus James Rentrope Officer JuStin Hanis made a motion to accept the application of the following Police person into the PSPRS with any pre-existing conditions noted: Marcus James Rentrope City Manager Kevin Phelps seconded the motion. The Board voted and passed the motion unanimously. New Business There was no new business.
