Glendale Ave. Glendale, AZ MEMBERS PRESENT: Mayor Jerry Weiers, Board Member, Chair Police Offrcer Cody Carmichael, Board Member Police Officer Justin Harris, Board Member Jim Brown, Human Resources Director and Board SecretarySTAFF PRESENT: Nancy Mangone, Assistant City Attorney Michele Blanco, Police Oflicer Vicki Moss, HR Administrator, Benefits MEMBERS ABSENT: Charles Erickson, Citizen Board Member Kevin Phelps, Board Member OTHER ATTEITTDEES: Police Sergeant John Rohkohl Coll to Order Mayor Jerry Weiers, Chair, called to order the Local Police Board meeting at 9:16 a.m. Review and Apnroval of the Sentember 28.2016 Local Police Board Meetine Minutes The minutes of the September 28, 2016 Local Police Board meeting were reviewed. Officer Justin Hanis moved to accept the minutes as presented. Offrcer Cody Carmichael seconded the motion. The Board voted and passed the motion unanimously. Review and Annroval of Annlication for Retirement from the Deferred Retirement Ontion Plan ("D.R.O.P.') - John James Chemsak The Local Police Board reviewed John James Chemsak's D.R.O.P. Retirement Application. John James Chemsak, Police Oflicer, has elected to retire from the D.R.O.P. and terminate his employment with the Glendale Police Department on December 31, 2016. On January 25, 2012, the Local Police Board had approved an Application for Enrollment in D.R.O.P. submitted by John James Chemsak. He had elected to participate on January 17,2012 and at that time, he had completed 25.005 years of credited service. He was required to terminate employment with the City of Glendale Police Department on or before January 31,2017. John James Chemsak is eligible to retire from the D.R.O.P. and to receive a Lump Sum distribution. He will begin receiving his normal retirement pension on or about January 31,2017. The action requested of the Board is to approve the Application for Retirement from the D.R.O.P. and Lurnp Sum distribution for John James Chemsak, Police Offrcer. Page I of4 Mayor Jerry Weiers asked for a motion to approve the Application for Retirement from the Defened Retirement Option Plan (D.R.O.P.). Officer Justin Hanis moved to approve the Application for Retirement from the D.R.O.P. submitted by John James Chemsak, Police Officer. Officer Cody Carmichael seconded the motion. The Board voted and passed the motion unanimously. Commencement of Executive Session - 9:19 a.m. Mayor Jerry Weiers, Chair, asked for a motion to recess the Open Session and convene into Executive Session to review and discuss two (2) items. Offrcer Cody Carmichael made a motion to go into Executive Session. Officer Justin Hanis seconded it. l) Review and Consider Acceptance of Three (3) New Police Personnel into the Public Safety Personnel Retirement System (PSPRS). 2) Review and Consider the Application for Accidental Disability Retirement for One (l) Police Officer. Adiourned Executive Session and Reconvened into Open Session - 9:25 a.m. Mayor Jerry Weiers, Chair, asked for a motion to adjourn Executive Session and reconvene in Open Session to vote on the two (2) items. Offrcer Justin Hanis made a motion to adjourn Executive Session and reconvene in Open Session. Officer Cody Carmichael seconded the motion. l. Consider and Vote on the admission of three (3) new Police nersonnel into the PSPRS with anv pre-existins conditions noted on the medical evaluations. Officer Michele Blanco affirmed that the following Police personnel met the standards of the Glendale Police Department and the Arizona Peace Officer Standards and Training Board: Thomas Patrick Bowman Francisco McSperin Martinez Theadore Richard Venable Officer Justin Hanis made a motion to accept the applications of the three (3) new Police personnel into the PSPRS with any pre-existing conditions noted. Officer Cody Carmichael seconded the motion. The Board voted and passed the motion unanimously. 2. Consider and Vote on the Apnlication for Accidental Disabilitv Retirement from the Public Safetv Personnel Retirement Svstem (*PSPRS") - Korry Raffertv Kory Rafferty, a Police Officer with the City of Glendale, applied for Accidental Disability Retirement through the Public Safety Personnel Retirement System (*PSPRS") on August 9,2016. He has been a member of the PSPRS since October 3, 2005. On November 22,2005, he was accepted into the Public Safety Personnel Retirement System. At this time, Mr. Jim Brown, PSPRS Board Secretary, read the requirements of the eight (8) discussion questions that the Board was to address. This discussion would become part of the board minutes. l. Did the employee file the application after the disabling incident, or within one (l) year of ceasing to be an employee? Page2 of 4 PSPRS Local Police Board Meeting Minutes t0/26n6 3. 4. Mr. Brown stated that the facts are that Mr. Rafferty's date of his disabling event occurred on December l, 2015. He is currently on leave of absence from his position as a Police Offrcer effective August 4,2016. So the answer to this questions is'yes'. The Board reaflirmed that the answer is'yes'. 2. Did the employee terminate by reason of disability? Mr. Brown noted that, as the medical documentations confirmed, the answer to that would be'yes'. The Board reaffirmed that the answer is'yes'. Did employment terminate based on a disciplinary issue? The answer to this question is 'no'. The Board reaffirmed that the answer is 'no'. Did employment terminate based on the employee's participation in DROP? The answer to this question is 'no'. Employment was not terminated based on a DROP Enrollment. The Board reaffirmed that the answer is'no'. Is the employee still working within their job classification that the Local Board considers a reasonable range of duties? The Board confirmed that the answer is'no'. 6. Has the employee refused a job within their job classification that the Local Board considers a reasonable range of duties position? The Board confirmed that the answer is 'no'. 7. Did the injury or condition occur prior to the current PSPRS membership date which was October 3,2005? The Board confirmed that the answer is 'no'. 8. Was the injury or condition the result of an event incurred during the performance of the employee's duty? The Board confirmed that the answer to that is 'yes'. Mr. Brown stated that there are three (3) statutory questions that the Board must vote upon. l. Does Mr. Rafferty have a physical or mental condition which totally and permanently prevents him from performing a reasonable range of duties within his job classification? The Board unanimously answered'yes'. 2. Does the member's disability result from a physical or mental condition or injury that existed or occurred prior to the claimant's date of membership into the PSPRS? Was the disabling condition or injury incurred in the performance of the claimant's duty as a Police Oflicer? The Board unanimously answered'yes'. Since all the statutory questions were answered, Mayor Jerry Weiers, Chair, asked for a motion to accept Mr. Rafferty's Application for Accidental Disability Retirement. Offrcer Justin Harris made a motion to approve the Application for Accidental Disability Retirement from the Public Safety Personnel Retirement System submitted by Kory Rafferty. Officer Cody Carmichael seconded the motion. The Board unanimously approved the application. New Business There was no new business. Adiournment Mayor Jerry Weiers, Chair, asked for a motion to adjourn the meeting. Officer Justin Hanis made a motion to adjourn. Officer Cody Carmichael seconded the motion.
