PLEDGE OF ALTEGIANCE CITIZENCOMMENTS Robert Heidt, Presklent and CEO of the Glendale Chamber of Commerce, encouraged the Council to support the eettlement. He eaid working with the Arizona Cardinals would foster oontinuing good relationships. Tom Sadl€r, Presklent and CEO of the Arizona Sports and Tourism Authority, enoouraged the Courcil to support the settlement. He wanted to s6e all the parties on the same pagp and working as a team. Joyce Clark, Councilmember-Elect of the Yucca Disfrict, urged the Council to support the settlement. The agreement would resolw sewral issues, including Ste $67 million daim ontstanding against Ute Ctty. The proposed underpass rvould resolrae sorne of the traffic issues that $rere oubtanding and the 95th A\renue alignment would be set She said it was not a perbct deal but would resolve many oubtanding issues. Micfiael Bidwell. President of the Arizona Cadinals Football Club, said commitrnents u,€r€ made many years ago and there had been a shortfall of parking over the last br years. After bdnging Mr. Phelps on board as Crty Manager, there was a push to solve many of Up CiU's oubtanding disagreements. He said the agreement gave oertainty ttat the parties uare working toge0pr to protecl the stadium and support the mega e\€nts. Bailey, City Attomey Mr. Bailey sakl he Council had the setflement agreement wtth the Arizona Cardinals and Arizona Sporb and Tourism Authority bebre them and had been briebd as to the merits of the agreement. He explained it was a settlement of all daims regarding pailing associat€d with the University of Phoenix Stadium. Gary Shenrood, a Sahuam Districl resident, said posting the meeting only one business day before ttp scheduled meeting precluded public participation on the issue. He rvent o\ler the history of the issue and terms of the previous agr€ement He was unsur€ what the breacfi of the conhact entail€d because fie Crty had spent thousands of dollars complying wih the parking agr€€ment He dit not undenrtand why the s€ttlement agr€€ment would go fonrard and the reasons had not been shared with the public. lt would wipe out any savings the City had. Councilmember Tolmadrofi asked br an explanation of the word "e\€nf from the agr€€ment Mr. Phelpo debned to Mr. Bailey br an explanation but br lhe purpoGe of the agreement, it meant any event that had a user tse and a minimum attendanoe of 40,000 people. Mr. Bailey said the term "ewnf rebrenced he parking lioerc€ and rebrenoed an attendanoe threshold and a user be. Councilmember Aldama was dFturbed that the meeting agenda was poeted right bebre a thrceday weekend and gave lhe public very litUe time to review the agreement. He was against moving e contracl of this amount in such a quick manner. He didnt bel citizens had time to speak about the issue. Councilmember Tolmacfioff made a motion, seconded by Mce Mayor Hugh, to enter into a setuement agreement wih $€ Arizona Sporb and Toudsm Auftofity, the Arizona Cardinals Football Club, LLC, he New Cardinals Stadium LLC and the Stadium Development, LLC, and approve a gerrralfund contirgency request. Councilmember Malnar said the public did deserve to know a litue about the reasoning behind the settlement. He said it dld resolve a $67 million claim filed against the Crty. lt resolved the flouv of lehiclee and people into fie stadium aM included improving 95th Avenue, which protecled the neaby neighborhoods. Final November 14,2010 Aye: A roll call vote was tiaken. Councilmember AHama said his vote had no,thing to do wiUr a rBlationship wih the Cardinals that had gorn bad. He was not sure the mertb of the daim had been completely vetted and many open€nded questions remained. Councilmember Aldama voted Nay. Councilmember Chavira agreed with Councilmember Aldama and blt Council was rushing into the agr€ement. t|e blt it would have been more approptifr to wait twp weeks until Councilmember-Elect Clark was in office beble making this big decision. Councilmember Chavira voted Nay. Councilmember Malnar said it was time for Council to move bnrard and create relationship that would help the Gity move brward. The item had been under discussion for many rrrpeks and Council was making an inbrmed decision that was in the best inter€st of the City. Councilmember Malnar voted Aye. Councilmember Tolmachofi spoke about aoquiring the Pendergast property in hopes of resolving tre issue. She said in addition to r*olving Ue parking bsues, Glendale citizens would be lefi with over 30 acres of property that could b€ dewloped in the sporB and entertrainment district to generate levenue br the City. lt was important to devebp good relationships wttr the City's business partrcrs. Councilmember Tdmadtofi voted Aye. Councilmember Tumer was anxious to res€t and r€pair the plationshaps that had been damaged in the past. l.le expressed concem about the short amount of time the p$lic had been aware of the iseue and it had made il difficult br him to contact members of the oommunity and staff who mbht provide input. tle support€d the improvements nobd in the agreement, but was conoemed about the loes of control over the city's parking lob. Councilmember Tumer said the agre€ment was not clear about hor parking decisions would be madE. He was concemed hor fie egr€ement would afiac{ the City's other partners in the area, including the arena managernent firm and llVestgate management. He would like more time to study f|€ agrgem€nt and sha]€ any concems and reoeive input. Councilmember Tumer also expessed ooncems this agreement could possibly diminish the value of our arena and create difficulties wih it in the frrture. Councilmember Tumer also said that when he was swom into offce he pledged to support the state Constitution, not subvert it. Councilmember Turner voted Nay. Vioe Mayor Hugh said this was the rlrht thing to do and supported the motion. He said building a parking garage would cost the City much more than he agr€ament. They uere saving taxpayer monoy. Mce Mayor Hugh voted Aye. Mayor tAbiers said the long-standing daspute had damaged the relationship wth the AZSTA and the Adzona Cardinals. lt was importrant to maintain a positive working relationship wih Utese partners and put the conflict behind fie City and mor,e brward.
