Call to Order
Charles Erickson, Acting Chair, called to order the Local Police Board meeting at 9:58 a.m.
Review and Approval of the Julv 23. 2014 Local Police Board Meetina Minutes
The Minutes of the July 23, 2014 Local Police Board meeting were reviewed. Mayor Jerry Weiers moved to
accept the Minutes as presented. Officer Justin Harris seconded the motion. The Board voted and passed the
motion unanimously.
Consider and Give Direction to the Local Board Secretary on the New Hire Medical Documents
Presented to the Board
The Police Board received information from Jim Brown, Director Human Resources and Risk Management,
and from Nick DiPiazza, Chief Deputy City Attorney. Mr. Brown distributed copies of the survey he had
completed on other Valley cities. Mr. Brown stated that there wasn't a consistency among the cities as to
what documents are given to their boards. The City of Mesa was the only city in the Valley, besides the City
of Glendale, that gave the full medical packet to their board members. Mr. DiPiazza distributed copies of his
legal opinion on what medical documents should be given to the board members. Mr. DiPiazza stated that,
although some of the medical information may not necessarily be understood by some board members, the
members should still have access to the entire packet for their review. In so doing, they will be able to fulfill
their obligation as board members, which is to thoroughly review the information so that they will be
confident in their vote to allow or disallow an applicant for membership into the PSPRS. Mayor Weiers
commented that the board members should have as much information as possible in order to make appropriate
decisions. Officer Carmichael asked how the board would be able to exclude an applicant with a pre-existing
condition such as a back injury that was disclosed by the applicant? Mr. Erickson also stated that an injury
sustained on the job could result in a disability case. Mr. Brown answered that we need to go by the

paperwork from the doctor who had cleared him in the pre-employment exam, and confirm that the applicant
was cleared to be a Police Officer. If a disability is filed at a later date, then an Independent Medical
Examination (IME) would be ordered for the Officer and the IME doctor would determine if the injury was
new or if it was related to the preexisting condition. Mr. DiPiazza addressed pre-existing conditions noting
that there are few people who don't have some type of pre-existing conditions such as allergies, etc. However,
the decision being made is can this person do the job regardless of the pre-existing condition, and has he met
all of the AZPOST standards. Officer Harris asked that if the PSPRS Board takes an applicant into the system
with a pre-existing condition, and then down the road the Officer has a disability, is the pre-existing condition
brought up, and does the PSPRS Board then have to grant them a retirement. Mr. Brown stated that is when
an IME doctor will determine if the disability was because of an injury on the job or was because of the pre-
existing condition. The doctor will look back at the record and determine whether the injury was job related
or was related to the pre-existing condition. That information will then go to the PSPRS Board and it will be
the Board's responsibility to review the documents and then to accept or deny the person's disability case.
After consideration of the board members' input, and based on Mr. DiPiazza's legal advice, Mr. Brown, Board
Secretary, made the decision to continue providing the full medical documentation at this time.
Review and Approval of Application for Retirement from the Deferred Retirement Option Plan
("D.R.O.P.") — Gary V. Myers
The Local Police Board reviewed Gary V. Myers' D.R.O.P. retirement application. Gary V. Myers has
elected to retire from the D.R.O.P. and terminate his employment with the Glendale Police Department on
October 30, 2014. On December 21, 2011, the Local Police Board had approved Gary V. Myers into the
D.R.O.P. At that time, he had completed 26.515 years of credited service. He was required to terminate
employment with the City of Glendale Police Department on or before January 20, 2017. Gary V. Myers is
eligible to retire from the D.R.O.P. and to receive a Lump Sum distribution. He will begin receiving his
normal retirement pension on or about November 30, 2014. The action requested of the Board is to approve
the application for retirement from the D.R.O.P. and lump sum distribution for Gary V. Myers, Police Officer.
Officer Carmichael moved to approve the D.R.O.P. retirement application submitted by Gary V. Myers, Police
Officer. Officer Harris seconded the motion. The Board voted and passed the motion unanimously.
Review and Approval of Application for Normal Retirement — Matthew John Barnett
The Local Police Board reviewed Matthew John Barnett's Application for Normal Retirement. Matthew John
Barnett, Police Officer, has completed 20.022 years of credited service. He is scheduled to retire on October
31, 2014. He has been a member of the Public Safety Personnel Retirement System (PSPRS) since October
24, 1994. The action requested of the Board is to approve the Normal Retirement Application for Matthew
John Barnett, Police Officer.
Officer Harris made a motion to approve the Application for Normal Retirement submitted by Matthew John
Barnett, Police Officer. Officer Carmichael seconded the motion. The Board voted and passed the motion
unanimously.

Review and Approval of Application for Enrollment into the Deferred Retirement Option Plan
("D.R.O.P.") — Clarence H. Haas, IV
The Local Police Board reviewed Clarence H. Haas, IV's D.R.O.P. Enrollment Application. Clarence H.
Haas, IV, Police Officer, has 20.239 years of credited service. He elected to participate in the D.R.O.P. on
August 1, 2014 for a period of sixty (60) months. He must terminate employment with the City of Glendale
Police Department on or before August 1, 2019. Clarence H. Haas, IV has been a member of the Glendale
Police Department since February 26, 2001. The action requested of the Board is to approve the Application
for Enrollment in D.R.O.P. Retirement submitted by Clarence H. Haas, IV, Police Officer.
Officer Carmichael moved to approve the D.R.O.P. Enrollment Application submitted by Clarence H. Haas,
IV, Police Officer. Officer Harris seconded the motion. The motion passed unanimously.
Commencement of Executive Session
Charles Erickson, Acting Chair, recessed the Open Session and convened into Executive Session to review
and discuss the medical evaluations of two (2) new Police personnel.
Reconvened into Open Session
The Board adjourned Executive Session and reconvened into Open Session to vote on the admission of two
(2) Police personnel into the PSPRS with any pre-existing conditions noted on the medical evaluations.
Review and Approve Police Medical Evaluations for Pre-existing Conditions
Officer Justin Harris made a motion to accept the applications of the following two (2) Police personnel into
the PSPRS with any pre-existing conditions noted:
Marcus Daniel King
Cody Andrew Michael Nicholas
Officer Cody Carmichael seconded the motion. The Board voted and passed the motion unanimously.
New Business
There was no new business.
Adjournment
Charles Erickson, Acting Chair, asked for a motion to adjourn the meeting. Mayor Jerry Weiers made a
motion to adjourn the meeting. Officer Justin Harris seconded the motion. The Local Police Board meeting
adjourned at 10:20 a.m.
