HomeMy WebLinkAboutAgenda Packet - Meeting Date: 10/28/2014 (35) 5850 West Glendale Avenue City of Glendale Glendale,AZ 85301 1 11 Legislation Description File #: 14-327, Version: 1 AUTHORIZATION TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH MARICOPA COUNTY FLOOD CONTROL DISTRICT FOR A RECREATION EASEMENT AT SKUNK CREEK AND BELL ROAD Staff Contact: Jack Friedline, Director, Public Works Purpose and Recommended Action This is a request for the City Council to waive reading beyond the title and adopt a resolution authorizing the City Manager to enter into an intergovernmental agreement with Maricopa County Flood Control District (MCFCD) to grant the city a non-motorized non-exclusive recreation easement at Skunk Creek and Bell Road. Background In April 2011, the construction of the Skunk Creek Multi-Use path at Bell Road was completed.The new multi- use path crosses a parcel owned by MCFCD. The city paid the easement fee of $46,131 to MCFCD during the construction phase of the project and is finalizing the process of obtaining the easement by entering into this intergovernmental agreement. This easement will allow the city access to maintain the multi-use path at this location. Analysis • Staff recommends approval of the MCFCD intergovernmental agreement granting the city a non- exclusive non-motorized recreation easement. • There will be no additional impact on city departments, staff or service levels as a result of this action. • The easement fee was paid during the construction phase of the project and there are no additional costs associated with this action. Community Benefit/Public Involvement The easement allows the city access for the maintenance and operation of the trail system in this area for the use and enjoyment of the general public for hiking, equestrian use, walking and other non-motorized uses. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GLENDALE as follows: SECTION 1. That it is deemed in the best interest of the City of Glendale and the citizens thereof that an Intergovernmental Agreement entitled "Non-Exclusive Non-Motorized Recreation Easement" with the Maricopa County Flood Control District (Permit: 2008P069) granting the City of Glendale an easement in Skunk Creek, south of the Bell Road Bridge, at approximately the 73rd Avenue alignment for the ACDC multi-use path project be entered into, which agreement is now on file in the office of the City Clerk of the City of Glendale. SECTION 2. That the Mayor or City Manager and the City Clerk be authorized and directed to execute and deliver said agreement on behalf of the City of Glendale. Page 1. of 6 2. Prior to any construction being undertaken in accordance with Paragraph 1 above, G NTEE shall submit plans for G • TOR'S approval. GRANTOR agrees to complete the review of said plans in a timely fashion and in accordance with the GRANTOR'S then applicable per it approval process. 3. This Easement is, at all times, subject to and subordinate to the rights of G • NTOR to have nnestricted access to the subject property for the purpose of operating and maintaining the flood control project within said Easement. At all times, GRANTOR shall endeavor to operate and maintain the flood control project in a ma er which will not easonably interfere with the G • TEE'S right of access to its Easement. Gi ANTEE assu nes all risk of d age to its improvements resulting from the property functioning as a flood control project except d. age that results from GRANTEE'S intentional conduct or gross negligence. 4. The rights and privileges granted herein are granted to the G • TEE only. GR &NTEE may not assign or grant these rights and privileges to any other person, except as provided herein, and may not grant any rights or privileges in the Easement greater than those granted to GRANTEE herein. GRANTEE may make no other use of the Easement without prior written per ission from the CR ANTOR. 5. The GRANTEE agrees: A.To maintain and repair the property subject to the Easement for d age caused by GRANTEE'S right to access and use the Easement, including without limitation the removal of graffiti, trash and debris from the property subject to the Easement. GRANTEE, however, is not required to maintain or repair any fixtures, structures or improvements associated with the flood control project constructed, installed, operated or maintained by GRANTOR in the Easement. B. To provide appropriate law enforcement monitoring and response activities to ensure the safety and security of persons accessing and using the property subject to the Easement. Page 2 of 6 6. In the event GRANTEE fails to comply with the terr s and conditions of this Easement, GRkNTOR may notify GRANTEE in writing that the te s and conditions of this Easement have been violated and request that GRANTEE take corrective action to remedy such violation within thirty (30) days, or such longer time as GRANTOR deems appropriate, of receipt of such notice. Should GRATEE fail to ret to compliance within such time period proscribed by GRANTOR'S notice, GRANTOR may revoke this Easement and record such revocation in the public records of M. 'copa Cou ty. Unless and til such revocation is recorded by G NTOR, this Easement shall remain in full force and effect. Nothing contained in this Easement, however, shall be construed to limit the ability of the GRANTOR to take any action necessary to address d.m age to or interference with the flood control structures or operations caused by GR NTEE or to demand that GRANTEE address any d. age to or interference with the flood control structures or operations caused by GRANTEE. GRANTOR may also request that GRANTEE pay any costs related to d. age or interference with flood control structures of the GRANTOR. 7. Should GRANTEE fail to perfow its obligations in accordance mNth Paragraph 5 A and B herein, G TOR reserves the right to perfom such obligations and seek r&i mbursement from GRANTEE for all costs attributable to G TEE'S failure to perfow . Nothing in this Paragraph prevents or prohibits GR NTOR, in its sole unreviewable discretion, from waiving or deer 'ng to seek reimbursement of some or all of the costs inc ed to perfo G TEE'S obligations wder Paragraph 5 A or B. 8. The GRANTEE agrees to indemmify, defend, save and hold h. less the GR ANTOR, its agents, officers, employees, directors, successors or assigns against any and all claims, actions, costs or expenses for any loss or expense inc ed and all property d. age, personal injuries or death related to G NTEE's exercise of the rights granted herein, uless such d. age, injury or death is caused by a fixture, structure or improvement associated with the flood control project constructed, installed, operated or maintained by GRANTOR in the Easement or othemm se caused by G NTOR's willful, intentional or grossly negligent conduct. As to any claims arising from the G • NTEE allowing access to the Easement for lawful uses by the general public, the G ' NTEE shall, to the extent pe issible by law, inde ify, defend and save h less the GR NTOR, including agents, officers, directors, governors and employees thereof, from any loss or expense inc ed as a result of such a claim or suit, less such claim or suit arises from the sole fault of the CR NTOR. Such inde 'fication obligation is intended to be a specific inde 'ty obligation rather than the general inde 't} obligations set forth in the previous paragraph and shall encompass any personal injury, death or property d. age, reasonable attorney's fees, court costs, and other expenses relating to the defense of such claims or litigation.
