Steve Einstnan, a Sahuaro Distict resident, said he had spoken with straff about the
eondition of lhe sbeets, but was toH the City did nol have enough manpo^,€r. He asked
Councilto look into the bsue.
Andrew Manrick. a Phoenix resident spoke about the Coyotes and the transportation
issues with the new stadium chosen. He said it was easier to gtst to Glendale for games
than the proposed new site. The Coyotes could also move to Canada as therc were
several stadiums that would meet their needs.
Bill Demski, a Sahuaro District resident, spoke about his concEms wi0r the prolbssional
standards unit of the Polioe Deparment. He described seraEral incidenb he had while
titJittg his bike and his interaclions with Glendale police offiers. He had oontraded the
Justice Department.
James Deibler, a Phoenix resident, spoke about an article In the Glendale Star about
chickens. He said chickens caused people to g€t sick and Council should do itts
research bebre approving cfrickens.

minutes be amended as bllored: 'Councilmember Tumer was anxious to reset and
repair the elationship that had been damaged in the past. He expressed conoem about
the short amount of time the public had been aware of the issue and it had made it
difficult br him to oontaci members of the community and stafi who might provide input.

He supported the improvements noted in the agreement, but was concemed about the
loes of control over the City's parking lots. Councilmember Tumer said fie agr€ement
was not dear about hor parking decisions would be made. He was conoerned hor the
agreement would afieci the City's other parhers in fie area, induding the arena
managem€nt firm and tlVestgate management. He would like more time to study the
agrcgment and sharc any concgms and receive input. Councilmember Tumer also
express€d @ncems this agreement could possibly diminish the value of our arena and
qeate difficrllties with it in the ftrture. Councilmember Tumer also said that wh€n he was
swom Into offce, he pledged to support the state consfMion, not subvert it.

Mr. Froke sakl he proposal was br en 18-lot subdivision in an ar€a that was fimarily
residential and wifi development of this lot, the gap in the semi+egional equestian trail
on 51st Avenue would be filled. There was a single point of accestt to addr€ss headllght
issues and the applicant had agrced to limit Lot 16 to a single-story out of concem for the
existing neQhborhood to the north. The Planning Commission unanimously
recommended approval of the general plan amendment and the zoning case.

Mr. Froke said there was no defined trail cunenfly from the south prope@ line to the
norfi prop€rty line of fie lot. The developer would complete the trail br equestrian use.
Councilmember Malnar asked about the bedback received from the nephborhoods
sunounding the proiect.
Mr. Froke said questions conerned the size of the lots and density. The proleci was
very oornparable to the neighborhood to the north. There was oonoem about haMng only
two-story homes so the developer had addressed the conoem by requirirB a single-story
home on the lot that bordered the rrighborhood to the north of the projecl.
Councilmember Malnar asked if there was any opposition to the prciect.
Mr. Froke said there was not.
Councilmember Tolmachoff had attended the neighborhood meetings for the prc{ect and
the main @noem was that there be no two-story homes backing up to the neighbortDod
tothe north.
MayortAleiers opened the public hearing on GPA 16{.4 and ZON 1S03.
Jane McBrirJe, a Cholla Disfict resident, thanked the developer and Planning stafi br the
considerations given to the neBhborhood. She wanted clarification for the proposed
drainage for rain water and watering of playground and common areas. The new home
site elevation was much hpher than the propeQ to the north. She had spent over
$40,000 in repairs b€caus€ of drainage assues at her property.

Mr. Froke said the request was to rezone the northem portion of the site located at 11401
W. Glendale Avenue to establlsh a special use districl and to r€zone 99 acres on the
south portion of the site to amend tp special use districl, which was approved in
ZON13-05 by Council in 2013. Mr. FrokE said it would also add five additional years to
the length of the temporary land use. The site was located on the south side of Glendale
Avenue and west of Glen Ha6or Blvd.
Mr. Froke said the SUD alloupd mining and exlractbn of sand and gravel to 2028.
initial Council approval, there had been sand and gravel operations at lhe location.
SUD had not caused any issues to the operation of Glendale Municipal Airport, nor
nearby mining operations located in Maricopa County. In October 2016, the Planning
Commiseion unanimously recommended approval of ZON16-05, subiect to fiw
stipulations. Staff recommended approval of the ordinanoe, subiect to fte five
stipulations.
Councilmember Malnar asked what the options were br the land nert to the airport over
the nerl twenty yeaF.
Mr. Froke explained that some of the revenues ftom the sand and gravel operation would
help develop Coppenrving for industrial use along Glendale Avenue.
Stephen Anderson, John F. Long Properties, said the land was near two rivea and the
soil in the area was ideal br sand and gralel operations, but not suitable br construqlion.
The sand and gravel operation would emove the problems from the soil. The company
was required to reclaim the soil as it moved fonrard wih its operation. lt made the soil
suitable br construciion over a penod of time. They had approval br a project knolvn as
Coppendng, whicfi was a business park. Once the sand and gravel operation was
completed in about 20 yeaa, hey would move fonrard to complete approval for the rest of
the Copperwing p@ect

SASO to condud businesses at the airport that were already adopted by Council. The
agreement incorporated all the required FM language and comments provided by Rlsk
Management and Aiport administration. The SASO would allor aviation businesses to
ofier their seMoes quickly and provide revenue to fie Airport.
Mr. Friedline said thee were cunently fiw SASOs on site. They paid bes, but there
$,ere no formal agreements in plaoe. Thg Master Agreement template would ensure
cooperative relationshipe, reduoe the amount of time ngcagsary to sign new agreements,
enoourage new businesses and ensue hsinesses had propgr assurancgs. The
agreement was approved by the Aviation Advisory Commission in August of 2016.

Mr. Brorun said the proposed odinane would amend Chapter 2, Artlcle Vlll, Division 5 of
fte Ctty Code by renamang the Commission on Pesons with Disabilities to a Diversity
Commission, expanding its duties and setting br0t an efiective date. Benchmark cities
had committees that were similar in purpose, struc{ure and fundion. Council determined
this commission should be advisory in nature and should rcview policies related to
diwrsity and advise the Council. The commission should also be able to hold a public
brum in which citizens and stakeholders oould be heard and inbrmation presented to the
cornmission could be presented to the Council. Stafi met with the Commiseion on
Persons with Disabilities and hey wer€ agr€eable to transbrming their commission into a
Diversity Commission that would address the conoems of lhe disabled and other
protec'ted and dilerse classes in GlEndale.
Councilmember Aldama made a motion, seconded by Councilmember Tumer, to approve
Ordinane No.3022.
Councilmember Tolmachoff was conoErned there was nothing that specified members of
the subcommittees had to be Glendale residents. She blt the subcornmitteee should be
made up of commission members.
Councilmember Malnar had a similar concem. He asked if all commissions had
subcommittees and wanted to knor if they were members at la6e.

Mr. Brorn was not familiar witr the suboommittee structures of the other oommissions.
Councilmember Malnar propoeed removing subsection E ftom the Ordinanoe. This was
seconded by MoE Mayor Hugh. He said it was a 14-mEmber committee and the
language was not specific that the members had to be Glendale reskJenb. He
suggested using the language, 'any resirlent of Glendale.' He said a oommittee with 14
members was laqe enough to fill subcornmittees and should be members of the
committee. He suggested changing the language to'any member of the committee."
Councilmember Malnar disfributed an amendment he had prepared.
Mr. Phelps said it was not un@mmon br subcommitteeg to acl an an ad hoc manner.
He exptained lhere were times when the oommittee mlght need outside expertise and it
would give the committee an oppofiunity to us€ experts who could participatE in an
advisory role. He sakt it could provide more flexibility for the committee, but thotght il
could work both ways.
Mayor tadeiers asked CouncilmembEr Malnar af that was difierent than what he was
proposing.
Councilmember Malnar said it was.
MayorlAleiers asked if he had language prepared regarding his questions.
CouncilmEmber Malnar said he had prepared two options.
Councilmember Tolmachofi saH there was nohing to prevent a subcommittee fiom
reaching out to other oommunaty members for input. She blt the language was vague
and too general. She said committee members should be Glendale residents. She said
Council could ahrays amend the ordinance in the firture, if necessary.
Mayor lA/eiers asked Councilmember Malnar if oopies were given to the City Attomey.
Councilmember Malnar provided copies to the CiU Attorney. He said thE first option was
to make any Glendale resident interest€d eligible to be appointed to the subcommattee.
He was not combrtable opening he committees up to non{esidents. The second option
was to allow only members of the commission to be members of he subommifiees.
Councilmember Aldama asked af staff put that lenguage in the ordinance. He asked if
stafiwas trying to eliminate research time.
Mr. Brorn said subcommittees was discussed in previous Council gessions and this was
put in to give the committee flexibility. He said not all members of the Diversity
Gommission were requir€d to be resldents. They could be employers, members of the
education system or Glendale residents.
Councilmember Aldama sairj commission members should be Glendale Fsidents and he
could see the commission going outside to obtain information. He would bel more
comfoilable to give it to straff to research.
Councilmember Tolmachoff sail the ordlnance stated that the commassion would be
compoeed of 14 members who would be reskjents of Glendale.

Councilmember Tolmachoff said she would be most oomfortable with commission
members forming subcornmittees. She said if commission members wanted to expand
to more than 14 members at some point in the future, Council could discuss it.
Mayor \Abiers clarifed the hardouts provided by Councilmember Malnar. The handout
that stated Glendale residenb would be handout B and the otherwould be handoutA.
Councilmember Malnar agreed with Councilmember Tolmachoff. His prebrence wag
handout A, which changed the language to say any commission member may be
appointed as a member of the subcornmitbe and membea of the subcommittee may be
appointed by the commission. Each subcommittee may be chaired by a member who
shall be appointed by the chairperson of the commission. The suboommittee shall have
no authority to act independent of the commission.
Mr. Gruber said it sounded like the direction was to limit the subcommiilee members to
members of the commission. He suggested replacing the word "any' wt[t the word
'only', so only commission members may be appointed as members of the
subcommittee to avoid any doubt.
Councilmember Malnar apprcved of the change. Councilmember Malnar wanted to make
a motion on handout A, whicfr was limifing the subcommittee members to membea of
the commission.
Councilmember Tumer sakl there was a motion on the floor alroady that had been
seconded that needed to be withdrawn.
Councilmember Malnar sairj this would be a substitute motion to amend the proposed
ordinance.
Mayor lAbiers asked Councilmember Aldama if he was cornbrtable amending his motion.
CouncilmemberAldama said he was not oomfortrable amending his motion.
Mr. Gruber recommended withdrawing the orpinal motion.

Councilmember Malnar distibuted an additional amendment (handout C). He said the
amendment was to seciion 2-313, Porers and Duties. The language as written, was an
attempt to include people that might not need to be included and there would be an
exclusion of people under the proposed ordinance. He had looked at Mesa's and
Scottsdale's ordinances and liked the wording in fie ScotMale ordinanoe. He would like
to replace the languagp to read that under Pouprs and Duties, the "oommission will
advocate and promote all dimensions of diversity. The commission will acl as an
advisory bo<ly to the Mayor, Gity Council, strafi, and to make recornmendations on ways
to en@uftUe mutual respec{ and undeatanding among all people, to dFcourage
preiudice and discrimination and to work tonard cultural alvareness and unity." He said
that wording strated what Council wanted wifiout gening into dasses proteded by O|€
bderal govemment, and oovered everyone without leaving anyone out.
Councilmember Aldama said the issue was gcing sldarays and he made a motion,
seconded by Councilmember Tumer, to appove Ordinanoe No. 3022 as presented.
Councilmember Malnar made a substitute motion, seconded by Vice Mayor Hugh, to
substitute the language he read in handout C, for in the language of the proposed
odinanca as it was preented.
Mayor lAleiers said Council would vote on Courrilmember Malnar's motion first and
asked if there was discussion on the motion.
Councilmember Tolmachoff said in seclion E, Councilmember Malnar was changing the
language to only oommission members willserve in subcommittees.
Councilmember Malnar said that was conect.
Councilmember Tolmachofi said th€ other change requested was to eliminate a list of
people and using the replacement language that Councilmember Malnar read.
Councilmember Malnar said instead of putting specific aroups and identifying them, he
wanted to be totally inclusive by using broader language.

bderally protected classes and that was why he blt Council should keep the broader
language. He said the motion was to amend the ordinance to replace section E with fte

said it was the very first opportunity he had to disars he item. Many times City
Councils dk n't debate, discnss issues or put their viewpoints on fie trable. He said his
changes gave the City a commission and would helpthem move bnrard as a City.
Councilmember Tumer was still confused as to whether Council had a substiMe motion
or amendments to what was pres€nted. He said inooporatirq these changes was a
clumsy way to do it and voting on the motions separately was amending the main
motion.
Councilmember Malnar said he agreed with that.
Councilmember Tumer asked if Council had loot track of whether this was a subetitute
motion or an amendmgnt to the motion.

or a disabled status.
Councilmember Tolmachoff said disabled was there twioe and she was unsure if it was
supposed to be written that way. She said after reading it twice, she now undeatood
what Councilmember Malnar was saying. By making a list, they might leave someone off
the list
Councilmember Aldama did not uMerstrand horr Council could not acoept representing
individuals that might be in a specific categpry and just adding the words 'all people' to it.
He said either Council was embanaseed by it or Counciljust didn't want to be a part of it.
He sald simply adding in 'all people' would cover everyon€, including those on the list.
That list of persons was who Council wanted to take cale of and represent.
Councilmember Malnar said Council was putting people into a proteded class whicfr they
tvere not bderally protec{ed in. He asked if Council wented to start having protected
classes and bdnging that lo the City. l-le didn't wanl to single out any groups
specifically. He said th€ City should be open and promoting diraaity to all people. He
said diversity was br all people.
Councilmember Aldama asked if Councilmember Malnar dirint want to support disabled
veterans. He said the Ci$ wanted to support thos€ prot€cled individuals and that was
what they were doing. He said again to add the words "all people'to the language.

wanted a committee to promote diversity and dadn't think either version of the suggested
language would prohibit the Council from doing that.
Councilmember Tumer asked if Mr. Brown knew about the issue.
Mr. Brovvn sakJ outsile organizations looked to see if the City had a diversity commission
and other types of ordinances in plaoe. He wasnt sure of any specific language that
would be required.

accomplished the goal Council set out to do. He said there were people who were not on
