Glendale Ave. Glendale,AZ MEMBERS PRESENT: Mayor Jerry Weiers, Board Member, Chair City Manager Brenda S. Fischer, Board Member Charles Erickson, Citizen Board Member and Acting Chair Capt. Mark Manor, Board Member Capt. Joe Hester, Board Member STAFF PRESENT: Jim Brown, Director Human Resources and Board Secretary Nick DiPiazza, Chief Deputy City Attorney Tim Pirtle, Deputy Fire Chief Marcia Zientek, Human Resources Support Staff Call to Order-Joint Meeting of PSPRS Fire and Police Boards Mayor Jerry Weiers called to order a joint meeting of the PSPRS Fire and Police Boards at 9:05 a.m. Open Meeting Law and Public Records Law Training Nick DiPiazza, Chief Deputy City Attorney, presented information regarding the Open Meeting Law and the Public Records Law. Mr. DiPiazza advised that this training is important as a refresher for the board members who are continuing in their role and especially important for the new board members. He provided each of the board members with a copy of his slides and gave the board information as it relates to state statutes of the Open Meeting Law and the Public Records Law. Mr. DiPiazza also specifically tailored the information as it relates to the PSPRS Local Fire and Police Boards. The 'Open Meeting Law' was explained. Included in the explanation was when and why an `Executive Session' would be called during an Open Meeting. Unintentional meetings such as the `Daisy Chain' and the 'Hub and Spoke' were defined and Mr. DiPiazza cautioned that both were violations of the Open Meeting Law. Also noted by Mr. DiPiazza were the penalties that could be assessed should a board member violate the Open Meeting Law. These penalties could include removal from office and up to $500.00 for each violation. Any assessment made is against the person and the not the public body. Mr. DiPiazza also addressed the `Public Records Law' and described what is, and what is not, a public record. He explained the duties regarding public records, the fees that may be assessed for copies of records, and the penalties for any wrongful denial of access to records. Mr. DiPiazza answered a number of questions from the board members. He offered his services to any member who may come upon an issue that they were unsure of regarding either the Open Meeting Law or the Public Records Law. He asked that they call him and he would be happy to discuss the situation. The joint meeting was adjourned at 9:50 a.m. Call to Order—Fire Board Charles Erickson, Acting Chair, called to order the Local Fire Board meeting at 9:51 a.m. Review and Approval of the September 24, 2014 Local Fire Board Meeting Minutes The minutes of the September 24, 2014 Local Fire Board meeting were reviewed. Capt. Joe Hester moved to accept the minutes as presented. Capt. Mark Manor seconded the motion. The Board voted and passed the motion unanimously. Review and Approval of Application for Retirement from the Deferred Retirement Option Plan ("D.R.O.P.")—Valeri Jo Eddings The Local Fire Board reviewed Valeri Jo Eddings' D.R.O.P. retirement application. Valeri Jo Eddings, Fire Battalion Chief, has elected to retire from the D.R.O.P. and will terminate her employment with the Glendale Fire Department on January 23, 2015. On February 24, 2010, the Local Fire Board had approved Valeri Jo Eddings into the D.R.O.P. At that time, she had completed 27.047 years of credited service. She was required to terminate employment with the City of Glendale Fire Department on or before January 30, 2015. Valeri Jo Eddings is eligible to retire from the D.R.O.P. and to receive a Lump Sum distribution. Capt. Mark Manor motioned to approve the D.R.O.P. retirement application submitted by Valeri Jo Eddings, Fire Battalion Chief Capt. Joe Hester seconded the motion. The Board voted and passed the motion unanimously. Commencement of Executive Session Charles Erickson, Acting Chair, recessed the Open Session and convened into Executive Session to review and discuss the medical evaluations of two (2) new Fire personnel. Reconvened into Open Session The Board adjourned Executive Session and reconvened into Open Session to vote on the admission of two (2) new Fire personnel into the PSPRS with any pre-existing conditions noted on the medical evaluations. Mark Manor made a motion to accept the application of the following new Fire person into the PSPRS with any pre-existing conditions noted: Donald B. Rowley City Manager Brenda S. Fischer seconded the motion. The Board voted and passed the motion unanimously. Capt. Mark Manor made a motion to accept the application of the following new Fire person into the PSPRS with any pre-existing conditions noted: Kevin S. Schneider Capt. Joe Hester seconded the motion. The Board voted and passed the motion unanimously. New Business There was no new business. Adjournment Charles Erickson, Acting Chair, asked for a motion to adjourn the meeting. City Manager Brenda S. Fischer moved to adjourn the PSPRS Fire Board meeting. Capt. Joe Hester seconded the motion.
